to him. now from western north carolina's news leader, this is news 13 at 11. >> frank: the body of a swain county man missing for more than a month is found. doug balu was found in bryson city. >> darcel: his body was found at fontana lake. >> reporter: doug balu did not stray too far at home in bryson city. he was physically disabled. >> we have been looking for the victim for a long time. we wanted to find him. we were just hoping we wouldn't find him this way. >> reporter: he knew balu and so did many others.

his body in fontana lake. >> it was along the edge of the water. >> reporter: that finding hit a little closer to home. >> whether i knew him or didn't know him, he was someone's son, someone's brother and they're hurting right now. >> reporter: entering the water in tuckasegee river and floating to fontana lake is how police believe balu ended up here. >> with the flooding in the river, that's what we believe at this time. >> reporter: how he wound up in the waters part of what they're investigating and hope to find out with an anticipate on monday in chapel hill. >> it could be accidental. it could be foul play. we just do not know yet. >> reporter: until they get more answers is a waiting game and a sad start to 2016. >> it's the beginning of the new year and i hope this is not how the rest of the year is going to go. >> reporter: in swain county, jerrika insco, news 13.

county sheriff's office made a gruesome discovery today on lower alarco road. that's where the sheriffs say rosco lindsey was found dead on his property where he was cutting trees. a tree fell on lindsey after he cut it down with a chainsaw. lindsey was in his 60s. >> frank: developing tonight, asheville police charge a woman accused of stabbing her boyfriend. police say it was a case of domestic violence. news 13's frank fraboni has the latest on this developing story. >> frank: rescuers roll the victim to a waiting ambulance. his injuries were not considered life threatening. police question several residents outside where the victim lived, including princess

accused of stabbing. she says her daughter monique gaynes stabbed her boyfriend during an altercation about money and a cell phone. >> it happened so fast. i didn't know she had a knife. i said monique, what you doing? >> reporter: her mother says she jumped in her car and fled while he bleeded profusely. monique turned herself in hours later and is now facing charges. >> i said monique, don't leave. she says i'm leaving. she was mad. she's a good person. never been in trouble. doing good in college. >> frank: police charged gaynes with assault with a deadly weapon inflicting serious injury. >> darcel: some jackson county residents are back home cleaning up.

a dozen trailers near highway 107 near cullowhee tuesday morning. they're assessing the damage and trying to save what they can. the red cross helped by giving victims a debit card to replace some needed items. >> yeah, they give us. thank you very much. >> darcel: residents still have emergency needs, they're asked to contact the red cross. >> frank: the rains moved on now but it's starting to feel a whole lot like winter out there. >> darcel: meteorologist karen wynne is here with the cold snap. >> karen: below freezing, darcel. we're coming close right now in asheville. down to 35 degrees. burnsville at that freezing mark at 32. 38 in franklin. still a little bit milder in forest city. we do have mainly light winds around the region.

him. >> frank: there was plenty of support from news 13 viewers donating to a go fund me account. quick recovery led to this special 16-year-old's first job at the halloween super store. >> he was really good at his job. he enjoys it. he only works six hours a week but it's good practice. >> also a good sign for this new year and beyond. >> look forward to spending time with her. friends and family. noah having a healthy life. and to see what it brings. >> frank: the past year brought the challenge of a lifetime with a life saving outcome. >> is this like a dream coming true in 2015? >> oh yeah. oh yeah. oh yeah. >> i think it was. i spent nine years worrying about what could happen.

watching college football. some people started the new year with a run. runners from across western north carolina hit the streets in downtown asheville this morning for the 2016 new year's resolution run. the run started and ended at pack square. >> i have a 17-year old who runs cross country and we love to run together. the first day of the new year, it's exciting to start it with a 5k run. >> frank: we can't forget the baby. mission hospital's first baby of the new year was born this morning at 1:17. jordan ellorry is the first daughter for kevin and pauline sweeten. she was ten days past her due date. mom started having contractions shopping at ingles. it was a wonderful and quick delivevey. >> it was so fast and like, just exciting. i grabbed the doula and i had to hold somebody.

addiction. and forever more >> reporter: cole's family says she'll remain unforgettable in their hearts. she was 65. >> darcel: a new tethering ordinance takes affect tomorrow in hendersonville. city council approved changes to how homeowners could chain their dogs. owners can only have their pets tethered for two hours within a 24 hour period. tethering age of animals from four months to six months. incredible video tonight of an apartment fire in florida. it happened this morning in tampa. dozens of residents were forced out of their homes after a blaze ripped through their apartment complex. it took firefighters about an hour to put it out. thankfully no one was hurt.

apartment, i could smell the smoke and the apartment was directly in front of us on the side of us was engulfed in flames. >> they were able to get those folks out. make sure that there was -- that they were safe so that the firefighters could go in and fight the fire. >> darcel: firefighters say the blaze was so intense. they would likely not be able to determine what caused it. >> frank: president obama is about to finish out the final year in office. the president called it the unfinished business of his presidency. frustrated by congress' inability to pass a bill. he will meet monday with the attorney general to discuss his options, including bypassing congress with an executive order. he's calling for public support. >> we know we can't stop every act of violence. but what if we tried to stop even one?

although you can see we have begun to clear out. we're talking mitchell and yancey counties. that trend is going to continue as we go on through the overnight. much of the cloud cover not real thick. in fact, clear skies at the asheville airport. 35 degrees. we have a light, not really light. but we have a breeze out in the north. that puts the wind chill out at 28. that's how cold it feels in asheville. mild but still chilly in greenville. winds are calm. we'll go ahead and take a look at the eastern u.s. and we can see it's cold almost everywhere except for florida. 29 in cincinnati. 30 in detroit. 33 in memphis. the coldest air is out to the west. denver 20. 14 in casper, wyoming. we have a couple of things going on. we do have this one little

swing here overnight and push some cold air in. then we have high pressure that is going to be in control all weekend long. that is going to keep any moisture across the gulf coast well to the south of us. a weekend full of abundant sunshine. but we have some chilly mornings that we have to get through. we'll take it closer to home. hour by hour future cast. high thin clouds remaining as we go through the overnight hours. we go on in through the early morning very cold and dry. dopt let that beautiful sunshine fool you. it is going to feel freezing. as we go through the afternoon. we go on in to sunday. sunday is also going to be dry. sunday afternoon, a few more clouds move back in to the upstate. lows tonight, we're talking 20s. 27 in asheville. 22 in franklin. andrews down to 25. 24 in newland.
