the north carolina utilities commission must make a decision on duke's new asheville power plant proposal in less than two weeks. >> larry: but the commission has a problem with part of that plan. news 13's aaron adelson joins us live near the lake julian power plant. aaron, what does the staff recommend? >> aaron: this staff report came out and recommends the commission not approve a back up unit now, which in six years duke could build. since 1964, duke's coal power plant has served western north carolina. by 2020, duke plans to replace this plant with a natural gas plant. duke's application asked permission now for the ability to build a back-up third unit in the future. >> we're going to keep the lights on up if there in asheville. >> we think it's a good step in the right direction. we're glad they're looking at duke energy's application with a

>> aaron: mountain true had an expert review duke's confirmation and the non-profit filed an affidavit to the commission. they question the whole project's necessity. >> the peaking unit is unnecessary. and not only that but the base units are also too big, too expensive and unjustified. >> aaron: duke projects this areas energy need to grow 7% in the next decade. the new plant with the new third unit would produce almost double the electricity. >> we would rather duke energy put money in energy efficiency and avoiding the need for more capacity. >> aaron: saying no now allows time for technological advances. >> it they're not given for the

we'll cross that bridge at that time. >> aaron: the commission doesn't have to follow the staff's recommendation. the commission meets monday and duke says they'll be there to answer questions. >> darcel: an alert from hendersonville police tonight, raccoons are starting to show up in neighborhoods around the mountains but these aren't your normal type of raccoons. they appear drunk, wobbly, even friendly, pointing to signs they could be sick with distemper. justin hinton joins us live in hendersonville, justin, how many have the city caught? >> justin: there's been five. they've had to euthanize several others. the most recent, a few hours ago. cars, businesses and apparently raccoons.

feet. they literally will walk up to people. they don't seem aggressive at all. to the point where they will walk up and people can touch them. >> justin: crews have been dispatched to five different sick raccoons. from king and first to williams street. >> maybe a six block area where we've had to put four of them down. >> justin: then there's the one that sits in a freezer in a box waiting to get tested for the disease. >> we had to double bag it. trash bag. put it in the box and drove over here. >> justin: here is the western animal disease diagnostic laboratory. michael brought the animal here after his mom called complaining about a raccoon displaying odd behaviors. >> came outside and said the raccoon was sitting watching my dog bark at it.

come back as distemper. i'd hate to think that a rabies outbreak so close to home. >> justin: what should you do if you see raccoons displaying these symptoms? for one, tonight touch it and don't feed it. call local law enforcement. also, make sure your pets are up to date on vaccines because the disease can spread. >> larry: the trial of a transylvania county man accused of killing for revenge began today. richard o'shields is charged with first degree murder in the shooting of mathis. mathis was involved in the death of o'shields' son joey. he was unhappy that mathis was charged with unvoluntary manslaughter saying he got off light.

the law in to his own hands. >> he acted as the judge, jury and executioner. endangering. >> richard o'shields fell to a perfect storm, a stroke, health problems, emotional problems, alcohol. a storm that led to tragic results. >> larry: two of mathis' friends who witnessed the shooting also testified about what they saw that night. >> darcel: an update tonight on the redistricting situation in north carolina. republicans want to push the primaries to june 7th if the u.s. supreme court fails to halt a lower court order preventing elections under the current boundaries. today a house committee approved rescheduling.

all primary runoffs in 2016. meaning whoever gets the most votes will be declared the winner. the measure now heads to the senate. the deadline to register to vote in north carolina's primary is tomorrow. to register, you must be a resident of the county and have been at your current address for at least 30 days prior to the election. you must be at least 18 years old by the day of the next general election. and you cannot be serving a sentence for a felony conviction. for more information about registering, go to wlos.com and click on news links. >> larry: despite legislation passed last october, north carolina still has a ways to go when it comes to hemp. tonight at new mountain asheville, people discuss what it takes to legalize the growing of industrial hemp here in the mountains. news 13's jerrika insco joins us. jerrika, who all was there? >> jerrika: larry, lots of different people.

experts from the states like kentucky who had been farming for years. they say that crop could improve farming in north carolina. before cultivation of it can begin, the nc industrial hemp association has to raise $200,000. that's to fund a commission to create applications for farmers so they can grow it legally. even before that happens, they're still tackling the stigma associated with hemp. >> it's just a crop like any other crop. that's the biggest thing. a big stigma about its cousin, you know, this is industrial hemp. this is nothing other than industrial hemp. >> jerrika: the industrial hemp association's goal is to get that commission funded before the general assembly here in north carolina goes back in to short session in april. darcel. >> darcel: award winning author

wife vicky have made serious diet and exercise changes. and those changes along with the reshape already are helping him meet@one of his goals. >> i've been able to get myself off of some of the medications i was taking. >> darcel: this procedure is usually about $6,000 to $9,000 and is not covered by medical insurance plans. in clinical trials which led to approval, the average patient lost two to three times more weight than those who just used diet and exercise alone. you do need to meet certain obesity criteria and additional risks include the risk of rupture, migration of the balloon and a complaint of reflux after eating. >> larry: good luck to her. >> darcel: there's a chance for wet weather. >> larry: at least this time it will be just rain. >> zack: to start. there's a chance for a wintery mix. but that we'll keep to later portions of the forecast.

weather. >> zack: welcome back. some chilly temperatures to finish up our day. but warm. that is the topic of conversation and warmer temperatures are still going to be on the way as we head towards the weekend. they're all coming from the west as a rigid high pressure is still going to dominate. we're talaling about sunshine to finish up the week. cloud cover for saturdayment then that forecast is going to shift ever so slightly. we'll get to that in just a moment. 36 degrees right now in asheville. what you see is what you get because the wind is calm. winds sustained above 15 miles an hour. not going to be the case tonight. we're going to keep the calmer conditions around. for tomorrow and the sunshine, it's going to be back and in a big way. as i just mentioned, we're going to keep that high pressure around. but it's going to be diving

high pressure has a clockwise rotation. and the second is that a low pressure system has a counter clockwise rotation. that's going to play a big part in moisture. when you do have that moisture from the high pressure and you start to see that southwesterly flow. that's going to bring in some of the cloud cover at first. staying dry on saturday. things startrt shifting as we make our way on sunday. not a whole lot of activity to be speaking of as we head overnight and to the end of our work week. we're going to keep that sunshine and blue skies around. watch what happens overnight bringing us in to saturday morning. you start to see that cloud cover. you start to see the wind vectors. wind speeds are going to be increasing. a bit of a breezier day on saturday.

but it's the showers on sunday that might be a little more scattered. things are going to start ramping up with many areas seeing one to two inches of rain. there's the potential of a wintery mix on top of that. this is something we're certainly going to be monitoring as we make our way to the start of the week. enjoy the weekend temperatures. in terms of the outdoor plans, i think it's probably going to be saturday rather than sunday. overnight lows is going to be chilly once again. just below the freezing mark. you see andrews up at at 32 degrees. by tomorrow, 55 degrees. the sunshine going to be seen all across our region saturday and sunday. that's what everybody is looking forward to. rain, i think a little bit more so on sunday. monday through wednesday, that's the storm tracker we're certainly going to be monitoring. 40 degrees come wednesday

the copter fell to its side. >> larry: a driver was killed after his truck slammed in to a home. it happened in gaston cououty outside of charlotte. police say the driver of the car was speeding, hit a parked truck and crashed inside of the home. the woman her husband were not hurt. >> darcel: a man who tried to rob a walgreens in florida probably didn't happen to run in to a fighter. it happened. and it was caught in surveillance video. the suspect climbed over the counter and threatened to stab he held him there until police arrived. >> larry: conference title is on the line tonight here in the mountains.

thank you for watching. thank you for coming. very nice. that's very nice. somebody in the audience was doing a cheerleader move, which i appreciated. you never lose that, do you. oh, boy. i'm glad you're here. especially after what a mess it was last night. last night, those of you here know, last night the unthinkable happened. it rained. water came down. onto us. some of it got on my body. which was scary. when it rains in l.a. we don't know what too do with ourselves. it isn't a joke. i went to dinner after the show. first of all i forgot my phone. i left my phone at home require went to dinner from work. so i had no idea where i was going. even though the restaurant i was going to, i've been there probably five times. but i now rely so much on my phone to tell me where to go. the part of my brain that knows where things are has been erased.
