found. cho killed 27 people on the campus in 2007 and then killed himself. the records were discovered in the home of the director of the university counseling center. governor tim canes says the records were removed from the counseling center more than a year before the shooting. an investigation has begun into how the records disappeared from the center where cho was ordered to get counseling. the senate today turned aside an effort to carry a gun. the measure would have made concealed carry gun permits valid in all states that allow them, not just in the gunowner's home state. 58 senators voted for the provision, which was strongly opposed by gun control groups. but 60 votes were needed to approve the amendment. abc's taemon bradley with details. >> reporter: by a narrow margin, the u.s. shut down a measure today that would have allowed people to carry concealed weapons across state line. >> state vote has a lot to do

with states rights and the ability of law enforcement to set the safety standards for gun ownership and carrying a concealed weapon in their own state. >> reporter: 20 democrats, most from red states joined republicans in supporting the bill, it fell short by just two votes. republican senators dick lugar and george voinovich surprised nra allies by voting no. although close, democratic leaders said they would have made sure that the bill failed there is so much going on in a vote like this. they know what it's going to take to have it passed. they also know it's important to get the vote out there, to allow senators, democrats and republicans to take a vote on this. >> reporter: big city mayors along with gun victims groups lobbied to defeat the measure because they viewed it as a risk to public safety. in a statement, the nra said not only would the bill have reduced crimes by deterring criminals, it would have protected the rights of law abiding citizens to defend themselves. a prominent african american scholar says he understands in a new and

personal way how african americans are sometimes treated by police. henry louis gates, junior, a harvard professor is outraged after being arrested in his own home. gates, one of the leading scholars on african american history, was arrested for disorderly conduct on his front porch last thursday. he says he just returned from a documentary shoot in china, and his door was not opening, so he and his driver forced it open. a neighbor called police. according to the cops, when police arrived on the scene, gates was out of control, calling a sergeant a racist, and saying "this is what happens to black men in america." >> i don't walk around calling white people racist. hell, first of all, i'm half white myself. 56% white in my dna. my wife of 25 years is white and my children are half white. give me a break. >> cambridge police dropped the charges yesterday. but the department says the incident was regrettable and unfortunate. gates says he wants an apology.

now for a look at tonight's top stories. president barack obama tackles the health care debate tonight in a crime time news conference. the president is urging congress to approve his public before the august deadline. obama is getting resistance from both republicans and democrats. abc 2 will carry the president's news conference live at 8 p.m. the birthday of public works has approved about $280 million in budget cuts to help make up for a $700 million financial shortfall. among the cuts, 34 million in medicaid payments to hospitals, nursing homes, managed care organizations, and other health care providers. the state's board of regents has scheduled a meeting tomorrow to discuss how the cuts will affect the university system. and the troubled senator theater is still owned by the city of baltimore tonight. an auction was held this morning, but no one bid the value of the theater's $950,000 mortgage. the city ended up buying the senator's mortgage after the

theater had taken on too much debt. the chaotic auction was frequently interrupted by area residents and friends of owner kiefaber who claims the city hasn't acted in the best interests of the theater and the surrounding community. in just two days, 70,000 fans will fill baltimore for an international soccer match. tonight city officials are encouraging those fans to use the light rail system for that event. the ac milan versus chelsea football club matchup will be held at m&t bank stadium. it's all part of the world football challenge that brings european teams to the u.s. to compete. this is the first time a soccer game has been held in m&t bank stadium. the event is a big moneymaker for baltimore with sold out hotels and packed restaurants. this can also prove to be a traffic nightmare. >> 70,000 people. of course we want to encourage people to use public transportation.

the investigation into michael jackson's death is continuing tonight in at least three states. los angeles detectives have followed leads to las vegas, while federal agents raided the houston clinic of the doctor who was with jackson when he died. carla wohl has the latest. >> reporter: federal drug enforcement agents and investigators looking into the death of michael jackson raided the houston office of his personal physician, dr. conrad murray today. law enforcement officials tell abc news agents obtained the search warrant after preliminary results of jackson's autopsy showed his cause of death was connected to the powerful anesthetic propofol, which is normally only administered in hospitals. >> searching for drugs? >> no drugs. this is just records. >> reporter: the raid came as a surprise to murray's attorney, who says officers were

searching for information they believe constituted evidence of the offense of manslaughter. ed chernoff said they took a computer hard drive and 21 documents. they also want to interview dr. murray for a third time. investigators did find propofol in jackson's home. now they're trying to find out how it got there. >> eventually they'll take all their information to the district attorney's office, and they will then rule on whether this is a criminal prosecution or not. >> reporter: in an emotional interview, michael's brother jermaine continued to deny any knowledge of his brother's drug abuse. >> i've never seen my brother have any different abnormal behavior, any substance that would cause that. >> reporter: the coroner's office is expected to release autopsy results next week, more than a month after michael jackson's sudden death. carla wohl, abc news, los angeles. now the forecast certified

because of areas of low pressure passing along the coast, causing very rough surf and a chance for pretty heavy rainfall. temperatures in ocean city 83. 85 in downtown. 90 in easton. 8 in philadelphia. and 87 in hagerstown. down in pawtuxent river, maryland, 84 degrees. the satellite picture throughout the day. had morning sunshine, but then as the afternoon went along, and this area of low pressure, and this one here continues to inject moisture into the system, it gave rise to clouds and gave rise to even some scattered pop-up showers and thunderstorms that terry and i were talking about there is still more scattered showers but, most is along the eastern seaboard. there is that developing area of low pressure. we've been talking about this for the past couple days. it's going to move rapidly across the eastern seaboard, as this system makes its way towards the east. here in the maryland area, we're caught in the squeeze play. tomorrow the moisture converging on our region, going to give us a better hans for more general rainfall. even though it's not going the rain everywhere all the time, a better hans for scattered showers around during the day tomorrow. right now maryland's most powerful radar continues to

track those pop-up showers there. now up around harrisburg, york, stretching out west of the hagerstown region. but here in the baltimore area, right now we are precipitation- free. but one or two little pop-up showers could happen. just like it did last night out around the mount airy region, damascus, one little light shower down here. and it developed into a huge thunderstorm. produced hail and gusts of over 40 miles per hour and over an inch of rain in some place while here in baltimore, we went precipitation-free. as far as our online interactive radar, you can access it at abc2news.com. click on the weather tab and you get the weather page. you can move it around. you can take a look out to the west and see the more shower activity that is headed in our direction. you even go for a larger view. you can zoom back and take a look at the eastern seaboard of the united states. you can always go all the way down there. is some of that precipitation showing up around that area of low pressure that is going to be making its way along the eastern seaboard. abc2news.com, 24/7, 365. here is the forecast.

heaviest rain tonight will be out to the west of us. the general rainfall. the pop-up showers don't really come in and show up on the computerized forecast. the showers along the eastern seaboard of the united states will continue to give us a chance for shower and thunderstorm activity during the day tomorrow. heavier rain on the eastern shore. and as we get into friday, things are looking again, scattered showers across the region. not everybody is going to see them. but they are going to be around. but over the week, that's when the heat really comes rolling back in. wait until you see the seven- day forecast. cloudy skies tonight. some early morning fog. showers and storms are going to be scattered around. 68 for the overnight low. during the day tomorrow and thursday, cloudy, showers and storms with a high of 82 degrees. that's the last cool one you're going to see, because wait until you see what happens on friday. starts to warm to 86. 91 on saturday. 90 on sunday, with lots of humidity around. so it's going to feel uncomfortable, even though it's going to be partly cloudy. showers come back out of the region with cooler temperatures on monday and tuesday. and partly cloudy on wednesday with high of 86 degrees. back at 6 with more on the weather. >> all right, thanks, norm. well, for some, eating veggies is tough enough.

but finding part of an amphibian in your green beans, that could make it a little harder. a woman in texas says she found part of a frog in her bag of frozen vegetables. she says she was heating up a great value brand of steamable green beans, making lunch for her kids when she discovered the frog. she bought the beans from wal- mart. she alerted the health department, and the store pulled the rest of the bags from that lot. >> i had put buttner the bottom of the bowl. so i went to stir it, and there is this brown clump. that's a frog! or worse than that, it's part of a frog. 75% of it. they didn't give me the frog legs with it. >> a food and drug officer sent the complaint up to the fda, in the meantime, the health department in that texas town said anything that might make you sick like that frog would probably have been destroyed in the cooking process. not very much consolation. are you someone who likes

hunting for bargains online? if so, we've got a warning about a popular discount clothing website. our consumer reporter john matarese tells us why the feds say stay away so you don't waste your money. >> reporter: the federal trade commission and the better business bureau are cracking down on a popular online clothing retailer. i first reported on this store almost a year ago after complaints about discount clothing that ended up being no discount at all. >> great deals. ten bucks for all this. >> reporter: michael shows me the online store that he says has cost him much time, frustration, and money. it's called classic closeouts.com, a seller of overstock clothing at huge savings. michael says his troubles started when he spotted this kid's bomber jacket for $10. >> it was a jacket for my daughter. it was on sale, free shipping. >> reporter: that was the last he thought about it until six months later when he said the store put another $59 charge on his credit card.

so he went online and found lots of other customers hit with the exact same charge. >> simple google search found out many, many websites with complaints. >> reporter: some customers say the store eventually told them a purchase enrolls you in classic closeouts buying club. for the $60 annual fee that renews every year. classic closeouts never returned my calls, but the better business bureau says it's received 900 complaints as of june 2009, and more than 800 of them unanswered. the bbb now gives classic closeouts an f grade. meantime, on june 24th, the ftc filed suit in u.s. district court against the website in an attempt to get refunds for michael and hundreds of other unhappy customers. this is a good lesson for anyone who likes to find discounts online. if it's not a company that you know, with stores at the local mall, then google them for complaints before you buy.
