>> a top republican leader was forced to backtrack on the always-controversial issue of ear marks. those, of course, are the pork barrel projects that have been so popular among lawmakers. senator mitch mcconnell had long defended that process. but no more. >> banning earmarks is another small but important, symbolic step that we can take to show that we're serious. >> in a strange bit of political theater, the earmark issue put tea party members and the white house on the same side. president obama praised mcconnell's move. but said getting rid of earmarks was only one part of the budget deficit problem. in the house, another bizarre bit of politics was also playing out. veteran congressman, charlie rangel, walked out of his ethics trial, after saying he had no lawyer. >> that didn't stop the committee from hearing evidence against rangel. dave evans of our new york station, wabc, reports from capitol hill. >> reporter: when congressman rangel arrived to his trial, he had one strategy, delay and plead for a postponement.

>> 50 years of public service is on the line. i truly believe that i'm not being treated fairly. and that history will dictate that, notwithstanding the political calendar, i am entitled to a lawyer during this proceeding. >> reporter: rangel showed up with no lawyer, having split with his legal team last month. and then, just last week, prosecutors filed a new 80-page statement of evidence. rangel, clearly, was not ready. >> i did not know until a week ago that this 80-page would be the way you intended to judge my conduct. a week ago. >> reporter: rangel's accused of improperly obtaining four apartments in harlem. he charged with misstating his assets by $500,000. he is accused of failing to pay taxes, and soliciting thousands for a school named after him at city college. >> these allegations, if proven,

would demonstrate that mr. rangel violated the house rules and federal statutes. >> reporter: the committee considered rangel's request but said no. so, rangel walked out. and the prosecution began. >> put simply, the record before you is the record. the facts are the facts. and the counts are ripe for a vote. >> reporter: the ethics committee will continue its deliberations on tuesday morning. now, if that committee, acting as a jury, finds that the evidence proves 1 of any of the 13 charges of congressman rangel, it would move into the punishment phase and a possibility of a vote by the full house. i'm dave evans, in washington, for abc news. we're following a developing story out of pakistan. at least 15 alleged militants have been killed in a suspected u.s. missile strike. the attack took place in the waziristan region, which is home to insurgents. who often launch attacks on u.s. forces across the border in afghanistan. and back here at home, a desperate search is under way in ohio for three people who

authorities now say may have been killed. 10-year-old kody maynard, his mother, tina hermann and her friend, stephanie sprang, vanished last wednesday. along with 13-year-old sarah maynard. she was found in the basement of matthew hoffman. police are hopeful to an extent. >> the fact that only one person has been located since last wednesday, you have to be realistic. i mean, you have to be realistic that there's a possibility that these folks are dead. >> divers searched a lake and nearby areas yesterday. they found two vehicles. but they say, at this point, neither appears to be related to the disappearances. horrifying, new details are now emerging about zahra baker. that's the 10-year-old north carolina girl who vanished last month. court documents say the child was dismembered. and her stepmother led police to her remains in several different locations. elisa baker had been jailed for writing a fake ransom note.

but no one has been officially charged in the girl's death and it's still not clear how she died. zahra would have turned 11 years old today. now, to a new court decision in the explosive immigration debate. california's supreme court has ruled that illegal immigrants are entitled to the same reduced tuition at public colleges and universities as in-state students. the suit was filed on behalf of out-of-state americans that are not entitled to the same breaks. 13 people were arrested at the white house yesterday, after demanding an end to the military's don't ask, don't tell policy, which bans gays from serving openly. the protesters chained themselves to the white house fence. but they were immediately arrested and carried away. the midair engine blowout on that qantas airlines jumbo jet apparently was a lot more serious than first believed. investigators say an oil fire caused pieces of the engine to break away, cutting critical lines in the wing of that airbus a-380. that caused pilots to lose control of the wing. officials say if the incident

had happened later in the flight, it could have brought the entire plane down. four construction workers are now in custody, accused of starting this deadly fire in a shanghai apartment building. at least 53 people died and dozens are now in the hospital. the officials say the four suspects were unlicensed welders helping in building renovations. nasa has found a fourth crack in the fuel tank for space shuttle "discovery." "discovery's" final mission has been put on hold while engineers work to repair those cracks. the next launch opportunity will be in november, and the first week in december. high winds are finally dying down in the seattle area this morning. yesterday, the 60-mile-per-hour gusts created quite a mess. trees, power lines and scaffolding came crashing to the ground. and thousands of people were forced to spend the night without electricity. and now, for this morning's weather from around the nation. a wet day along the eastern seaboard. heavy downpours, hail and 60-mile-per-hour winds from pensacola and tallahassee, in

southern georgia and alabama. rain from the carolinas up to new england and stretching back into the ohio and tennessee valleys. up to two feet of mountain snow in the central and northern rockies. >> 50 in boise. 58 in colorado springs. and 70 in sacramento. it's 48 in omaha. and 51 degrees in detroit. upper 50s in boston, new york and baltimore. atlanta will get up to 66. and new orleans is 70 degrees. breaking business news when we come back this morning. is the housing market due for another collapse? the dire warning released overnight. and a seven-year wait expected to end today. apple's newest addition to itunes.

the foreclosure robo signing scandal is now threatening to spark another crisis in the nation's housing market. that's the finding of a congressional watchdog. the report released this morning finds flawed foreclosure documents could cause the housing market to collapse and literally shatter the nation's recovery. if widespread irregularities are found, it could call into question the validity of millions of mortgages. and good news for taxpayers. just days ahead of general motors planned initial public offering. demand for shares is so high, the automaker is now raising the price range for the stock. gm is also planning to sell more shares than originally expected. that means the government would make more money on the sale, recouping more than its $50 billion bailout. overseas stock markets are sliding this morning. tokyo's nikkei average fell 0.3%

today. hong kong's hang seng is lower. in london, the ftse opened lower. on wall street, the dow added nine points yesterday. the nasdaq was down four points. walmart wants to help you work off your thanksgiving feast with late-night shopping. the retail giant will open most of its stores at midnight after thanksgiving, joining a bunch of other major retailers that are expanding their hours on black friday. but shoppers will have to wait until 5:00 a.m. for deals of electronics. >> let the madness begin. the best-selling band of all-time is joining forces with the world's biggest music retailer. apple is expected to announce that the beatles are coming to itunes. the fab four have been one of the few high-profile holdouts to digital music. the agreement comes after years of lawsuits over trademarks between apple and apple corp, the beatles' company. also, facebook is looking to change the way we communicate, once again. it's unveiled a new messaging

1 car was trapped underneath the truck and at least 20 people were injured. the highway was so icy, part of it was eventually shut down. commuters can expect more slippery roads today, across the central and northern rockies, especially on i-80, from salt lake to cheyenne. i-70, west of denver. wet on i-95, from north florida to maine. and on parts of i-80, 90 and 94, out in the midwest. >> if you are flying, you can expect airport delays in seattle, salt lake city, denver, detroit, and boston down to atlanta. just as we head into the busy holiday travel season, there's growing outrage over new security measures at some of the nation's airports. some passengers are now refusing what they're calling a virtual strip-search. >> and now, the government is trying to head off the criticism. emily schmidt reports from washington. >> reporter: busy holiday travel often means crowded flights. >> come on through. >> reporter: but it's a preflight routine that has some customers missing their personal space.

>> you can do that out here. but if you touch my junk, i'm going to have you arrested. >> reporter: california traveler, john tyner, said that's how he told the tsa he did not want a new, hands-on, patdown search. tyner canceled his flight and posted the interaction on youtube. federal officials say the worry is unwarranted. >> our commitment is to the public safety of protecting the public. >> reporter: two, new security measures prompt the concern. first, 300 full-body scanners now in 60 u.s. airports, with more to come. >> they, in no way, resemble electronic strip-searches. >> reporter: pilot unions worry about radiation exposure for pilots who fly frequently and who have passed extensive security checks. >> to waste the resources, take them away from the true threat, and to apply them to our pilots is absurd. >> reporter: the next security layer is patdowns, with more extensive hand searchs. and no chance to refuse. >> i don't like being touched like that in personal areas and everything. it's kind of invasive.

>> reporter: john tyner avoided the patdowns. but he may pay the price. the tsa says he can be fined up to $11,000 for failing to complete a federal screening. rob and revinita? >> so many of us are flying next weekend. the question is, will the new measures mean it will take us even longer to get to the gate? >> reporter: one travel experts say the body scans take about 30 seconds. the new kind of patdowns are looking more like two minutes. if more people opt out of the scans or decide to protest the system altogether, they really say there's a chance it can slow things up for everybody else. as for janet napolitano, she said yesterday she regrets there's a growing resistance among travelers against these new security measures. >> thanks, emily. in other news, now, the controversial energy drinks that combine alcohol and caffeine could be the subject of an fda warning as early as today. brands including four loko, have been linked to several deaths.

and are now being banned in an increasing number of states. "the new york times" reports the fda is linking to use warning letters to inform the drinks' makers they are considered unsafe. an experiment drug may replace a widely-used stroke prevention pill that's been around for decades. researchers say a new johnson & johnson drug xarelto prevented strokes in people with a common heart rhythm problem. but the new drug is easier to use and didn't cause increased bleeding and some of the other side-effects. sarah palin has rocked the political landscape. and now, the linguistic one, too. refudiate has officially been named word of the year by the new oxford dictionary. palin tweeted the word earlier this year, apparently mashing up refute and repudiate. if you have a fantasy football player, you should hope you have eagles' quarterback, michael vick, on your team.
