attorney tried to end the murder case against him today, the judge in this case ruled that is not going to happen. after the prosecution rested its case the defense attorney argued that there wasn't enough evidence to support the murder charges and he filed a motion to dismiss. the judge disagreed and offer ruled the motion. >> this is not a situation where the commonwealth has to prove it beyond a reasonable doubt. they have to have enough evidence, that is the judge takes the evidence in the light best for the state giving all the evidence and all the -- and so unless there is absolutely no evidence that would sustain a charge at this stage at the end of the prosecution's case they will let the case go forward. >> reporter: this morning several lacrosse players testified hugeley's teammates talking about his behavior before the death, behavior so normal they were prepared to

main break-in southwest baltimore that shut off service to hundreds. crews fixed the break but many don't have service. we are live with the latest. >> reporter: right now they are still going through the process of cutting off the gas to all the houses. they have come along very far with that. they probably only got a hundred or so to go. if you look behind me the gas main is fixed. you see the yellow things, the yellow markers, that's where the main was. that's where the water main break started that caused the gas main break that caused a lot of problems in the neighborhood. there is still work to be done. a lot of work that needs to be done. a lot of people are getting ready for what may be a long night. it's not always easy to deal with thing that are out of your control. first there was a water main break on monday. that brought in the city and now the gas main break that has

people dealing with that. it hasn't been a good week so far. >> i think -- i take a shower and nothing. you can't do nothing at all. no heat for your house or nothing. >> reporter: people in the block have been here for a lot of years. they say this is the second gas main break they have had in the past 20 years or so. sandra anderson was more put out earlier by the water main break. she said that was almost a disaster. >> how am i going to flush the toilet? i have no water. i took a trash can down here where the mainline was take -- pumping out the water and filled it with water and that's how i was able to flush the toilet. >> reporter: it'll be another day or so before the gas can come back onto every home. they have to make sure the gas

is off in every affected home before it can restart the line and then they have to go back to all 900 homes and turn it back on again. at this point, it's just time some say to hun connection r do. >> my husband for valentine's day heated up a big thing of water for me that. was my present. all in all its been good. i mean the guys have been great and we make do. >> reporter: now there is a whole process that has to be done here. after they get the gas off in all the houses they have to restart the gas line. after that is done, they have to go back into the 900 buildings affected cut the gas back on. because of the water main break some of the water got in to the gas line so they have to get the water out of the gas line l is a big process here. we are talking act something that may take until the weekend

think that more and more delegates are realizing that as other states have done we can protect religious freedom and rights and i hope we find the will to pass this as other states have done and ultimately the people will have their say on this. >> reporter: some opponents are worried it'll force educators to teach about same sex marriage in schools and threaten religious freedom for people who survive services for weddings. if the house and senate sign off maryland could be the 8th state to legalize same sex marriage. state lawmakers want to crack down on human trafficking so they are joining forces with a task force. a senator is among the lawmakers sponsoring bills to expand the definition of child abuse to include human trafficking, porn and prostitution. the bills would raise the fine

and crime to a felony for kidnapping a child under the age of 16. >> if you want to get serious about it we have to take the profit out of it and that means we need to take all of the proceeds from human traffickers. >> the maryland human trafficking task force was created in 2007. jerry san dusk you can costing penn state millions. the university said the scandal against him has run up a bill of $3 million this legal, consultant and public reactions fees. alumni donations, student tuition or taxpayer dollars aren't being used to cover the cost. well, another beautiful day. calendar still says it's february but it didn't feel like it. maybe change could head your way. let's check in with wyatt, look

three degrees from yesterday's numbers, the mid to high 50s. today that wind shift out of the northwest, 48 york, 50 wilmington and the state capitol checking in at 53. satellite, radar, showing basically not a thing this is a quiet weather day that we kind of like in the storm center. we get to relax before yet another rain maker. this is set to arrive, beginning tomorrow afternoon i think the best chance for a significant rain will come in later tomorrow evening. as we look at that thursday rain maker, the big question mark here is how much of the moisture will pass south of us and how much will come up into maryland and it's the same question for sunday. high press ire in control for tonight will keep us high and dry and very dry air at the surface as well. maybe tonight one of those nights you run the humidifier. we look at the future trend, from tonight in to the morning clouding up. chances for rain around 1:00

o'clock -- 2:00. a lot of moisture, down through virginia. some of it still could end up passing over baltimore, over southern and central maryland. at this point looks like a lot will be just south of us, maybe showers and we are done with this tomorrow. if this tracks further north that is going to mean a heavier, steadier rain. it'll all be rain. temperatures just to warm to support any winter weather. we are clear, dry and off to a great start on friday, sun, back into the 50s. just like today. overnight down to 35, clouds increase, chilly, thursday two degree guarantee, we will go 50, cloudy and breezy. rain developing through the day, showers lasting into tomorrow evening. the potential to be heavier if you get the bulk of that moisture tracking further north and into the state. check out the seven day forecast as we look ahead and find temperatures will run above average. mid40s will be normal. we are in the 50a's.

and has the longest tenure, this is his last year and today he joins me with more on his career. thank you for being here. >> delighted to be here. >> let's talk -- let's reflect on the 12 years, what comes to mind as you think about those 12 years in. >> there has been rewarding 12 years, very exciting, more importantly, i think reflecting most superintendents and school systems, with over 100,000 students and a diverse population, rarely survive four or five-years and the fact that i'm one of those rare individuals who have benefited for 12 straight years in one school system, speak volumes to the level of support i received from the community special from our board, more importantly the response from our teachers, we have 17,000 employees in baltimore. again those wonderful children, 10 5,000 students and just

fantastic. >> and how did you face some of the challenges? >> the superintendent is one of those jobs where you are -- look like everything is calm on the surface and you are pad eling like crazy underneath. a lot of what i do is driven by a spiritual strength more than anything else. have you to have a strong sense of values and beliefs. i believe in education in particular in this country is driven by belief and values, people who believe strongly in traditional education and people who believe strongly in choice options, people who believe in private schools. baltimore we have a -- at least 33% of the population with children of school age who believe in public education and the baltimore schools. >> wow. so june 30th marks your last day and we wish you much continued success in your future and thank you again. >> thank you.

. in tonight's health alert the fda is warning that certainly medical practices, a type of drug used to treat cancer isn't the real deal. the fake ones label is in french. it doesn't contain a key ingredient to treat cancer. the real one the label is in english . it's not known if anyone in this country got the fake movement about 26.7 million people over 50 suffer from hearing loss. now a new study, found that only one in seven of them use a hearing aid. for working age adults 50 to 59 that number dropped to fewer than one in 20. researchers say the numbers

reflect a shortage of health insurance for hearing rehabilitation and a widespread belief that it's not that big a deal. in fact it is associated with falls, poor brain function and even dementia movement sinus infections are common and doctors often prescribe medication for them. a new study finds in most cases, they are not even necessary. washington university researchers followed 166 people suffering with infections, half were given a medication while the others just took a sugar pill. both groups also took over-the- counter medication for pain, cough and congestion. after about ten days, 80% of them in both groups felt better. most of us will get better without them, experts say after seven day itself s if you feel bad, have a fever ever 101 or higher it may be time for
