past several years. during that time, all but two of the businesses left. atwater's restaurant says they're willing to take a chance in the old market, even in this down economy. >> in this economy, while business is not what it was a year ago, it still isn't bad because people -- hopefully we can let them know there is value and money for this kind of food. >> reporter: even if you take into account, the histories, the tradition and the central location, the bottom line has been sort of grim for this place. market house has not been that successful over the past few years. even though you have thousands and thousands of tourists that pass by here every year. even on a hot and humid thursday, the tourist traffic is quite brisk. this place should not have lost money. and that's what the city says. they plan to remake the market into more of a gathering place instead of what the mayor calls a fast food court. >> it's a placfor people to get together, whether you live here or you're visiting. it's still a place to gather together and just enjoy.

we have an outside patio. we hope that that -- that we do things on that patio. >> reporter: lawyers say they will close the market january 3rd. and they plan on taking applications for permanent tenants in october and give the current businesses a chance to stay. that way they can bring the old market some new life. in annapolis, roosevelt leftwich, abc 2 news. >> the former owner of the original steak house and sports heater in parkville has apparently gone missing, leaving behind millions of dollars in debts and confused creditors. osama el atari owned four of the restaurants in maryland and virginia. in court documents, banks say he used nonexistent life insurance policies to get millions in loans. creditors say he owes nearly $42 million. el atari failed to show up for a hearing to consider his creditors' petition to force him into bankruptcy. and now for a look at tonight's top stories, a former baltimore city police officer has been charged with attempted

murder. police say 59-year-old daniel marshall shot a man during an argument. the sykesville man is charged with attempted first-degree murder, assault, reckless endangerment, and handgun crimes. marshall was a city police officer from 1976 until 1986. he left the force because of an injury. baltimore police have arrested three men in connection with last month's shooting at the 700 club on pulaski highway. but tonight a female suspect is still on the loose. the victim was dancing with a group of people when shots were fired. he was wounded and treated at a nearby hospital. but police still have no motive for that shooting. three men have been arrested in connection with the incident. the woman has not been identified. but the club's video cameras did capture her image. detectives believe she freaks the edgewood area of harford county. supreme court nominee sonia sotomayor wrapped up her testimony today before the senate judiciary committee. the panel also heard from

witnesses, including a group of connecticut firefighters. sotomayor ruled against the firefighters in a discrimination lawsuit. that decision was reversed by the supreme court. the firefighters testified against her, but the judge is expected to become the first hispanic to sit on the high court. a warm one out there today with higher humidity. taking a look at some of the temperatures, and the feel-like temperatures at cecil community college, glen burnie high school, veterans elementary in ellicott city and winters mill high school. definitely feeling warm out there. now for the next couple of hours, look for partly cloudy skies. a few showers up to the north and southern p.a. and also in northern delaware. our temperatures will be in the upper 80s for the next couple of hours. some rain is on the way. we'll she you, curve. a hotel and office complex that found itself in the middle of a political scandal goes on the auction block next week. aug's auctioneers begin taking

bids, made famous by the 1972 burglary that led to president richard nixon's resignation. the hotel's owner has defaulted on its loan. now to an update. the former boston med student charged with killing a masseuse he met on craigslist has lost a bid for an investigation into media leaks he claims may have tainted the grand jury that indicted him. last month, an attorney for philip markoff asked the judge to have prosecutors prove media leaks didn't influence the jury. but the judge ruled the defense did not show that grand jurors were influenced. he also noted grand jurors are not banned from reading news reports. investigators have found a safe stolen from the home of a florida couple murdered last week. they also found several guns and believe at least one of them was used to kill the couple. >> in our opinion, this was a home invasion robbery where the

brasila. on the left a picture from 191996. he is an illegal immigrant who repeatedly stab manned and dumped his body under an overpass three years ago. the fbi says she a day laborer and is on the run. if you have seen him call the fbi. baltimore county police are trying to figure out who shot two men in the middle river area. the shooting happened wednesday night at an apartment complex on star wood court. one victim was found there, shot in the chest. another victim was found at the intersection of rossville boulevard and philelphia road. county police say a friend was driving the second victim to the hospital when the car ran out of gas. call police with any information you have about this case. now don't forget, you can see more of our reports by heading over to abc2news.com/crimechecker. if you have any information about any of the crimes we report, please call your local police department. brian kuebler, abc 2 news.

40 years ago tonight, three men huddled together, hurtling through space between earth and the moon. the crew of the apollo 11 was on a mission to make history. within days, the lunar landscape would include an american flag. from cape canaveral, abc's carla wohl remembers a space odyssey. >> reporter: buzz aldrin says he felt a few butterflies as he, neil armstrong, and michael collins climbed aboard the apollo 1140 years ago today. he reminisced at an event commemorating the historic space flight. >> maybe a little unnerving when you climb up and get on top of that thing. >> reporter: people crowded the beaches and highways to watch. a three-day journey to the moon, and a short hair-raising ride on the eagle lunar module down to the lunar surface, a ride in which the astronauts almost ran out of fuel. >> there was a time when the

low level light came on, and we were still 100 feet off the ground. and charlie says 60 seconds. i was beginning to wonder. >> reporter: charlie duke remembers there was dead silence in mission control. >> literally, we were holding our breath when we heard -- then we heard contact, engine stop. >> the eagle has landed. >> reporter: nasa has released new enhanced images of armstrong climbing down the ladder and into the history books. >> that's one small step for man, one giant leap for mankind. >> reporter: it was a triumph of technology and a moment of national pride. >> got the flag up. now and you can see the stars and stripes. >> beautiful, just beautiful! >> reporter: it's been 37 years since the saturn 5 rocket like this last boosted an apollo mission to the moon. now there are plans to return, and eventually to go further to mars.

early this morning, there was some showers over just off the ocean city area. that made their way out into the atlantic. and during the day today, we saw some breaks in the overcast. quite a bit of sunshine. the heat and humidity humid has given rise to thunderstorm activity and very active weather down through the north carolina, south carolina area. the next chance that we're going to get for some showers is going to come from the stationary frontal system. it's going to actually a front that is passing through the area right now will get locked up right here. and then some of this moisture will be traveling along it. we'll see it during the day tomorrow. some much needed rain. right now shower and thunderstorm activity being pick upped by maryland's most powerful radar. having its way down towards the vineland region. out in the philadelphia area getting some shower and thunderstorm activity. right now they've got some thunderstorm watches for northern delaware and into southern portions of new jersey. but around the baltimore area, no precipitation. tomorrow different situation. 267 wise right now, in moncton 90 degrees currently. and again, this is live data, only available here on abc 2.

and the nominees are? we now know who is up for an emmy this year. who is racked up the most nods from the academy. >> reporter: it was the early morning prelude to television's most prestigious prime time event. >> the nominations in the drama series category are -- >> the academy of television arts and sciences unveiling the nominees for the 61st prime time emmy awards. co-host chandra wilson of "grey's anatomy" and jim parsons of "the big bang theory" found out during the presentation that they had been nominated. >> it is completely coincidental that you have both been nominated. >> reporter: the sitcom "30 rock" led all shows with 22 nominations. the nbc come comedy about a fictional nbc comedy swept best comedy, actress and actor last year. now former winners tina fey and
