this decision i want to digest it but it's a sick feeling to think what i have to do to put the constitution back together. >> supreme court decision affirms the president and affirms the proper role for the congress of the united states. >> mixed emotions from local and national lawmakers on the u.s. supreme court decision to uphold the affordable care act. health insurance opened enrollment set to begin in just 15 months now. and that supreme court decision was upheld by most of the health care law. starting in 2014 insurance companies will no longer be able to turn people away with a history of medical problems or
6:39 am
charge them more because of those problems. many you wonder what it means for me. what happens now? so there are a lot of speculation this morning and that's why we brought in steve at len thanks tore -- allen thanks for coming. >> good morning. >> people are conlikeed and there's a lot of -- conflicted and there's a lot of emotion. >> it meant the supreme court didn't want to become involved in the political discussion. justice roberts made it clear that he doesn't like the law but feels it the supreme court has a duty to uphold legislation. so they engaged in a legal fixsion. although one might say it's a penalty, if you don't buy the insurance, what they said is it's a tax. it's paid through the irs and handled on a your tax return and it's a tax court decisions say you can encourage conduct by taxes. so essentially they are saying here is you don't have to buy the health insurance. if you don't buy it, we are
6:40 am
going to tax you so you ought to buy it so at least you will have it. but it really a fiction in that regard. >> that's the sticking point some people feel that's unconstitutional to basically tell people they have to buy something. >> well, it would be unconstitutional under thecommerce clause and what they did is decided in that case this is a very narrow decision that you can't force people to do something because eat affects interstate commerce. what they said is with the cigarettes for instance, we heavily tax cigarettes to force people not to smoke. and the supreme court said that's okay. so they are saying we are not forcing you do anything we are not penalizing you from doing things but we are going to charge you a tax. so wouldn't it be better to get something for your dollar. merely than to give it to the government. >> what happens now sh. >> at this point -- now? >> at this point details are to be worked out. because it's not until 2014
6:41 am
that the statute goes in place. the supreme court is done. it will not come back and challenge. what the supreme court has suggested is that congress may want to take another look and depend on the presidential election, this statute could go through tremendous changes. otherwise, there will be aspects of the statute which will be challenged in the lower courts but that will be in the area of implementation. this case is constitutional and the statute and so from that perspective, the affordable care law if the congress doesn't change it, will become the law 2014. >> no doubt people will talk about it. thanks so much for coming in. appreciate your time. >> my pleasure. >> stay with us this morning. he serve as the head of the baltimore county school district for 12 years. what now for dr. joe hairston who enjoying a life of retirement. we will tell you how the district plans to celebrate. >> reporter: fire in southwest
