ejecting two people inside, the 3-year-old edna zook is at life trauma with life threatening injuries. howard county, dui charges against a woman are thrown out, she walks free because a judge said her rights were violated. brian kuebler joins us now. >> police departments are not supposed to have quotas or a number of citations to give out. one judge in howard county believes police were doing just that. the woman was pulled over and blew more than double the legal alcohol limit. it's why she was pulled over that ultimately let her walk out of the howard county district court with no charges. >> you have to have reasons not numbers to meet, actual reasons to pull over someone and invade their privacy. >> reporter: mark successfully argued that point on behalf of his client based on this memo

obtained from howard county police. one that states officers should be ticketing 2-4 drivers an hour ui patrols to fulfill a federal grant police received. >> what the judge found, they were violating the quota law under the public safety article. therefore they were operating illegally and can't seize you illegally under the constitution. >> i don't know why the judge ruled the way she did. >> reporter: the police chief says the judge let a drunk and reckless driver go over what is basically a misunderstanding. the memo existed and the department does not debate that but it's bad wording by the employee who typed it. >> our memo could have been worded better. i don't think the verbiage in a memo ought to be underpinning throwing out the case. >> reporter: the memo said u

citation, the police said it should have said stops. they want to see enforce to award the money. the employee misunderstood that difference, citations are tickets, stops often are not. police insist it's bad practice to pad numbers and they don't do it. >> there are no quotas in the howard county. >> no quotas in the police department, period. >> reporter: this won't go away while the memo was active from january-april of 2011, defense attorneys have found and will search for other dui cases during those four months. brian kuebler, abc2 news. attempted robbery in lorel this morning leads one man dead, the suspects are at large. jeff hager joins us.

>> it happened in high end town homes, russ green, off of route 198 near the baltimore washington parkway. police say 36-year-old gregory sears arrived home when a pear of masked men met him at his vehicle and tried to rob him. one shot him and fled. the victim survived long enough to tell police what happened. when officers arrived on the scene. one of his friends says the victim was an expect an ex pecktant father. >> they were excited about having a kid. his wife and my wife work together. >> if you have information, you are asked to call crime

as we go through the rest of the evening, temperatures will remain in the 50s, cool, not cold, we will have the southwesterly wind and out five to 10 miles per hour, things will die down more, more breezy conditions and a cooldown on the way. across the country, lots of places that would normally be feeling the cold this time of year are warming up instead over the past week, 900 record high temperatures were recorded. in minnesota they played hockey in t-shirts and shorts. yesterday, rapid city, iowa was warmer than miami. it's hitting the west coast, strong winds could mean 15-foot waves. >> it's really rough. i've never seen it like that before. >> there are a few reasons , there is la niña, a natural pattern, and the arctic steering the midwest from its usual bitter cold feeding.

promising jobs numbers today show the unemployment rate dropped last month to its lowest level in three years, roosevelt leftwich is here with more on what that could mean. >> that's right. 200,000 people had a good december and got a new job. that was job, a real job. not just a job at the mall for the holidays, 200,000 people got new full time jobs last month. the number of new jobs was better than expected expected and the unemployment rate fell. it's a fourth month in a row unemployment dropped. >> we need to have jobs growing at 200,000 per month. it's nowhere near enough to make up for all the ground we lost in 2008, and 2009. >> the labor department says the positions that were added were mostly in manufacturing sector. the white house says they are pleased with the numbers saying it's further evidence that the economy is starting to heal.

good news for anyone looking to buy a home or refinance soon. the rate on a 30 year fixed mortgage fell to 3.19%. economists say it's the sign the coming year will be a buyer's market. qualifying will probably still be difficult. more than a month after a dundalk man and his girlfriend were burned, police charged him saying he lift the woman on fire. miller admitted to pouring gasoline on himself and believe he doused his girlfriend with paint thinner before setting her on fire. he is charged with attempted murder and held without bail. we told you last week about a disturbing new figures out of the military academies, a rise in sex assaults was reported. air force is charging 3 of its cadets with sexual misconduct including one that's charged with rape. investigators say it happened over the past 15 months.
