million yearly to school construction budget by the end of july next year. >> reporter: today city council vice president and various community organizations got a tour of patterson high school. they saw the boiler room. >> patterson was built in 1958. this is one of the original boiler that came with the school. . as you can see, this boiler has been condemned for the last three to four years. >> reporter: they saw school falling apart because of age and neglect, visited classroom for the temperature was above 94 degrees and heard from the students. >> don't -- [inaudible] the raid ate ear is open where you can see the wires and the power sockets are open too. > students don't care to even come to school because of the conditions. >> the bottle tax is us putting our money where our

condition tonight after she was shot inside her washington state classroom. >> reporter: here is what happened. kids packing up, ready to go home when a gun goes off inside a backpack, hitting an 8-year- old right in her stomach. the school immediately went into lockdown. teachers doing their best to control the situation. parents of course panicked. as they waited to see their children. >> i just want to know who the child is that got shot. i don't know if it's mine. >> reporter: it was amenia who was taken to the hospital where she went into surgery right away. she is expected to recover. a 9-year-old boy was charged as a juvenile with unlawful possession of a firearm and bringing the gun to school. parents still want to know how he got a gun and why it wasn't locked up and unloaded. >> thank you. more to come on this. news from around the nation starting off in new jersey

where a grandmother and four children were unable to get out of a burning home. the fire started around three this morning at the home which is more than a hundred years old. the children ranged from two to 12 years old. the children's mother, her baby daughter and 15-year-old son managed to get out. we don't know what caused the fire. a train derailment caused headaches in texas. several road hazardous to be shut down after at least five train cars derailed. officials say the cars were carrying car parts so there were no health concerns, all but one of the roads was reopened late in the day. nobody was hurt. and a judge has ordered a plan to apologize to his estranged wife on facebook. he ruled mark byron violated a protection order after posting a picture of his son and himself while venting his frustration over his divorce and child visitation. despite his wife being blocked she saw the comments and a

judge ruled in her favor. he now has to post an apology every day for 30 days to avoid a 60 day jail sentence. he said he just wants freedom of speech and to see his son more. ist on one hand i have been told i can't say what i want it to say on facebook and now i must say something they are telling me i have to say. this prewritten apology. >> the judge also ruled that he has to grant friend status to his wife or someone of her choosing to monitor that page. gas prices have grabbed all of our attention lately but for one reporter it turned out not to be her main story. coming up how a live report on increasing prices nearly came to a crashing halt. and a diet pill may help you shed pounds, how it's rebounded after being rejected by the fda.
