the ramseys were all treated. district attorney has full confidence the way they can handle the case despite the mayor. >> tammy: new developments tonight in a bizarre kidnapping case. the case involves suspects from different states. three suspects in georgia just appeared before a judge there. they've waived extradition. news 13's kimberly king is live at the asheville police department. kim, there's also a fourth suspect. >> kim: that's right, tammy. trena weaver and she was in asheville in court today. this is trena weaver. her mug shot taken in asheville in the last 48 hours.

the video monitor facing one count of misdemeanor child abuse. the case involved one-year-old elijah and three-year-old harlee joyner. >> i didn't see the children leave. but we saw the children being taken in. >> by a woman? >> mm-hmm. >> kim: neighbor belinda williams doesn't know the details but she does recognize weaver's mug shot. >> probably three or four sheriff's cars came. >> kim: belinda says she's certain it was that white trailer. >> we saw the children go in with her. >> kim: with the woman? >> uh-huh. >> kim: at 1:13 yesterday, buncombe county sheriff's received a car and deputies, two minutes later, went to the

swannanoa fire department where they met several adults where they found the boys and handed them over to police custody. belinda says she also saw a car that matched the amber alert description yesterday. >> they all looked around the car, inside and out. all the sheriff's deputies left after they made sure that that was the car. >> kim: she says one apd investigator stayed. >> he put her in the back seat. when the wrecker came, they loaded up the car and they left. >> kim: the boys' mother is the person that called in for help and that's what launched that amber alert. meanwhile, the mother's ex-boyfriend is one of the three suspects who is down in georgia. we will get more details on exactly what happened once these three suspects are extradited back to asheville.

kimberly king, news 13. >> larry: a father and his son in mcdowell county are charged after a fight involving a hatchet and a gun. thomas stafford and his son daniel got in an accident. the bullet actually struck thomas' other son in the left armed. both are charged with aggravated assault. >> tammy: hendersonville police name a suspect in the investigation in to a drive-by shooting last week. they're looking for trey bradley. a family member says bradley was dating a girl who lived at the home and may have gotten in to a fight. that was last tuesday. they've seen no sign of bradley since except finding a gold honda that they believe he stole. >> the fear of the guy is brandishing a deadly weapon in

running around without any kind of police protection was a little, yeah, was fearful for us. >> tammy: if you have any information about this case, call the hendersonville police department. >> larry: after a fabulous mild weekend, the rain is back. and looks like it's going to be sticking around for a while. >> tammy: chief meteorologist jason boyer has the details. >> jason: we always have 2013 to look back on. it's not that weather. rivers are high. creeks are high. ground is saturated. anything that falls is pretty much going to be runoff. we have bands of heavy rain working through mcdowell, burke and eastern buncombe. right up in to anderson county. watch out there. those creeks and streams could rise quickly. you could see showers moving in.

4/10 of an inch in andrews. same in franklin. we're getting close to 1/10 of an inch. temperatures in the 60s now. boy, it's warm but much colder to the north. temperatures will stay in the 60s right on through it. rain is likely again for the rest of the evening planner. mostly to the west of asheville before it starts to spread over the entire area. because it's been so warm, we now have flowers popping out across the mountains. ashlea surles is live at owenby orchards. what are they thinking? >> ashlea: jason, the worry now is fruit trees. you can see on some of these apple trees there are already some of these small tightly packed buds on the trees. where we start to have problems is if these buds start to turn in to flowers. if they flower, that's it. they wouldn't bloom again when they're supposed to for the

growing season. so of course we lose thousands of pounds worth of apple crops in the area. most apple varieties need about 1,000 hours in temperatures below 45 degrees. that's about 40 days or so. so there's still plenty of time for that to happen. >> i wouldn't have any concern until late january if we don't see any cold weather in january, yeah, there may be some concern then. peaches and apples. >> ashlea: now if you see actually flowers popping up, don't be concerned. however, they likely won't bloom a second time this spring. so you'll lose out on that color. coming up on news 13 tonight, we've got another sort of weird warm weather story for you. we'll tell you what mountain pet owners are having problems with

close to 100 for many of us. and then they drop off. chances of rain down to nothing new year's day right in to the first weekend of the new year. south-southeast wind 15. dewoint ridiculously warm. 59 degrees. the dew point at 66 degrees. more like may, folks, than anything else, as it has been recently. record warmest temperatures we've now set or met in the last five days. we did it on christmas eve morning, christmas day morning, saturday morning, sunday morning and this morning. 56 is the new maximum temperature. 30 plus degrees in some cases. the average is 28. last night we had several days of record max low temperatures in december was the winter '82 folks.

that was a strong el nio winter. it's coming. believe you me. we have a surge of moisture out ahead of the gulf. that's going to produce showers this evening. another surge comes up courtesy of a low pressure. another wet day wednesday. finally a break. this will be the break that will last in to the new year and beyond likely for most of us. so let's time it out. future cast. 7 o'clock this evening. a bed of thunder working east ward now in to macon, jackson, swain county and approaching asheville. moving east by morning. a lot of us already done with the rain. sunshine in the afternoon. not a ton but enough. and there it goes again, rain back in to the forecast on wednesday, lasting much of the daylight hours.

up to a half an inch of rainfall. it will add up again on wednesday as well. half an inch to an inch again. 60s for lows tonight. it is going to be mild, muggy. it is going to be the same tomorrow. we cool down, though. 30s for lows wednesday night in to thursday. so that likely breaks the streak of record warm lows. it is going to be cold come new year's day. but no snow. and you're chilling down, too, from 70s tomorrow to 40s by saturday in the upstate. >> larry: before some students went on their holiday break, they had a very special visitor at this school. >> tammy: as you'll see in my never stop learning, weeser showed up in a mobile classroom. that's weeser. she's a jersey cow and she's there to teach kids about milk

and the process that it goes through before it reaches their breakfast table. students get to see how cows are milked using a milking machine. they learned that some cows could store up to 30 gallons of milk a day. >> they have machines that milk the cows for them. and they don't really milk it by hand anymore. but they used to back then. >> it's important to drink three servings of milk a day because it helps your muscles get stronger and stuff. and it also has protein in it. >> tammy: look at all those muscles. students also learning about vitamins and nutrients and products made by milk like cheese, sour cream and of course, ice cream. love that stuff.

are hoping to get back on track after having their five game winning streak snapped a few games ago. dylan smith who has shown a natural ability. wayne sutton has been very aggressive. as a result, he has been the big south conference freshman of the week twice already. i talked with head coach nick about an hour ago to get his perception of the team right now. >> it's one thing i like not only about our freshmen but our team. they play hard. they play together and they want to keep improving. that allows us to go in to each and every game with a chance for success. >> luke: tuesday night at 7:30. well it's been a magical

season for the clemson football team this year. orange bowl, the tigers will take on oklahoma. clemson has been ranked as the number one team in the country in every ranking so far this year. they've found a way to win games. deshon watson knows that he can't do it alone and that he has to rely on his team mates if they want to be successful against the sooners. >> each game is a play away from making that touchdown or catch. we just have a lot of playmakers. hopefully we can create problems for different defenses. >> luke: clemson in oklahoma will kick off thursday afternoon at 4 o'clock. the panthers lost their first game of the season against the atlanta falcons. the panthers still have a chance to refocus and get ready for the
