suspect. >> reporter: while the elder joseph forest would lose his life in the street, a younger nephew by the same name joseph forest would lose his freedom good she pointed to him as one of the other officers was leading her from the scene and said, you know, get him because he helped try to take my gun. >> reporter: almost a month later the officer offered a detailed written statement of his involvement. >> she said he stomped on her hand. he tried to pry her fingers off of the gun after stomping on her wrist. >> reporter: the father after newborn baby and the other thanker after new business, forest remained locked up with no bail for almost six months when that same officer testified she may have confused him with an unidentified suspect. >> now some mysterious man who the best she could say he had on a pair of nikes. >> reporter: prosecutors have dropped the charges against forest but brown says his

client plans to file suit against the officer and the state's attorney's office for false imprisonment and malicious prosecution. >> this woman is not quite all right, i'm telling you. she's got a gun and a badge. >> reporter: a police spokesman says it will be up to the state's attorney to determine if the fatal shooting was justified and whether the officer could face charges. in east baltimore, jeff hager, abc2 news. >> by the way brown defended another man who allegedly tried to take the same officer's service weapon four years before this most recent incident. a man charged with murdering a woman in a liquor store last november has been declared not criminally responsible. 23-year-old david briggs walked into the store and stabbed 24- year-old iesha in the neck. she died a short time later. the attack was random and briggs did not know his victim. he has been committed to the hospital in jessup.

the mayor of baltimore is charged with perjury and faces trial on november 9. it was scheduled for september but the delay was needed after prosecutors got a new indictment. this inclimate includes new evidence against -- indictment includes new evidence against dixon. her attorneys plan to file a new motion arguing that the state prosecutor has abused the grand jury process. >> we're going to get a little bit more discovery under the new charges and once we go through that, we expect we'll be filing a new motion at least with respect to the grand jury as well as some other issues that we're going to be filing. >> i fully anticipate that the defense will bring up any motion it can, not surprising. >> dixon is accused of stealing gift cards from the needy and failing to report gifts on ethics forms. it was an emotional homecoming for the two american journalists freed from north korea. laura ling and una lee were re- - euna lee were reunited with

no precipitation around the area. nice clear scan but later on this evening we could see one or two isolated showers pop up. it looks like the majority of the rainfall activity south of fredricksburg, virginia. your forecast for the next couple of hours partly cloudy. a few showers later on tonight are possible for the evening time. we'll hang in the upper 70s but cooler steps by tomorrow morning -- temperatures by tomorrow morning and cooler temperatures on the way before we start another warm-up. now to exclusive video. police continue to investigate an apparent hit an run in downtown baltimore early this morning. abc2 news was told the driver was speeding away from police down saratoga street when he hit a person near utah street. police arrested the unidentified driver. the person he hit was taken to the hospital and is expected to recover. city police want your help to find another hit and run driver. 67-year-old john yates was killed while riding a bicycle in the 2800 block of maryland avenue yesterday. he was hit by a truck and police believe that the driver didn't even know that he hit

anyone. if you have any information about this case, you're asked to call baltimore city police at: police have arrested a man in miami, florida for a murder in glen bernie. joseph serio is charged with killing george lamont last month. the victim was found july 15. witnesses told police he shot gordon to death and escaped to florida. he was arrested in miami on unrelated charges and police connected him to the maryland murder. three frederick county students are charged with burning a rival high school football field. it hammed this past weekend but the damage was discovered monday. the 17-year-old suspects are from brunswick high school. the fire marshal says they torched a portion of middletown's expensive new field. they also damaged the game clock and the scoreboard. the damage is estimated at about $20,000. middletown high school officials say the community is pretty upset.

>> i think they're surprised, upset, maybe a little bit of anger which is probably, you know, expected but again i think they'll rally together and we'll move on and have a great season and a great year. >> the three teens are now back at home after being in custody of juvenile services. they face first degree malicious burning and property destruction charges. a memorial is underway at frederick's municipal airport this evening as family and friends remember the victims of last month's helicopter crash on interstate 70 near hagerstown. three of the dead worked at a frederick-based flight school. the fourth victim was a friend. ntsb investigators have yet to determine exactly what what caused the chopper to go down but an initial report he says the pilot took off in questionable weather conditions. doctors made medical history at two washington, d.c. hospitals performing a record seven kidney transplants involving 14 patients and donors who didn't match. the transplants were performed over a four-day period last

month. at georgetown university hospital and washington hospital center. surgeons used a process called plasma exchange. during the process the machine separates antibodies from blood that can cause organ rejection. doctors say the process can also make it easier for african- americans to receive transplanted organs. some of the patients and donors met today for the first time. >> the sacrifices that these people made i really believe will never be forgotten because this will forever change our field, our field of transplantation. >> of the 80,000 people on the kidney transplant list, 36% are african-american but only 15% of living donor kidneys go to african-americans. some bad news about your money tonight if you have a state pension. maryland's public pension fund has fallen by more than 20% over the past year. stocks and other investments held by the maryland state retirement and pension system

hit a high of $40.9 billion in 2007 but it dropped to $28.5 billion as of june 30. the dip could force maryland to dedicate additional money to cover employee retirement costs. now, some good news for the general motors transmission plant in white marsh. the white house says the plant will get $105 million to build batteries and electric drive projects for electric cars. it's part of the government's economic stimulus plan. no one is sure if this means more job at the plant but it could provide more job stability for current workers. wall street's summer rally is on hold after investors learn that business at service companies was weaker than expected last month. that news offset more upbeat news -- [ inaudible ] marylanders love to go boating. but how safe is it on the water

it has been a particularly dangerous summer on maryland waterways. ten people have died in boating accidents and authorities say some of those accidents could have been avoided. maryland department of natural resources says with three months to go in the boating season, the state is on pace to have its worse summer boating season in five years. dnr says eight of ten people who died this year weren't wearing life vests. one of the basic safety rules. >> it happened from deep creek lake to the main part of the chesapeake bay and virtually any tributary so any place where you have water. it happened on smaller lakes, larger bodies of water. whenever you're boating, the potential is there to have an accident. and the number one rule to follow is wear your life jackets. >> the sergeant says they're going to accept up enforcement and education efforts to get

out at bwi. 82 was the high in new york. look at ocean city. they had a high today of 93 degrees out on the boardwalk. as far as current temperatures right now, 80 in york. 58 in pax river. ocean city has cooled off just a little bit. right now they're at 91. throughout the day a few little light clouds across the region. we did see some peaks of sunshine. the majority of the shower and thunderstorm activity right now in western virginia and right on the virginia-north carolina border some very heavy showers and thunderstorms. it's all moving on toward the east. looks like the majority of the rain will stay down to the south in the bat mr area but there is a -- baltimore area but there is a chance we could see a few showers break out over baltimore. we've seen showers and thunderstorms moving down through the ohio and mississippi valley. here's the line of showers and thunderstorms trying to get organized and making its way in our direction but again the majority of the heavy rainfall will be down to the south of the baltimore area both today and also tomorrow. but then back here we've got some cooler air that's going to

be heading in. we'll see that over the next couple of days. right now nothing showing up on maryland's most powerful radar. no precipitation showing up. later on tonight we could see one or two pop-up showers but again it's very unlikely. so as far as making evening plans, looks like the barbecue grill is going to be okay. 81 in carney. bowie at 82. 82 up -- dover delaware 86. did you see the temperature change? that's because this is live data. it's only available here on abc2. we're the only ones that have it as far as the forecast. for tonight scattered showers remain basically to the south of baltimore. one or two showers here is possible. same kind of a situation tomorrow again with heavier rainfall down to the south of the baltimore area. here comes the cool air that's going to be in place the next couple of days. your forecast for tonight, mostly cloudy. some showers are possible late tonight but they're going to be very few and far between if we see any at all.

and obstacle course. >> did gives us a reason over the summer to train harder which gets us more ready for emergencies. >> lifeguards use these skills every day to protect beachgoers. prize were awarded for first, second and third place. it was a day of rest for many players at ravens training camp today. after all, they are over 30. but while the old guys rested, the workouts continued. abc2 news photo journalist lamont williams found out that rookies ruled the day mainly in the stands. >> i get up at 5:00. i live in glen bernie. i bring sodas and ice packs. >> i really like the ravens so much that -- i don't know why.
