i'm justin hinton. we'll tell you how the asheville police department nabbed three people accused of kidnapping children. a toddler falls out of a second floor window in the mountains. the miracle first responders found when they alived. details on a shooting on that left a one year old in critical condition. now from western north carolina's news leader this is news 13 at 11:00. a one year old and a three year old are safe tonight after they were reported missing this morning. but how, where and why they were taken remains a mystery. news 13 justin hinton joins us live from the buncombe county jail. several people from multiple states have been arrested. reporter: that's right. we know four in total. one of those people is here at

we're told the other three are in a georgia jail. they will be brought back to asheville as early as tomorrow. around 4:00 in the morning in reference to a possible kidnapping. sdmrr two kids, one and three. dropped off by strangers, unharmed. but what remains a mystery the circumstances surrounding their disappearance. >> i believe they were in town visiting relatives but the mom is one that initiated the call. in all four people have been charged in the case. these three pulled over in the georgia after investigators say they pinged one of that you are cell phones. investigators down there say the only known connection between them and the two boys is this man. chadwick agan, they say is the former boyfriend of the kid's mother. >> moving forward we have to coordinate with the jackson

georgia and start getting these guys back and the investigate will continue. reporter: a fourth person and the only one that lives in asheville is charged. but only with misdemeanor child abuse. how she's connected to everyone else is not clear. what is clear -- >> it's not a random act of violence. there's no threat to the public right now. reporter: police tell us those kids are currently in the custody of dss. live in asheville, justin hinton news 13. police in the up state are investigating the death of a man. 36 year old man was found this morning. he was taken to spar ton burg regional medical center where he died. the death is treated as suspicious. no other details have been released. a florida family on vacation got a scare when their toddler fell out of a second floor window of their cabin.

a three year old was playing near an open window on the second story taking an accidental fall off the roof. the boy did not appear of the serious injuries and is expected to be okay. >> he was scared. he had his favorite frog. we let him keep it. he's got it with him. besides that he was fine. his mom was in the ambulance with him as well. they both got to go to the hospital. >> that little boy was not able to be air lifted to mission hospital because of rainy weather. new details in a christmas day shooting in chappell hill that left a one year old girl in critical condition. authorities arrested 22 year old davis for the shooting. he's charged with attempted first-degree murder and assault with a deadly weapon. tonight we're hearing from the mother of the little girl as she makes a tearful plea for justice. here is andrea blanford. reporter: a mother broken in grief waiting for her one year

old daughter to wake up. >> she's my heart. hanging in there. >> she takes us back to christmas day. a warm evening that drew families outside these apartments on trinity court in chappell hill. she says adults stood watch as about ten kids ran around playing with their new toys. when a car drove through the parking lot, back up the hill and stopped by the dumpsters as a man inside started spraying bullets below. >> she just started shooting. i started running. reporter: her little girl in her arms. sdmri felt my body being so warm. my baby was just bleeding so much. gasping for air. i kept telling her i love her. please don't leave me. reporter: outside that apartment a neighbor tucks a bible in the middle of stuffed animals piled high under messages for her to stay strong

and keep fighting. her family sending another message to the gunman. >> you no who you are. she saw you. i don't want you to think you're going to get away with it. you need to turn yourself in. reporter: her mom says the bullet that went through her daughter's head wasn't meant for the infant. a happy little girl who everyone adores. >> it was a mistake but you road right by all the kids. you knew there was a chance. why would you do that? now she's fighting for her life. it's killing me. a woman who survived a shooting caught live on television in virginia about four months ago is ready to go back to work. vicky gardener was shot in the back. it happened in august while being interviewed by a crew from a local tv station. a foremaner employee of that station walked up to gardener, reporter allison parker and cameraman adam ward and shot them.

and gardener spent weeks in the hospital recovering. she spoke about the shooting today. >> when he opened fire, it was still very difficult to understand, to comprehend what was happening. it was something that one does not expect to happen. you mind very quick will i goes into a lot of scenarios. but it was very horrific. vicky gardener says she plans to return to her job at the local chamber of commerce in late january. her office is right next to the spot on the balcony where the shooting happened. this morning police detained two people flying a drone over the vatican. officers ordered the pilot to land the aircraft which was equipped with high resolution cameras. the drone was seized. police are trying to verify nar reasons for flying the drone and the video recordings. tornados ripped through parts of texas this weekend. killing eleven people and

of homes and businesses. reporter: a devastating scene in texas sunday. aerial views of homes now reduced to nothing. >> our key focus is this. that is first rescue and recovery. second, aiding and assisting those who need to get to shelter. third is helping families and communities. reporter: late saturday severe storms and tornados tore through parts of dallas with winds traveling between 150-200 miles per hour according to the national weather service. the storm blew off roofs and toppled trees. >> big tornado. big strong tornado. reporter: areas like garland and rowlett took the brunt of the weather. at least eleven people were killed. some along interstate 30 where police say cars appear to have been thrown from the road.

many watched the nightmare unfold from their homes. >> it was just a dark funnel. it was a big roar. it was scary. it scared me. i don't care that easy but i was scared. reporter: others now trying to salvage what's left. >> out of nowhere it happens. and you're left without words. left without a home. reporter: i'm reed binion reporting. the governor of new mexico declared a state of emergency after a winter storm dumped snow on the eastern part of that state. some areas seeing up to 21 inches. snow driftss as high as 8 feet making roads impassable. high winds are also causing trouble bringing down power lines and knocking out power to thousands of homes. forecast is calling for another 4-8 inches of snow in new mexico. wins gusting up to 50 miles an hour. we've had no problems here on what's been a beautiful final

weekend of 2015 but there's rain on the way. karen wynne joins us with the sky watch forecast. >> karen: we have rain on the way. you wouldn't know it by looking at the radar now. a few light spotty showers popped up earlier this evening. but pretty much nothing we see around our region. however, we head out west and see that heavier rain causing flooding and some severe weather back across mississippi, western tennessee. much of this is moving north but eventually quite a bit of this is going to move into the mountains. get that umbrella ready to go for tomorrow. right now we reflect on our very warm, high temperatures. we came within one degree of a record high. made it up to 71 in asheville. morgan ton hit a high of 75. right now comfortable at 60 in asheville. hendersonville 59... franklin 57. we look at the morning planner. an umbrella is in order and

know why she died from a chicago police bullet. the mother of five opened her door as cops confronted 19 year old college student. >> while i'm tempted to still hate. i think we have to show the police officers and family compassion. . >> police say jones was accidentally and tragically killed. officers were responding to a domestic disturbance at a two story house shared with jones. the teen reportedly threatening his father with a bat. >> seven times my son was shot. no mother should have to bury her child. [singing] reporter: this shooting sparking new protest against police and city officials. two days ago protests shut down part of the magnificent mile, the high end shopping district of chicago. the demonstration part of the backlash against other deadly police shootings.

>> if you're afraid of the streets to the point that you've got to shoot first, you need to turn your badge in. reporter: so far the mayor has resisted calls to resign. responding to the deaths releasing this statement. any time an officer used force, the public deserves answers. regardless of the circumstances we all grieve any time there's a loss of life in our city. >> i want the mayor to understand that this is a message to you. you failed us before. but now it's your time to step up. or step down. reporter: alex perez, chicago. iraqi military says they are in full control of ra mad di. the terrorists are said of the fled the complex. iraqi forces are dismantling booby troops around the area.

thunderstorms in cincinnati, atlanta, memphis and behind that some snow all the way from minneapolis to oklahoma city. nice and dry but cold in much of the western u.s. meanwhile, we take a look at what's going on in the mountains and the up state. not much. we had a few very widely scattered light showers earlier. now we just see some clouds. any kind of major rain is well off to the west of us. but it is coming our way so pack up the rain gear and get ready to use it for tomorrow. right now in asheville we are warm and calm. very muggy. 61 degrees with the dew point in the upper 50s. in greenville, cloudy and warm as well. 65 degrees. the air saturated with that relative humidity at 100%. so if you're out and about early in the morning, definitely expect that patchy, dense fog around the region. bigger picture on the future cast showing the warm front well off to the north of us. that is going to be the set up for tomorrow.

we do have this system on the move and you'll notice the snow and the ice staying well off to the west and north of us. but that rain is going to pickup throughout the day. morning commute it should be light and spotty. then we see more green over the mountains as we head into late afternoon and early evening. we see more moisture ahead of that approaching front. we can't rule out a few thunderstorms and periods of heavy rain monday night on into tuesday morning. but by tuesday at 6:00, it looks like much of the rain is going to be over us. quickly we dry out behind that. it's not over yet. we get a break from the rain tuesday afternoon before more moves in on wednesday. hour by hour future cast. closer to home showing the shower activity for morning commute time. on and off again showers. then it picks up as we head towards the evening. heavier rain in the western

the heaviest rain during the evening overnight before drying out briefly on tuesday. rainfall totals as we go through this system are going to be fairly light through the day on monday. maybe close to half an inch in hendersonville and forest city. then we have that heavier rain by tuesday morning, between 1-2 inches of rain in the southern mountains. north up statee clemson could see over two inches of rain. lows tonight remain warm. mid 50s in asheville... franklin 53. tomorrow cooler than today but above average for the highs. asheville 64... burnsville 63. it is going to be windy and that with the rain is going to make it feel a little bit cooler. week ahead, eventually we dry out and cool down. you'll need the suiteweaters and

the last time the carolina panthers lost a game in the regular season was november 30, 2014. 392 days ago. carolina hoping to keep that streak going today on the road against the falcons. another victory for the panthers would put them at 15-0 this season. let's pick up the action in the first quarter. newton keeps the football and goes up the middle for the first touch down of the game. panthers take the lead of 7-0. that would be the only carolina touch down today. falcons come right back down the field early in the second quarter. freeman finds pay dirt and this game is tied up at 7 apiece. fast forward to the third quarter. ryan avoids the pressure and launches the ball.

the north carolina tar heels are getting ready to play in the russell athletic bowl on tuesday. taking on baylor in florida. tar heels one of the highest scoring teams in the country. scoring at least 45 points seven different times. unc played well in the acc championship game losing to clemson by eight points. carolina players were
