long. the jury's recommendation after convicting huguely of second degree murder and robbery earlier this year, 26 years in prison. judge hogshire will make the final decision on that recommendation. >> so the lawyers have to give the judge a real good reason to deviate from that. >> reporter: back in may of 2010 just weeks before both of them were set to graduate from the university of virginia, huguely broke through love's bedroom door and assaulted her leaving her to die in her room. charlottesville attorney goodman says in virginia judges almost always take the jury's recommendation. >> they would be surprised if he deviated much at all from the 26 years recommended by the jury. it could take a few minutes several hours but a longer hearing is expected because testimony will be heard from people who knew george huguely including potentially family members and friends. her mother and sister testified during the sentencing phase of the trial. however the judge can use their testimony along with letters

to appear before a judge. a court date has been set for september 7th. gladden is facing attempted murder and assault charges. 17-year-old daniel bowery was shot in the back during the first day of school. and speaking of daniel, his classmates are now rallying around him. they want to do all they can to help him recover and coming up in the next half hour we're going to main how pop star -- explain how pop star lady gaga could be part of the plan. new this morning a sheriff's deputy is out of the hospital after he says someone tried to get into his cruiser. terry weber of tennessee tried to break into a car in downtown cumberland. the deputy saw him and he tried to arrest him. police say that weber tried to grab the deputy's service weapon. he was immediately taken into custody. still no sign this morning of a man who went missing while boating in middle river. the coast guard suspended the search last night for sherman wall den. he and some pals were on the boat tuesday in the creek. wall den jumped into the water

to help who women who appeared to be in trouble. wall den never resurfaced. he has an excellent history as a swimmer and they can't understand what possibly went wrong. democracy 2012 this morning. tonight is a big night for the gop. after months of campaigning and numbers of debates, mitt romney officially becomes the gop candidate for president. and before his big speech tonight there have been a number of big names taking the podium at the rnc in tampa. last night it was vice presidential running mate paul ryan who spoke to the crowd getting the voters all fired up about the election and his potential boss. >> after four years of getting the runaround america needs a turnarounds and the man for the job is governor mitt romney. >> senator john mccain and former secretary of state rice also took to the stage last night. meantime a bit of a crazy scene outside the rnc as protestors they clashed with police. this is new video of demonstrators marching with signs near the forum where the

morton's restaurants are offering $10 glasses of cabernet sauvignon. that storm has been downgraded from a hurricane as it makes its way across louisiana. ashley walters joins us for the very latest and because it seems calm with you but that storm system seems to have stalled over louisiana. >> reporter: yes. what a difference a day makes. it's an entirely different story at least right now: we know that strong wind gusts, possible tornadoes, even more flooding are all possible today. so everybody's on high alert prepared for anything that could come. we know that today, a levee will likely be cut to allow some of the storm surge to actually flow back into the gulf. now here in the french quarter we're seeing a lot of this. this is a street that's flooded. you'll see a lot of debris. that's all going to take some time. particularly the debris is going to have to take some time to actually be cleared out of the way. if you look to your right over

here the windows are still boarded up. businesses most of them are still closed down. we know that about 600,000 people this morning are still without power. that's going to take some time to actually deal with all of that because first it has to be safe enough for workers to go out and with the strong storm gusts and wind gusts it's still not safe. we're waiting for at to die down and again widespread flooding in some areas. we did check in with the ninth ward. the place where you might remember the famous photos and images and video back from hurricane katrina exactly seven years ago. the people say there was no flooding, however, they did experience some -- some traumatic moments at their homes you know a lot of roofs ripping off and trees falling down and even one house that completely fell to its knees. just been kind of standing since hurricane katrina. so a lot going on across the area.

and we'll be watching that all today. live in new orleans, i'm ashleigh walters, back to you. >> a lot of tense moments in louisiana. you guys stay safe down there. for a check of the forecast now, a little closer to home with us and let's see what's going on with lynette. >> all right charlie let's talk because we're still watching tropical storm isaac here and we can see as we go underneath the clouds, still lots of rain to talk about and still lots of flooding around jackson. you can see the heavier rain bands. it is moving very slowly now to the northwest at about 7 miles an hour. the winds now sustained at about 45 miles per hour and we have a new update on this and the pressure is going up. that just shows you the storm the weakening but still dropping lots of rain across the area. also what it's dropping a severe weather threat. so tornadoes are definitely happening with this system as well. now, this will begin to continue to push northwest and then take an easterly job and you can see the models indicating that and it will be heading towards us as we head through the beginning of nec

4:51 and news around the nation this morning. at least 11 people are recovering after a driver backed into a crowd at an elementary school was letting out. police say a 100-year-old driver's car jumped a curb and slammed into parents and children outside a school in los angeles. the driver says his brakes failed. nine of the people were take to the hospital and they were kids. these injuries are considered nonlife-threatening. imagine pulling into a gas station and there's no gas. that's what happened to drivers on a turnpike in kansas and you can't blame isaac for this one. turns out it was a business issue. a motor assistance officer came there to rescue some of the stranded drivers. >> i'm going to put gas this car for him and then in that gar. >> you guys are a lifesaver. thank you. >> they are appreciating it. the drivers they were able to fill up with enough to get them to the place actually had gas. the service station has since worked out a deal but customers had to pay with cash only as

credit card machines went down. and a college grad in new york is now making sure you don't have to dig in for spare cash if you want to leave a tip. it's first the tip jar that now takes plastic. with more people going cashless and using cards, rider kessler created the tip jar. the dip jar is preset with tip amounts at a coffee shop. the barista gets about $10 more per week because of the dip jar. >> it's a help and any little bit helps. >> i prefer using cash. >> the dip jar uses encryption and he hopes to see the invention in more stores soon and we need one of those up here on the set with us because we need give you tips as you just keep the good times rolling. >> mother nature has the timing good too because it's not going to disresult our weekend. with we hike -- we like that with the wet weather. >> a lot going on. >> down to it charlie looking
