frank, who was 73 years old, died after he was hit by the bus. s 41 years old, is at uc medical center with serious injuries. she is in stable condition after surgery last night. investigators say the two were crossing erie avenue and edwards road in the crosswalk when the 51 crosstown bus hit them. there were no passengers on the bus when this happened, but the driver was also taken to the hospital in shock. >> this is a driver that' s been with metro for about 10 years. so a driver that has quite a bit of experience. the driver of the metro bus has been transported. again, very upsetting experience for all of us in the metro family. our hearts are with the people who are involved. dan: cincinnati police say excessive speed and impairment do not appear to be factors in this crash. there are cameras on this bus that will likely take part in this investigation and they are

eyewitnesses. we will continue to follow this story for you. live in hyde park, dan griffin, wlwt news 5. mark: a 14-year-old is now facing serious jail time after he was found guilty of raping another teenager at a party. this all started after a springboro high school football game in september. a teenager decided to throw a party. there was marijuana and alcohol. that' s when police say a girl who was too drunk to walk or even stand was raped. >> everybody that was there knew that she was extraordinarily intoxicated, couldn' t stand on her own, couldn' t speak, and he decided that he was going to engage in sexual conduct with her at essentially the encouragement of some of the other males that were there. mark: the 14-year-old will be sentenced this coming wednesday. lisa: shocking news rocking the thomas more college community . a leader on campus is now facing 36 counts of possessing child

investigation has been going on for years. wlwt news 5' s andrew setters is live in kenton county this morning with the latest details. good morning. andrew: robert marshall has gone from being in charge of campus safety at thomas more to being held here in the kenton county detention center. he was arrested on campus yesterday. robert marshall had been around the thomas more campus for years. he' s been director of public safety for more than a decade. but on his home computer, investigators believe he was collecting child pornography. the investigation was not an easy one. investigators say he used a program to try to scrub the hard drive on his computer, making it more difficult to recover the evidence. marshall was arrested yesterday after being indicted by the kenton county grand jury. >> it' s shocking to me and it' s not really like it scares me, like i didn' t feel unsafe or anything. >> it just blows our minds that

that someone that would do that actually really gross and wrong. that ey would do something like that. especially with children being involved makes it worse. andrew: marshall is facing a 36-count indictment. he' s being held here on $25,000 bond. reporting live from the ikenton county detention center, andrrew setters, wlwt news 5. mark: thank you. senators lobbying their colleagues for help and money to stop the deadly heroin epidemic during a senate judiciary committee. new hampshire is one of the states hit hardest. those testifying are asking for funding to help. u.s. senator rob portman from ohio also testified, speaking on what needs to be done to battle this growing problem. >> from prevention efforts to law enforcement strategies to addressing overdoses and expanding evidence-based treatment to supporting those in recovery, this legislation is comprehensive. it will help communities pursue all of these proven strategies. we need them all. not just one.

overdose deaths involving opioid pain relievers have increased dramatically since 1999, and heroin deaths increased five fold between 2002 and 2014. lisa: time to talk baseball in january. the reds are hitting the road today and kicking off the annual reds caravan. the buses are leaving great american at 9:00 this morning. the reds have four tours heading in different directions over the next three days. the reds caravan will cover more than 3300 miles with stops in five states. fans will get to meet reds coaches, broadcasters, and players. mark: time now to check traffic. kyla: good morning. we are talking about construction. they will be able to get some of that work done. i am sure they will enjoy the warm up getting the work done along 75.

s headlines. new developments in the criminal case against accused south carolina church shooter dylann roof. a south carolina state court will draw from a pool of 600 s state trial this june. . the death penalty. lisa: a candlelight vigil was held in burns, oregon, last night for lavoy finicum. he was the man killed by officers during a traffic stop when authorities arrested ammon bundy and several other protesters who had taken over a national wildlife reserve. ammon bundy, one of the leaders of the movement who was arrested tuesday, told protesters to abandon the wild-life reserve and go home. three more people suspected of being linked to the armed occupation surrendered yesterday. mark: 30 years ago today, one of the great tragedies in american history took place, as the space shuttle challenger exploded just 73 seconds after liftoff. all seven astronauts onboard were killed. this morning, senior nasa

observance and a wreath-laying at the arlington national cemetery. later in the day other nasa centers will hold remembrance events. helping the homeless get the services they need. lisa: people representing social services from across northern kentucky were surveying the region and talking to people who live on the streets. the homeless count helps to establish the level of federal funding that flows to programs to help the homeless. volunteers say it' s important to talk to the homeless and find out how the community can help them get back on their feet. >> it' s really iimportant because it also helps us find any gaps in service so we' re doing this survey with people so it' s not necessarily just counting someone. it' s actually talking to them and figuring out what barriers they have and how we can help them as a region. lisa: more than 300 homeless year' s count. most of those were in kenton county. count tuesday night into wednesday morning. mark: remembering a milford high school teenager who was killed in a weekend car crash. last night family and classmates

lisa: good morning and welcome back. 27 degrees right now. fitbit is arguably the hottest fitness tracker on the market. mark: it seems like everyone has those bracelets that track your steps, and in some cases ,your heart rate. kyla: but does fitbit really

a new lawsuit is saying "no." this month fitbit was hit with a class action lawsuit alleging fraud. according to the suit, two of the company' s heart rate monitors, the fitbit charge hr and the fitbit surge, don' t accurately measure your heart rate, which could be dangerous. the suit surprised consumer reports, who tested and recommended the devices. so, consumer reports retested them. the testers again found both fitbit models were on point, but noted one exception. the fitbit charge hr would give more inaccurate readings at higher intensity workouts, depending on where the strap was put on the arm. if you follow fitbit' s recommendations, however, the monitor seems accurate. while consumer reports says it will keep an eye on the fitbit lawsuit, it says it will continue to recommend the fitbit surge and the fitbit hr trackers. these are really popular. you see the black band on their

september 11th. it' s not clear if that road trip ever happened, but in a 2011 interview with "vanity fair," one of jackson' s former employee s insisted that it did. lisa: a hollywood actor says he wants to move to cincinnati after shooting a movie here. in an interview at the sundance film festival this week, emilio estevez says he would like to eventually live in over-the-rhine. estevez shot "johnny longshot," a movie about horse racing, in cincinnati in 2013. estevez, whose father martin sheen is from dayton, ohio, says cncinnati is a magical place. mark: maybe he can come here. a little sequel action. randi: i saw him once out and about and people started shouting -- chanting "mighty

southbound five is picking up in so. these are easing right along. updated. mark: thank you. new details this morning on a tragic bus crash near hyde park square. lisa: a woman and her father work it as they walked across the street. ve learned overnight. dan: good morning. people. it is a very busy area. from what we understand, a father and daughter were here enjoying a day together. they decide to walk across the crosswalk across erie avenue. they were hit by a metro bus. police say the two were hit by the 51 crosstown bus before 8:00 last night. there were no passengers on the bus. investigators say the father and daughter were crossing the intersection at edwards road.

emily frank, 41 years old, is at uc medical center with serious injuries, but in stable condition. the driver of the bus was taken to the hospital because of shock. the investigation turning to why this happened. >> it is very rare for an accident of this nature to occur with metro. there are some standards that have to occur under the commercial drivers license requirements. you driver will be sent to drug and alcohol testing to make sure there is no impairment. there will be a full investigation. we will wait at this point to determine exactly what happened. our thoughts and prayers are with the family. dan: cincinnati police say speed does not appear to be a factor. they also say the driver has 10 years of experience. there is no word on charges at this point. cpd still looking closely into

happened. this bus and hoping to hear from many eyewitnesses. we are live in hyde park. lisa: thank you. and indianapolis principle is being remembered as a human -- as a hero when she was hit by a bus. witnesses say bus came on a curb and kept going, nearly hitting the kids. to 10-year-olds were injured. and expect her said the bus pass and inspection friday. mark: plenty of questions remain this morning in a wrong way crash that shut down the highway in hebron yesterday. now we have new video of the accident. this is cruiser cam video from a boone county sheriff' s deputy. as the deputy drives up to the scene you can see a pick up truck on fire. investigators say the pickup was spun backwards by a car going the wrong way northbend road. on northbend road. before hitting the truck, deputies say danielle honshell clipped a jeep, and flying glass

as the video goes on, you can see heavy smoke coming from the pick-up. two deputies had to pull the driver out of the truck. in total, four people went to the hospital. no word on their conditions. investigators are trying to figure out why the 22-year-old was going the wrong way. new this morning, cincinnati police are investigating a stabbing in winton terrace. police say someone stabbed a man in the chest around 3:00 this morning during a party. someone then dropped off the victim at u.c. medical center. -- mercy health hospital. no word on his condition. and so far, no arrests. lisa: the safety director for thomas more college is behind bars this morning indicted on 36 counts of possessing child pornography. 52-year-old robert marshall was indicted by a kenton county grand jury wednesday. all 36 counts are linked to material police say was found on his home computer in covington. at this time there is no

school. covington police say this investigation started two years ago in january 2014 after a witness filed a complaint. officials say marshall used a software designed to remove pornographic material, which is why it took so long to find. >> it is very tough. when digital data is deleted or wiped from a hard drive, it makes it tougher for us. lisa: marshall is currently in the kenton county jail. his next court date is monday, february 1 for arraignment. he will remain on administratively from school. mark: a big step for four and ohio bill that would divert total funding away from planned parenthood. the bill. the senate last night. it would restrict $1.6 million in grant funding for going to organizations that perform, or promote abortions. the house passed an earlier version, but will need to pass

randi: welcome back. we are taking a live look outside over the ohio on this chilly thursday morning. i promise you it will be warmer as we roll into the weekend. this is what you need to know. for today, back in the mid-40' s. yesterday, we stayed in the low 30' s. today, mid-40' s. as we head into the evening hours, dinnertime, plan on fairly light rain and flurries kicking in after 8:00 tonight. but 50' s and 60' s on tap starting on saturday. we will look at the forecast that goes 40' s, 50' s, 60' s, 30' s -- all of that in the next week or so. guys? mark: thank you. cincinnati' s police chief and city council. joined the cincinnati board of education to address safety concerns at the city' s schools. one of the issues discussed was

roles in the schools in order to keep kids safe, and deal with bullying before it escalates. the police chief also discussed ways the police department is working with the different cultures represented in our schools. >> we recognize there is a growing immigrant population. we do have a number of officers that do speak spanish. right now, as we continue to hire new officers, cultural competency is something that is instructed to in the police academy. mark: the police chief also discussed active shooter training. lisa: the water crisis in flint michigan has ignited an emotional spark across the nation. the head of cincinnati water works have now met in an effort to make sure the public gets all the facts. an estimated 16,000 lines in homes in the greater are made of lead.

although current treatment procedures minimize the lead coming from the five, they still pose a risk. councilman chris smitherman wants lines tested and reports done. to ensure all residents are not at risk. >> let' s say at someone' s home, there is no leakage, but there is a risk for it. i still believe those property owners should be advised about that so they are monitoring that and can decide whether they want to deal with that or not. lisa: the public safety committee will take up this issue at a meeting on monday. 35 people are on staff to test the water. they test for lead, other metals and bacteria. mark: all cities across the u.s. are governed by the epa' s 1991 " lead and copper rule." since 1991 the rules have been revised several times. but city leaders tell us greater cincinnati water works has always been in compliance. additionally it' s recommended , children be tested for lead

the family of any child found to have high levels of lead in their system is then referred to the health department. in 2014, more than 15,000 children in cincinnati were tested for lead. less then 1% of them were found to have elevated lead levels. lisa: downtown cincinnati has dramatically improved over the past decade. and with a new proposed grocery store that improvement looks to continue. at 16 west central parkway a proposed new building could house a 40,000 square foot grocery and retail space. the four levels above it could be used for parking. there' s also plans for 3 levels of office space. >> we have got the kroger up the street online. you go in there, and there is not a lot of variety product. >> i think it is long overdue. to get more housing downtown, we are at the right where a new downtown grocery store would be

we will be at 44 degrees today the weekend. start at february with some temperatures up into the 60' s. the roads are dry, but radar looks like there is some showers. the air is still dry. we are shooting radar up into the sky seeing the showers, but they hit the ground. everybody is waking up to breezy, cloudy conditions. the line looks impressive as far as what you are actually seeing on the surface, not impressive. a cloudy start to the day. winds out of the south, 13 miles an hour. all across greater cincinnati, the windshield in the upper teens. 8:00 a.m., cloudy, breezy, cool, and 26. we will see temperatures pop-up into the upper 30'
