-- verdict will come down. a ruling is expected on whether knox can be freed after spending 4 years in prison. she is in court making the plea. she and her ex-boyfriend were convicted of killing her british born roommate. the decision to set her free will be made by two judges and six jurors. here's what she had to say so far this morning in court. >> my life should be taken away from me for something i didn't do. because i am innocent. >> reporter: knox was sentenced to 26 years in prison but she has always denied any wrongdoing. corinne redman, abc2 news. testimony resumes in the trial of michael jackson's doctor. he was with jackson the day he died in 2009 and has been blamed for the popeye con's death. rick vincent has the story. >> reporter: week 2 of the conrad murray trial is expected to pick up where week one left

they tried to revive the pop star. i am rick vincent reporting. headlines around the nation, police in philadelphia say this car wreck was at the hand of a 9-year-old. they say the boy was driving down a road yesterday when he lost control flipped over and crashed into a tree. the child was taken to the hospital with severe head injuries and the last check he was in critical but stable condition. no word on how far the child drove and where his parents were at the time. danger looms in california. people near julian have been warned to be ready to evacuate because of a fast moving wild fire headed in their direction. they are calling it the great fire and it's scorched 2000 acres since it flared up saturday. there's a thousand firefighters are battling the flames. they were told the fire is 5% contained. more on the story to come throughout the week. and hundreds of thousands turned out for the 56th annual miramar air show in california. one of the highlights is the

sunday night officers shot an armed man in south baltimore. sherrie johnson is live outside police headquarters with the latest details this morning. sherrie. >> reporter: at least report, the man that was shot is in critical condition at the hospital. now detectives are investigating that police- involved shooting and it happened last night about 9:00 in the 3600 block of st. victor street in south baltimore. now police got a call of an armed person in the home and the caller feared for their safety. when police arrived at the home they found an adult male between 40 and 50 with the weapon. now police spokesman says when officers entered the home they found a man holding a weapon. they asked him several times to drop the weapon. and they said he didn't and he turned toward officers and that's when he was shot once in the upper body. the victim was taken to johns hopkins bayview medical center and at last report he was in critical condition. none of the officers or anyone in the home suffered injuries.

homicide detectives are investigating this shooting which we are told is standard procedure. reporting live at baltimore city police headquarters, sherrie johnson, abc2 news. this morning police in annapolis are investigating a double shooting a at an apartment complex. juan brown and james wilson were shot and taken to shock trauma. witnesses in the area described hearing argument between two men and another person about a week ago. that argument took place at the scene of the shooting. news time 6:48. the trial of a man accused of killing a fellow patient at a state mental hospital begins today in howard county. he is charged with first and second degree murderer in the death of susan sax. it happened in jessup last year. prosecutors have video of him centering her room before she was strangled. they lived in medium security area in a forensic hospital and both were committed following trials for murder. the family of a man that

died after it eating tainted canteloupe is filing lawsuit. corinne redman is standing bywith more. >> reporter: clarence wells' daughter said they knew there was a problem when their father gained 9 pounds. his infection was caused by listeria. the public health official told the family listeria has been found and was the same strain of listeria found in dna in the bad canteloupes. clarence wells is one of 15 people to die from the fruit shipped from jensen farms. >> it's an enormous hole. it's the first couple weeks i couldn't sit at the table and have breakfast because he wasn't sitting there. and it is really hard. >> reporter: the family hired a seattle based attorney suing jensen farms on their behalf.

corinne redmon -- redman, abc2 news. police say speed was a factor in a high speed deadly motorcycle crash. authorities say juan carlos calderon mejia hit a parked tractor trailer. he was taken to shock trauma where he was pronounced dead. before you get behind the wheel this's new information you need to know that involves your cell phone and texting while driving. linda so is live to tell you about the changes. and the changes went into effect this past weekend. >> reporter: yes. you know now it's illegal to read or even your text while driving even if you are stopped at a red light. the restrictions took effect saturday and it means that an officer is is a primary offense now so if an officer sees you looking at your phone too long he can write a ticket. the first offense care yeas 70 dollar fine and you can get one point on your driver's license.

the cold air on into the mid atlantic and warmest stuff rotating around the other side. so let's put it in motion. that circulation here this is a cool pocket of air and there's rain around the pifry. as -- periphery. that's where the coldest of the air is and it pulls milder air off the atlantic and new england is warmer than we are. let's bring this closer and see the circulation there in virginia and that's a wave of low pressure wrapping underneath the cold core and that is enhancing some of the rainfall here in the piedmont and leading off towards southeast virginia and we have what few sprinkles around kent island and lower eastern shore and there's rain back into the mountains. that's going to try to push in our direction and it's chilly and we are locked in with the clouds although there's been athin ribbon break in the clouds and some of you are seeing brightness in the skies. we have had clean overnight to allow few temperatures like in ellicott city to drop to 39

this morning. most of us low 40s and a struggle rain back to the west will filter in. and it's not going to be a steady heavy rainfall, there will be a few occasional showers. much like we had over the weekend. and we are stuck with temperatures well below normal. through tomorrow morning, there's still the influence of the upper level system clouds and showers around and wave of low pressure pulls off the coast into new england and lowing the wind to pick up out of the northwest -- allowing the winds to pick up out of the northwest allowing things to dry out. wednesday, thursday and friday a shift that's common for the month of october. you go from one extreme and you swing the pendulum the other way. we will get nice payback for this. we have to get through today. monday and may hurt but the ravens won and that should put a smile on your face. 55 this afternoon. two degree guaranteed high and a few shoty showers -- shoty showers. more sun breaks in the afternoon 66. how do you like 70 on wednesday? lows in the mid to upper 40s. we will go 72 thursday and push

our way to the mid-70s by next weekend. and that's 5 consecutive days with sunshine. how about that. >> reporter: i love it. should be like that every week. we have a broken down car report on the inner loop at 59 in arbutus. looking live at the beltway, on the southwest side, we have a little volume here but not much to report at frederick road. it will be slow in the outer loop between 795 and windsor mill. jfx at cold spring has southbound traffic with the volume coming towards the camera. that volume will start probably at the beltway making its way past northern parkway and cold spring. volume continues southbound from the 41st street overpass as you can see. as you make your way down towards north avenue, that continues as well. so, once you get down to fayette treed street you should be okay down to the light. no incidents on jfx and we had a disabled vehicle at ruxton. >> go to the official wmar
