>> darcel: robin richardson was charged with first degree murder of tim fry. >> larry: news 13's frank kracher joins us live at the buncombe county courthouse. frank, you've had a chance to listen to the recording several times. >> frank: it was given to us on this cd. half a dozen audio clips. now the judge sealed the content back in december. but they were released today. the call came from this home on crestwood drive. the place where tim fry had lived. >> sheriff's 911, what is your emergency? >> i just shot my boyfriend. >> frank: the voice is that of 47-year-old robin richardson, fry's girlfriend who slowly answers the questions. >> okay. were you having an argument? >> yes. >> have you been assaulted?

>> have you been assaulted? >> yes. >> okay. and where did you shoot him out on his body? >> multiple times. in the gut. i don't know if he's dead or alive. >> frank: fry was shot five times. richardson told the dispatchers she left the gun by his body. she was upstairs when she made the call. >> can you tell if he's breathing. is somebody else there with you? >> no. he's dead. >> okay. what can i hear in the background? is that a tv? >> i just turned it off. >> frank: richardson answered more questions from the dispatcher waiting for deputies to arrive. one of the last about her own

>> and you said you were assaulted. do you need any kind of medical attention? >> no. i'm fine now. >> frank: at the very end of the call, as a deputy enters the home, you can hear richardson say i shot him. she said that twice. she remains in jail under no bond tonight. frank kracher, news 13. >> darcel: developing tonight, firefighters are working to determine the cause of a fire that destroyed a mobile home in fairview. it happened off sharon road around 8:30 tonight. the fire chief says no one lives in the home but it still had power hooked up. he believes it's a total loss. >> larry: new tonight, air quality concerns in enka. debruhl's employees came to work this morning and saw every car covered with mysteryius substance. aaron, what covered the cars? >> aaron: larry, it's a mystery. but every single car has this

you can see a little bit of dew on the hood here. they think it happened at night. they're not sure what this is, where it came from. but again, they think it came sunday night. i spoke with environmental quality. they have not received any calls. there's a little bit of a shine on whatever this is. and that's bringing some of the concerns about what people are breathing in this area. >> it's flickering. see, it went off right there. >> i don't know. looks like insulation. really don't know but would like to figure out what it is. >> aaron: another employee here said they've seen this two or three other times. said it would only come after a weekend.

air quality said they would come out and check out. live in enka, aaron adelson, news 13. >> darcel: an update tonight on a deputy caught doing something they got him in trouble. that deputy has been fired for giving a driver the middle finger. it happened when deputy van anthony crossed paths with scott. on camera, the deputy gave him the middle finger. >> larry: the buncombe county democratic party hosted a town hall with 2016 candidates. about 50 people showed up to meet candidates for county and state seats. the candidates explained a little about themselves, why they're running. which is exactly what voters came to hear. >> i'm new to asheville. just moved here. so i want to see who these people are. and educate myself.

primary is march 15th, except for races for congress. their primary is pushed back to june. >> darcel: migraines, foot pain, back pain. people struggle with pain every day. some turn to acupuncture. >> larry: now also therapists are treating patients with needles. >> darcel: the concern is whether patients are getting injured in the process. kimberly king has been investigating both sides of this debate. what have you found? >> kim: larry, darcel, it's complex and heading to court. acupunctures are suing physical therapists. physical therapists are suing acupuncturists because of that. we go to south carolina where we watched a physical therapist up close.

>> kim: this is patient marion on the table. >> i have experienced migraines for quite a few years. >> kim: she says this has been her salvation. the pt has his ph.d. in physical therapy and certification in this needle therapy called dry needling. >> how deep you have to go. how much play you want. >> kim: this is dr. sissy majebe, a board licensed acupuncturist with three decades of training. >> i can do this right here because the skap pu law . >> kim: acupuncture and dry

while pt says they're different. acupuncturists say it's the same. majebe sits on the state's acupuncture licensing board that has filed this lawsuit to stop pt's from performing dry needling. alleging what they're doing is unsafe and against the law. this suit involves the case of dry needling that caused a patient's lung to collapse. neither hager nor the owner of cornerstone physical therapy where the incident allegedly occurred would comment. >> it's a turf battle nationwide.

federal lawsuit that acupuncture acupuncturists are losing money. if our potential patients believe that dry needling is the same as what we offer, why would they come to us when insurance will pay for dry needling. ironically in 2002, north carolina's pt board published a letter asking if dry needling is in the scope of practice for pts. their answer was no. now the board has changed its stance. there's no doubt that health care is big business. while physical therapists aren't licensed acupuncturists, those who want to learn dry needling, get post-courses. >> there was hands on training.

there was research involved. >> kim: this pt we spoke to is confident in his skill. he got his certification in dry needling with 54 hours of hands on training in atlanta. >> but after that class, they return home and start doing acupuncture without ever having had any clinical training or supervision. this is a three-day class. >> kim: majebe says acupuncturists have hours of training. >> it is our duty to protect the public. >> there's been no increase in claims data. no increase in malpractice. and there has been no significant injury or death to a patient because of it. we're not trying to take business away from acupuncturists.

intervention in our tool box. >> kim: a tool majebe says physical therapists here shouldn't have the legal right to use. attorneys for physical therapists say patients should have a right to choose whatever therapy they want. larry and darcel, washington state has banned pt's from dry needling along with several other states. dry needling done by physical therapists is often covered by insurance, but acupuncture typically is not. >> larry: authorities are investigating a deadly shooting involving a police officer. up next, what family members were saying that does not match up with what police say happened. the chances of them being born on leap day were virtually non-existent. and then it happened. >> darcel: plus a family is celebrating something that only happens every four years.
