'new tonight' -- a 'durham family' -- in 'mourning' and 'looking for answers' -- after police 'shoot and kill' -- their 'loved one'. good evening - i'm steve daniels. and i'm tisha powell. the family' -- is identifying the man 'shot and killed' -- during a 'scuffle' with 'police' -- as 'frank clark'. and they say.... they're not buying notions that clark was in possession of a gun -- as the police chief indicated. angelica alvarez-- is on the investigation-- that also sent an officer to the

police haven't officially identified the man... but family members say frank clark is the man who died today. still no word yet from dpd on who the officers are...the chief has only said one of them is a veteran officer. she's also promising transparency as the investigation continues. tears of grief mixed in a crowd of police...and strings of crime scene tape otlight... as three of her offira on ministrative leave. "we want to make sure that the relationship we are attempting to build here in the city of durham is one that is collaborative, its inclusive and transparent." in a news conference chief cj davis said three uniformed officers were patrolling near wabash and dayton streets... near mcdougald terrace.... an area she says has seen a 20- percent spike in violent crime over the past three months. "our approach has been to gather intelligence through various non-

the officers... stopped a man who was walking... the reason... still isn't clear... but their conversation took a turn when chief davis says the man reached toward his waistband. there was a struggle...and officers heard a gun go off. in response...at least one of them fired. its not clear how many shots were fired. one officer was hurt in the struggle... not shot... and was taken to the hospital. a gun was found next to the body... of who we now know from family was frank clar there is no dash cam video of what happened... and since police body cameras were only approved by the city council just last night... chief davis is asking anyone with cell phone video...to come forward. she says body cameras should become available by the new year. meantime... she says she's reached out to local ministers for help in keeping an open dialogue between police and community. another 'officer - involved

one in robeson county. police were called to the 'dollar general' on martin luther king drive in lumberton. you can see -- a pick up truck in the parking lot is roped off. they have not said what led to the incident.. or the suspect's condition. the s-b-i is investigating. watch for the latest on both of these stories here on abc 11 and on th app. new tonight-- a 'horrible crash' -- 'kills' one person in raleigh.... and sends 'two children' to the hospital... it happened at about 6:30 -- on 'creedmoor road' at 'brennan drive'. ...that's in 'north raleigh'. one adult 'died'... 'another adult'.... and 'two children' -- went to the hospital. police have 'not' said -- what led to the 'two car' crash. new tonight -- crews in raleigh just wrapped up the work to 'patch up' a stretch of capital boulevard. that effort -- began monday morning just after nine -- when a water main pipe burst. that set off a 'domino effect' --

and re-pavement operations on the main "north-- south" artery out of downtown raleigh. all lanes are back open for those of you who rely on the road during your commute. tonight - there's 'another' -- "water main break" -- this time 'not far' -- from "crabtree valley mall". 'raleigh city officials' say -- construction workers - 'hit' a 12- inch 'water pipe' -- between the 'mall' and the 'beltline'. there's a "boil water advisory" -- in effect -- for a 'mcdonald's'... and an 'apartment complex' in the area. 'another' water main break -- also forcing a "boil water advisory" -- this time for a po the 'town of cary' -- issuing the 'advisory' -- for about '120 homes' -- in the area around "glasgow road" -- in the "macgregor subdivision". ....that includes the "macgregor downs country club". if you're under the 'advisory'... you should use 'bottled water' -- or 'boil' the 'tap water' for at least 'one minute'. now to the "race for governor". it's geting 'new' national attention -- and sparking 'demonstrations' -- here at home. it is now the focus of a lawsuit. and governor pat mccrory-- is envoking his right-- to demand a recount. joel brown is monitoring all of

downtown raleigh. it was another fast-moving day... first, here's the latest on the vote tally... roy cooper leading pat mccrory by 6,154 votes. cooper's camps says there's no way the mccrory can catch up... the governor not giving up. - "pack it up and hit the road one term pat has got to go!" tonight at the governor's mansion... demonstrators brought in a u- haul moving van... symbollic suggestion for governor mccrory to pack - "1 term pat was voted out!" - "roy cooper is going to be governor! pat mccrory, stop being a sore loser and move out and let north carolina move on! --cheers--" there's no sign governor mccrory has any intention of conceding soon... in his letter to the state board of election, requesting a recount-- mccrory writes, "with serious concerns of potential voter fraud emerging across the state, it is becoming more apparent that a thorough recount is one way the people of

confidence in the results, process and system." amid the flurry of protests from the mccrory campaign... and then a new lawsuit was filed tuesday by the governor's allies at conservative policy group 'civitas'. - "this is not the governor, this is civitas and frances deluce filing this lawsuit." civitas suing to keep the state from counting ballots cast by voters who used same-day registration... until they've been verified... citing a study by the state that there was 2% higher chance of same-day registrants being inelgible to vote. - "in 2012 and 2008, thousands of voters who registered to same day vote were found not to be verfied." - "stop the carolina coup!" outside state gop headquarters mccrory's critics accused the governor and his allies of an illegal power grab. - "we're putting them on notice that we're not gonna accept a coup in north carolina which is what it amounts to." meantime, county election boards continue to tally their votes. once they're done, the state board can consider the governor's
