tonight, reaction from brewers to how the law's affecting business. now from western north carolina's news leader, this is news 13 at 11. >> larry: developing tonight, madison county deputies are trying to find a man who has been missing for more than a month. >> darcel: here's a photo of 37-year-old johnny cook. he was last seen in weaverville november 28th. news 13's jerrika insco talked with his mother who was hesitant to talk but managed to get a word out about her son's appearance. >> jerrika: the madison county sheriff's office has been investigating this case since his family reported him missing. >> had a very good thanksgiving dinner and haven't seen him since. >> jerrika: it was not until after two special occasions that

they say he often left for weeks at a time to stay with his girlfriend in weaverville. >> he just had a birthday three days before christmas and never, never have we not got to tell him happy birthday. and then christmas, we never seen or heard from him. and his son hasn't either. >> jerrika: for a parent like gayle cook, it's the worst dream she could think of not knowing where her son is. >> nightmare. nightmare for sure. >> jerrika: and also not knowing he is alive. >> we hope and pray to the good lord every day and pray for him >> jerrika: phone calls and spirits. >> there was a call that my son was found with bullets in his head. just please come home to us safe

momma and daddy and son needs you. >> jerrika: if you know where johnny cook is or have seen him in the last month, you are asked to call the madison county sheriff's office. jerrika insco, news 13. >> larry: a second buncombe county sheriff's deputy has been fired after complaints of use of force. today, deputy shawn kent was also terminated. it happened at carmel ridge apartments on new year's eve when the deputies responded to a child custody dispute. a body camera caught what happened. sheriff van duncan can't comment about it because of privacy laws. but he says that video was a factor. >> that was part of the investigation and a very useful part of the investigation. >> larry: kebs was fired tuesday. >> darcel: a travel club in asheville has been ordered to refund customers for failing to

festiva hospitality group sold and marketed members for time shares and vacations from atlantic beach to charleston. the group used an aggressive 90-minute sales presentation. but instead of affordable family vacations, members ended up with costly memberships they could hardly use. >> they should really do research on these types of travel clubs. if they can't find any information about it or it looks like a brand new travel club, that's something to really think about. >> darcel: festiva has been banned from face-to-face sales for three years. and must refund money to their customers. the company says tonight they deny allegations. they also say it was their decision to stop face-to-face marketing.

mostly 30s and low 40s to greet us in the morning. there's 2 o'clock in the afternoon. 50s in our southern mountains. 40s from asheville east and south and that's where this cool air is going to be locked in again tomorrow. we don't move much in terms of temperatures. now that cool northeasterly wind winning out again east of asheville. the warm southerly winds will win out over the tennessee valley. that will bring them in the 50s. but it also brings in moisture. our temperatures will be around 46 at lunch time here in asheville. in the upstate, you're looking at your temperature about the same. even though you start out a few degrees warmer at 42. we'll talk about the rain and then the big chill and some snow. coming up. >> darcel: new tonight, a state law surrounding the distribution of beer has a north carolina brewery halting its expansion and calling for change. news 13's justin hinton joins us live.

>> justin: it has to do with getting that beer to different places like ingles, for example. now if you brew at least 25,000 barrels a year, by law, you can no longer self distribute. so we wanted to know with so many breweries in the area, when it comes to the brewing business, the owners of highland brewing company knew distributors would play a big role. >> buying trucks and working at all those logistics really was not in my father's interest when he was younger in the company. it's really easier to just keep going that way. >> justin: the company relies on 44 distributors. about 2/3 of this line will be on the move early next week. >> it happens to not be in the logistics and trucking industry. it's really such a different business. we love to focus on making beer and then have somebody else get

drink it. >> justin: here they produce 44,000 barrels of beer a year. because they produce more than 25,000, we're required by state law to have distributors. but a smaller group like sanctuary brewing self-distributes. >> it just makes more sense at the moment because we're able to take the beer to essentially the consumer. >> justin: owner joe diamond says it's a little too early to start considering distributors. while there are benefits, he says there are also benefits to self-distribution. >> we're not looking to conquer the world. we're just looking to produce good beer and, you know, be able to be a huge member of the community here in western north carolina. >> justin: that's part of the reason behind a charlotte based brewery that recently made the decision not to rely on distributors. choosing instead to pull out of the greensboro market to prevent going over that 25,000 barrels a

>> instead of just saying, well let's make as much beer as demand dictates, make a floating number out there. >> justin: some people are calling for that tap to be raised to 100,000 barrels a year. we reached across to senator tom a apodaca but he was unavailable for comment. justin hinton, news 13. >> darcel: friends gathered tonight for a couple of benefits for the children of a woman who died last month in a rock climbing accident. bands cranked it up tonight to raise money for the children of kaya gaidish. she died from a fall. the money raised tonight goes to her children. >> for the future.

the plane was flying from eerie, pennsylvania. they planned to land in charlotte to refuel. before they landed, they pulled the plane's parachute and crashed. both people walked away from that crash. >> darcel: a massive international manhunt is over tonight not too far from where it began. the infamous mexican drug lord el chapo it back behind bars. >> larry: he escaped last year. it was a horrible embarrassment for mexican authorities. one they've been trying very hard to live down. >> tonight they can put one in the win column. >> reporter: captured, the

the man called el chapo is once again in the arms of the law. joaquin guzman, the most wanted man in the world, now the prized prisoner. they tracked him down after six months on his trail. killing five of his gunman in the pre-dawn raid. inside a deadly arson of military grade weapons. including 50 caliber sniper rifles and russian rocket propelled grenades. they caught him at a nearby hotel where he was photographed in handcuffs wearing a dirty t-shirt. mexico's president tweeted, mission accomplished. we got him. security camera rolled. guzman is seen pacing in his

monitor, then disappearing along this mile long tunnel. it was the second time he'd broken out of a a mexican prison. the big question now, will mexico finally agree to extradite kenneth moden, abc news, washington. >> larry: well a woman caught a thief on camera stealing a package from her front porch. you could see the man show up on her security camera. grabs her package. inside that is a gift for her daughter. she's not the only one. two other neighbors said they same thing happened to them. the homeowner says she plans to sign for delivered packages from now on. >> jason: a little bit of snow

weather. >> jason: well we talked about it all week. the rain is back for the weekend. 70% of showers. most of that is going to be saturday, not the first half. although there will be a chance of isolated showers in the day. snow mixed inn on sunday. that's behind the cold front that's going to blast through here and really chill us down. and even a chance for showers on tuesday. all in all, the snow that's in the forecast is minimal for asheville. 44 degrees. clear skies. not exactly. it's mostly cloudy. south wind at 6. the wind chill is down to 41. you're socked with the clouds in the upstate. 45 right now. wind chill of 43. that pesky northeasterly wind has been relentless. there's a reason for it. the high pressure in canada pushing down that cool air.

it's very heavy. it's dense and likes to settle in the low spots. most areas have been spared farther west of asheville. i think tomorrow you're going to be warmer in western communities like haywood county, swain, and also graham county. whereas the foothills and piedmont will be stuck with cool air. behinin that system on sunday, boom, a wintry blast. cold, windy, windy, windy weather on monday. and it's going to be mighty chilly much of next week. let's go out to phoenix where it will also be chilly for the big game. yeah, coming on monday. 8:30 is the game time, eastern time. 6:30 mountain time. alabama versus clemson. at kick off, clear skies. temps in the mid 40s by fourth quarter. that's chilly out there. wind vectors all the way through the day tomorrow.

showers in the afternoon. showers even past sunset. then we start to see this rain move out. and then the cold winds begin to blow on sunday afternoon. that's going to rip right through here and bring the showers again. temps in the 30s tonight. highs tomorrow should top out in the 40s. upper 40s in asheville. temperatures go down big time by monday only 30s. 20s several nights. even teens wednesday night.

32 for the high temperature. >> darcel: two iraqi refugees facing terror related charges are connected. they were arrested separately. one in texas and the other, california. the feds say a syrian refugee and promise to teach him to fight. the suspect arrested in california is accused of lying to authorities about his links to terror groups in syria. a philadelphia police officer is recovering after being shot several times and authorities say the shooter claimed to be inspired by isis. the attack was caught on

police say the suspect fired at least 11 times in to a patrol car last night. some of those shots hit the officer in the driver's seat. the suspect was eventually arrested. officers say he confessed to following the islamic state. >> larry: president obama has vetoed legislation that would have repealed the affordable care act. it's one of many measures pushed by republicans since 2010. the bill will go back to the republican led congress, which does not have the votes to override the veto. the legislation would have also cut federal funding for planned parenthood. close call for an atlanta woman who nearly drove off a parking deck. she was charged did drunk driving. an officer was able to pull her out through the back rear door. she was taken to the hospital to be checked out.
