now from western north carolina's news leader, this is news 13 at 6. >> larry: tonight a buncombe county deputy is off the job after accusations of excessive use of force. >> darcel: news 13's john ostendorf joins us with the story story. >> john: the sheriff says this all started with a child custody call on new year's eve and he says the body camera the deputy was wearing really helped make a decision in this case. deputies and asheville police have been wearing body cameras for about a year. the sheriff's office got a complaint about that call and referred it to current affairs.

cams is it has really cut down on our complaints. we have used body cams to clear officers in a couple of complaints. and in this particular case it substantiated the complaintants. >> john: deputy teeg was written up for a code of conduct violation the year he started. he was promoted to patrol in 2010. now the fraternal order of police here in asheville says officers are rarely at fault in excessive force complaints. >> 700,000 officers in the united states, 99.9, less than 1% accused of excessive force. so statistics are showing the officers are doing their job. body camera shows that. yes if you do go to extremes, body camera will show that or

that or cell phone camera will show that. >> john: he also really couldn't discuss the incident that kicked all of this off saying it's still under investigation. john ostendorf, news 13. >> darcel: we have an update on a mother accused of conducting prostitution out of her waynesville home. she sat down with rex hodge to tell her story. what did she tell you, rex? >> rex: that she allegedly got in to prostitution out of a desperate attempt to help her family. deion grey had a tough childhood in georgia. >> growing up my dad was very abusive. >> rex: by 16 grey was working at a strip club. >> before you know it i'm in to

>> rex: drug arrests followed. booking her was police captain david grey who took her to church and picnics. in doing so, grey lost his job but gained a wife. by 2010, bills piled up. and deion says she turned to prostitution briefly just enough to pay for esthetician school. david had a job with an insurance company but lost it when another company took over. living in moorhead city. job interviews for david but no offers. deion says it's because of his skin cancer treatments. >> those cost anywhere from $5,000 to $18,000 each. and we have no insurance. >> rex: out of desperation. >> we're broke. >> rex: she says she turned back to prostitution for a short

>> the kids were never here. >> rex: deion says she's off drugs. prostitution was for her family. >> do it for just a second. until he gets a job. >> rex: affording her the chance to finish schooling. but deion says the price is too high. >> it's not worth it anymore. i'm done. >> rex: her husband now facing aiding and abetting charges. the man keeps teaching her to keep the faith. >> just keep the faith because it always works out in the end. >> rex: deion grey is scheduled for court january 13th. rex hodge, news 13. >> larry: two people accused of killing a man in hendersonville made their first court appearance this morning. shawn hollifield and savannah

they're charged in the death of deque taylor. two others were charged with accessory after the fact. new information tonight in the dwi charge against the wife of waynesville's mayor jackie brown. court documents says she was operating the vehicle at almost twice the legal limit. the legal limit is .08. jackie brown was behind the wheel on christmas eve when she collided with a truck. one of the passengers in the truck was seriously injured. >> darcel: the sheriff says 38-year-old sabrina painter turned herself in this morning after seeing her photo on news 13. deputies say one dog had no food or water. a second was severely matted. another dog named snoozy was found with a telephone cord

that leg may have to be amputated. >> i guess there's a perception sometimes that people think just because they have a pet dog or a pet cat or a horse, whatever, that's their property. they can do whatever they want with it. well that's not the way i look at it. >> darcel: she's been charged with abandonment and animal cruelty. if you'd like to donate, contact the department. >> larry: we had a nice little warm-up today. and the sunshine helped. >> darcel: but unfortunate the sun isn't lasting long. jason, we have rain on the way? >> jason: yeah, we do. plenty of cloud cover rolling from the west. 59 degrees with the high officially in asheville and hendersonville the same. even low 60s today over the upstate. we've come down to the 40s already in morganton. 46 in newland.

there's a little more push of this cool wedge of air now. that's going to be more noticeable tomorrow as well. low to mid 50s across the mountains. the clouds advancing in from the south and west. we still have that persistent wind. 46 at 7. low 40s by 11. clouds getting on the thicker side. we'll talk about when the rain does come and how much. stick around. >> larry: how much online shopping do you do at work and should it be allowed? some private companies ban shopping on the job. >> darcel: but that's not always the case for government workers. on cyber monday, an investigation found public employees spent hours visiting sites like amazon.com, target, old navy while at work. >> larry: for the most part, it's not against the rules. >> reporter: the monday after thanksgiving was busy for

but it wasn't all work. >> there are certainly legitimate uses. but does it get mangled at work? yes, it happens. basically it's like any other business, it's frowned upon. and actually the policy says you know, let's not do that. >> reporter: news 13 obtained records that shows public workers visiting sites. asheville's 1,000 workers spent a combined 44 hours on the site. or about two and a half minutes each. city officials wouldn't speak to news 13 on camera. but a spokeswoman in a written statement says it's a stretch to assume shopping on the job is an issue. the henderson county manager had the same take. >> is it a problem? i don't see it as a problem.

next . >> darcel: uber drivers at the asheville regional airport are now being charged with criminal trespassing. >> larry: they're issues cease and desist letters to uber drivers. since uber employees use privately owned vehicles, they can't get commercial licenses or for hire tags from the north carolina dmv. >> we need an airport permit for a commercial vehicle. we're not a commercial vehicle. and we can't get for hire plates from the dmv. it kind of sucks but they want us to pay for a permit that we can't even get. >> darcel: airport officials tell news 13 they're working with uber to try to amend this issue. >> larry: tomorrow would have been the king's 81st birthday.

maybe a dusting to an inch. slim chance of anything accumulating at all. but it will get cold and you'll notice that. 52 degrees right now. it's still relatively balmy. south-southeast wind. a little bit of a chill earlier but not much now because the wind is so light. high pressure to the north is actually going to help wedge in cool air. you had to go far to the east towards the triad. we're certainly going to erode away the mild weather tomorrow and get back to chilly weather especially areas east and south. we start to see the warmer air try to come back but it just can't get enough of a push because the clouds and showers will develop. highs in the low 50s. best chance rain will come later in the day. sunday's highs early in the day. falling temperatures. wind starting to crank up. and a chance of rain and snow

future cast. you can see the view across the western north carolinas. a few showers late, late night. tomorrow afternoon might be pretty much on the dry side for most of us. more clouds. here come the showers saturday. saturday afternoon. saturday evening looks pretty wet. and some of those showers may even linger in to saturday night before tapering off. light-light rainfall if anything does come friday. notice rainfall amounts could get over a quarter of an inch in some places saturday. it could come down. even half an inch not in the realm of possibilities. 40s over the upstate. and you're looking at temps in the 50s area wide tomorrow. exceptions north and east. only highs in the 40s for forest city and morganton. it's going to be chilly there. temperatures will stay in the 50s on saturday above average. then coming down big time next week. the wind will be cranking so it

>> stan: the unc asheville bulldogs improved to 4 and o in the big south with their remarkable win against winthrop. mcdowell high school who provided the fireworks in the second half. the most exciting basketball games in the season in this week's game changer. >> luke: during the first half wednesday night against winthrop, it seemed like nothing could go right for the bulldogs. the eagles made nine of their 11 point shots. and asheville trailed at half time. >> nobody was stepping up trying to be a leader. we was just allowing them to do what they wanted to do. >> luke: asheville was staring its first loss in their face. blink. do. been practicing all week.
