years. both were seniors and played lacrosse. hugly pleaded not guilty to first degree murderer and five felony charges. family members from both sides were in the courtroom. his attorneys plan to argue love died from an irregular heartbeat caused by taking adderall and drinking alcohol. hugly told investigators he kicked in her door and shook her, causing her head to hit a wall several times. the high profile murder case is garnering media attention like they've never seen before. >> i've talked to people, this is by far, the most attended trial with the most attention, regionally and nationally. >> when court resumes, lawyers will narrow down to 27 jurors. we have a crew in charlottesville and bring you the latest developments on air and on line. linda so, abc2 news.

new this morning, we received a picture of a pastor of the northeast based tabernacle accused of stealing from the government and maybe his church. johnson sent this picture of fannon. he is accused of tax fraud and theft between 10, and $100,000 from the government. it was a joint investigation that came out of an audit which attracted the attention of the maryland state police and the social security administration's office inspector general. >> things were just wrong. we knew it. the trustees got us an attorney. >> fannon is due in court this month to be arraigned on criminal charges of theft and tax evasion. if convicted the pastor could face up to 25 years in prison. governor o'malley will address the baltimore school of law students on marriage e

quality. he feels it is time that the state change. marriage e quality is an issue that's the focus in california today. >> here o'malley is pushing for same sex marriage. on the west coast in california, the 9th circuit court of appeals will issue ruling on whether proposition 8 stands or falls. they jove turned same sex marriage in california in 2008. judges with the court of appeals say they will make the announcement about 10:00 a.m. pacific time in august of 2010, a judge ruled the ban on same sex marriage was unconstitutional. supporters say the judge who made that ruling should have been removed from the case because he is openly gay.

supporters and opponents of same sex marriage are confident this issue will make to it the supreme court. >> on a fast track, unless they set something extraordinarily fast this would not be reheard in the supreme court until next fall sometime. no decision until a year from today. >> either side can appeal the coming ruling and the case could go back to the 9th circuit to do decided by an 11- judge panel. washington state could become the 7th state to allow same sex marriage. the state showers will possibly vote on the bill and looks like it could pass, the senate passed it last week. high school voted the third best play in the video contest. tonight, at the walkersville high school gymnasium, the school will be awarded $7500
