daughter's life. >> i'm mad as hell at this guy. >> what we need are strong consequences right from the beginning. first time offenders, the data shows is not the first time they've driven drunk. >> reporter: records show smith had repeated traffic violations. in 2001, he was charged with driving under the influence and negligent driving. in 2004, he was pulled over for failing to properly restrain a child in his car. then in 2006, he received a citation for speeding and operating an unregistered vehicle with expired tags. in 2007, he was pulled over again for operating an unregistered vehicle. and in 2008, he pleaded guilty to carrying a loaded weapon in his vehicle. the suspect, 42 years old, apparently lived at his mother's house here on whiskey springs road in frederick county. we tried calling the house. the mother picked up, said "no comment" and hung up the phone. door, but few minutes later, a woman was spotted coming out of the house. advocates against drunk driving say stricker laws need to be in place to keep people like kevin smith off the road. >> there is clearly an indication of someone who is not capable of making wise choices can and good decision. he is someone who clearly lacks solid judgment, and judges need to be looking at his record when the next case goes to court. >> help stop people from going out and destroying people's lives. >> reporter: linda so, abc 2 news. >> smith was release affidavit posting $20,000 bond. the parents of 7, 8, and 11- year-olds arrested last week are demanding an apology. the three boys were caught trying to steal a go cart and a scooter from a neighbor's yard. police say the stolen items were returned and the children were locked up for hours. the parents say they know the children did wrong, but they say the treatment was little severe for kids that young. >> it's horrible.

seeing my 7-year-old handcuffed, sitting on a curb was the worst feeling i've ever had. but i think it was much too extreme for three children to be handcuffed together for that amount of time. >> police say there will be no charges filed against the boys. tonight a nanny is accused of showing pornography to children in her care and asking them to pose nude for a web camera. hyattsville police charge 22 aza hrnjic with child abuse. now according to charging documents, she is accused of showing pornographic websites to a 5-year-old boy and 10 and 12-year-old girls. she is also accused of having sexually explicit conversations with the children. the children told police they locked themselves in the bathroom to avoid the nanny. the 22-year-old is being held on $350,000 bond. tonight police in anne arundel county are investigating a light rail robbery in brooklyn park. a 16-year-old girl told police that she was robbed monday night when she got off the train at nursery road station

in the 6800 block of baltimore and annapolis boulevard. now according to police, four women assaulted the teen and stole her purse. the suspect then ran toward belle grove road. if you have any information about this crime, you're asked to call metro crimestoppers. at 1-866-7-lock-up. two firefighters were hurt battling a fire this morning in east baltimore. the row house fires started around 7:20 in the 200 block of st. matthews street. the fire burned through the roof of the building. one firefighter suffered burns on his neck. another was hurt when he fell, hurt his elbow. both are just minor injuries. the cause of the fire is under investigation. with a $700 million hole in the state budget looming over maryland, the governor has announced the first round of state cuts. more than 280 million in cuts will go to the birthday of public works tomorrow. but as roosevelt leftwich tells us tonight, there are no major layoffs planned for state workers, at least for now.

>> there are many things that we are going to have to do. >> you can describe it as cutting the budget with a fine razor instead of a blunt ax. the governor took little bits here and there to cut down the deficit by about $280 million. >> we will, however have, to make cuts that we wish we did not have to make. >> reporter: some departments hit than others, the biggest losers stem cell research, $3 million. higher education more than $40 million. and the maryland lottery promotion budget cut by $5.5 million. 39 people will lose their jobs, and 18 open jobs won't be filled. the state whittled down expenses by decreasing budget and programs to get already budgeted money back into the general fund. every state department was touched, except one, education. >> there one day will be a recovery. and when that recovery comes, our ability to capitalize on that, to compete not only nationally, but globally will depend on the job we do to protect the priority of

education in the here and now. >> reporter: you have to think for every dollar cut from the state budget, somebody is going to be affected somewhere, like a seat improvement at m&t bank stadium to medications to senior citizens. all these types of things depend on state dollars, but the cuts are going to get worse. >> folks who say that that government needs to operate like a business and sweat out the costs, well, that's what the governor is doing. >> reporter: budget and tax policy institute director neil bergman says these cuts are small compared to the $420 million in cuts looming this year and the budget projected for 2010. he says cuts aren't the only option. >> conventional wisdom is that tax increases this year off the table and probably out of the dining room. but you get to some point where it -- the cuts are so damaging that maybe you bring the tax options back into the dining room.

>> bergeson says the more unpopular issues in tax increases will be hard to push with an election coming up. now to good news or the elementary and middle schools in maryland. it looks like test scores have gone up this year, some of the biggest changes in baltimore. the city and state officials made the announcement today at abbottson elementary school in northeast baltimore that school's students advanced 100% on the test. baltimore students are no longer the lowest performing in the state on the maryland assessment test. in grades 3 to 8, reading scores are up 72% compared to 67% last year. and in math, scores increased up to 63.5%. last year scores were 55.6%. the head of the city school system says the scores are a sign that the schools are finally moving in the right direction. >> craft setting some programs

that are meeting the needs of individual children, including the children who are already proficient. >> ceo andres alonso believe there's are only a few districts in the nation that have made the same. it's the same progress under the no child left behind act. defense contractors moving to maryland say they're going to move too. according to the survey, 58% of the 4300 employees now plan to keep their jobs even after they're moved as part of the federal base realign and closing process. only 13% said they're likely not to move. 29% are still undecided. transportation really was the biggest factor in workers' decision. but the recession, retirement savings losses and the slow real estate market are also playing a role. this week, 17,000 firefighters and emts have come to baltimore with some real hands-on training. it's all part of the firehouse expo. the six-day event offers education, exhibits, and the latest safety training.

today a group of firefighters reviewed training on entering a burning building with the coordinated and controlled fire attack. the hands-on training is held at a variety of locations around the baltimore area reviewing numerous drills. >> they've made mazes inside the building. they have wire and various things that will entrap a firefighter. so they have to learn how to get themselves untrapped and disentanglement. >> the firehouse expo runs through sunday with a parade sunday going right through the inner harbor. and now a look at the harbor. looks pretty nice out there. 79 degrees, relatively mild. meteorologist norm is here with a look at our first forecast. >> take a look at what we found on the radar, just about 35, 40 minutes ago. a little shower developed to the west of bowie, right now making its way over the top of the fort meade area. what we're going to do is get in even closer on that, take it right down to the street level, hoe you exactly where the showers are now heading. they're heading right up towards the severn region, going to pass just west of glen

burnie, and then in towards the baltimore beltway there is more rainfall out to the west that we can see some showers a little later on in evening. here is your forecast or the the next couple hours. mostly cloudy, humid, 80 degrees. that one little pop-up shower could visit the downtown region. but heavier showers are likely, and going to be scattered around later on tonight. we'll tell you all about it, coming up. >> thanks, norm. baltimore county is helping a local farmer build a new creamery. today baltimore county executive jim smith presented a loan to bobby and pam, the owners of the creamery at the belleville farms. the loan will help in construction and equipment for the creamery. krugle creamery will sell organic ice cream, yogurt and butter. kriegels has been battling with neighbors over building a creamery. they're concerned it would build a lot of traffic to the neighborhood. the couple says they're really happy about the loan. >> a lot of hard work, a lot of hard years. and it's neat to see the lord bring us to the point where we can be more profitable.

the next generation can farm. the farm will stay around. >> county executive jim smith says it's important to support agriculture. next wednesday, the county will break ground on a $9 million agriculture center. loyola college may bid on the senator when the historic theater goes on the auction block tomorrow morning. a loyola spokesperson would not say what the college would do with the theater, saying only that the york road corridor is part of a strategic plan. baltimore city bought the theater's mortgage in may with the intent to foreclose and sell the property. but officials fear that sluggish economy would prevent additional buyers from bidding. a new partnership take on the aids crisis. how religious leaders and the university of maryland are coming together to help those living with aids and hiv. got warmer today than i thought. i had a 2-degree guarantee for today of 77 degrees. we warmed up to a high today of 81. 4 degrees higher than our 2- degree guarantee.

provide hiv testing in our city. >> organizers hope the partnership will also set up safe places in our community where people can discuss hiv. a group of maryland teen volleyball players are out of quarantine in china after taking the same flight as a person who later developed the h1n1 virus, or swine flu. the baltimore sun reports members of the maryland junior volleyball club and a group from silver springs were quarantined in a beijing hotel. u.s. embassy officials say about 1800 americans have been quarantined in china since the swine flus began in early may. of the americans quarantined, about 200 have tested positive for the swine flu. now the forecast certified baltimore's most accurate. here is chief meteorologist norm lewis and maryland's most powerful doppler radar. >> another nice day. >> a pretty nice day. we ehad a little bit more humidity today. and a little more heat than i thought we were going to have. more of a cloud cover. but we do have some scattered

all along the eastern seaboard. we've seen a few light breaks in the overcast here, but the majority of the rain back to the west of us right now. we also have a little shower breaking out to the southwest of the baltimore area. the low pressure moving along the eastern seaboard. that's where it's going to continue for the next couple days as the areas of low pressure move in, pull the moisture in from the atlantic, and that's what causes the clouds and the pop-up shower activity. talking about pop-up shower activity there is that one shower we're talking about making its way up towards the severn region, but it's losing a little bit of power. as it approaches the baltimore beltway. there is the beltway right there. it's making its way northward there are showers out in western maryland. but as they're hitting the mountains, they're in the process of falling apart. don't be at all surprised to see some of the showers just kind of pop up and develop as we go through the evening. right now in owings mills 76. 82 in walkersville. 77 in hanover. landover right now at 80 degrees. churchville 74. 81 in rock hall. 78 in lovely tillman island. as far as the forecast for this

an employee at harrah's lake tahoe hotel in nevada claims roethlisberger force herd to have sex last july. the woman also named eight hotel employees who helped cover this up. no criminal charges have been filed. the ravens opened training camp one week from today. rookie quarterback and selected vets report to mcdaniel college monday. the first practice is tuesday. yesterday, we caught up with mark clayton at a charity golf tournament. she ready to put on the pads. >> definitely pick it up, you know, towards -- as you get closer to training camp, you pick up your workout and everything. and you know, just try to get in. i guess already at full speed. so you're not missing the beat, and you're not starting behind. besides trying to find a receiver, the most interesting position should be the kicker. graham was the top kicker at florida state last year.
