pounds. they think she may have struck again. check your holiday shipments to see if anything is missing. city police now confirm that a woman beaten by her 14-year-old grandson has died from her injuries eight months after the attack. back in march, police say 67- year-old shirley garett's grandson repeatedly hit her in the head with a hammer as she slept. the boy later told detectives he was angry at his grandmother was getting ready for school. garett died over the weekend at union memorial hospital. baltimore school officials did what they could to have a one families bullying problem, that is the ruling from a jury today in a landmark lawsuit against the school system. barry simms has been following the case closely all week. >> if the verdict and hinged on concern for children safety. the parents wanted the bottle -- baltimore public school system

held responsible for bullying incidents against their son and daughter. >> there was not enough credibility for it to be a " bullying case. >> the sullivans' lawsuit claimed their children were believed at their respective elementary schools between 2008 and 2010. their special needs son was beaten, kicked, and stuck in the knee with a fork. >> i will have to tell my son that the system failed him. that we failed him as parents. that we were not able to protect him. >> how did you feel him as a parent if you brought this? he went as far as you could. you tried. >> because we were not able to correct the problem. >> jurors felt the couple presented a strong emotional case, but lacked documentation proving the principal and other officials were neglectful and fail to take action. >> they could not give names or dates. the stories could not match up. the fact that a child was choked

out on school property and one called police. no one got the name of the person who injured the child at the school. no one saw the child being taken to office. the fact that the principle was unaware of the event. >> going to schools verbally complaining and making phone calls means very little. >> obviously, that relies on the people of that school to be able to follow the procedure. procedure does not mean action. obviously cannot complain about something in this case makes no difference whatsoever. >> that is why i say to parents, make a record. the school system -- we do not know to what extent the school principals are writing these things down and actually investigating. >> the retired principal left court without making any comment.

the other principal made a very emotional comment and said with tears in his eyes that he should not have to go with -- through this. >> city police say they do not know why someone shot and killed a 40-year-old man late last night in west baltimore, but whoever did it pulled the trigger more than once. investigators arrived on the scene to find a man with multiple gunshot wounds. he was taken to shock trauma where he later died. homicide detectives are on the case. and fans and players stormed the court in a big brawl on a high school basketball court. after the video was posted online, we told you about it last night. >> one person was taken to an area hospital for a possible minor injury due to the sprawl. what started a brawl is still unclear.

it is supposed to be a high school basketball game, but it looks more like a basket brawl. the melee erupted wednesday night during a basketball game between the hometown connections community leadership academy high school located on the city's west side and cardozo high school from washington d.c. as you can see from the video, which was posted on line, it was a free-for-all. baltimore city school administrators tell 11 news that a fight broke out and fans and players -- among fans and players from both teams. if you look closely, you can see females exchanging blows with males, all while officers tried to break up the scuffles. it was the topic of campus today. >> it was unfortunate that it happened. >> since it is still under investigation, a spokesperson from baltimore city public

schools said no disciplinary action has been taken at this point. they tell us, "the gap -- the outcome of the police investigation will determine our next steps." this mother at the academy says perhaps more security is needed at these games. >> hopefully, it does not happen again. but you know, just next time, take precautions and have more security so it will not. >> we try to contact the district of columbia schools about the debt -- the incident, but they did not return our phone calls before this newscast. >> thank you. more now on the story that we told you about at the top of the hour. house speaker john boehner says he expects to pass a new bill on the payroll tax that by christmas, renewing the tax break for two months. sally kidd is live in the washington bureau with details.

386 children will be picking up much happier on christmas morning. this is the pick up location for the salvation army's angel tree program. gathering toys and bikes and presents for children who need extra -- for families who need extra help this holiday season. and a local business give away holiday turkeys as well. an army intelligence analyst accused in the wiki-leaks scandal will stand trial. the defense says the army had failed the troubled soldier and was trying to strong arm him into pleading guilty. he is accused of handing over thousands of pages of national secrets to wikileaks. if he's court-martialed on the 22 charges against him, he could receive life in prison. there are thousands of vacant homes in the baltimore area, but what do you do if you live right next door and there's a problem?
