from the senate passing the agreement. >> reporter: that's right. this happened in the wee hours of the morning. that vote happened around 2:00 in the morning. but it was a long night but when we saw vice president joe biden make his way to capitol hill, that's when many of the observers knew that the negotiators had really struck a deal and we were moving forward here. of course vice president joe biden as well as senate republican leader mitch mcconnell were key in negotiating this deal. they are being referred to as the closeers here. so this all happened last night. joe biden met with fellow democrats and briefed them on where they were as far as the compromise. legislation was then drawn up and the senate met arounded 2 -- did around the 2:00 hour and cast the votes and that's where we are today. now, we are not out of the woods yet because the house

still need to vote on this measure. and they will not return to capitol hill until noon so we don't know how the story ends just quite as yet charley. >> renee as we understand yesterday presidentth president addressed the nation at 1:30 and this was on new year's eve he was surrounded by a few supporters. he came out for about 15 minutes and made some remarks. this was a direct message was it not to members of congress saying get a deal done. >> reporter: it was. and we saw backlash just moments after the president came out and spoke. there were some senators who felt as if that was not the right time for the president to do that almost bullying them into getting this all done senator john mccain not happy with the president's words as well one senator tweeting out that if the president thinks this is going to help the process he is actually wrong. but in the end, despite push

back, and the strong words used from the president, they were able to get it done but the country did technically go over the fiscal cliff. but they are working to fix everything so that we don't feel the pain of going over the fiscal cliff. so, how will the house vote? that's the big question coming in to today. and the short answer is we are not sure because house leaders put out a statement following the vote in the senate and they gave no promises. they simply said that they will consider is coming to them. they will read it and they will make their decision after that. but no indication whether they will do as the senate did or will they go the other way. >> vice president said you can never guess how the house will vote. renee marsh with us live in dc thanks for the time. in news around nation, a parking lot scuffle gets nasty in the state of georgia.

a woman faces charges after police say she hate teen with her suv hit a teen with her suv. angela cornet got into a arrangement with a 17-year-old girl saving the space for a friend at wal-mart. >> she told her to move and pulled into the parking spot a hit her with the tire of the vehicle. there was scuff mark on the victim's knee which was consistent with the tire during that incident. >> cornet claims she told the teen to move as she pulled into the space. then she says the girl leaned against the suv and began yelling. however police say security video from wal-mart showed cornet striking the girl with the suv and the teen was not seriously hurt. a baby girl is pulled from the cold waters of san diego bay after falling in. it happened within minutes. the girl fell in and her dad jumped in after her. a tourist threw them a life preserver and pulled them out of the water. more people ran over to make sure they he were doing all right. >> they cheered come on now.

better. a number high-profile sequels are set to hit theaters including thor ironman and star trek and hunger games saga. green day is resuming the tour in the new year but not on the original scheduled dates. the band's first concert of 2013 is in march in chicago. they cancel the series of perform ands in january and february and the tour was put on hold after green day announced the front man would seek treatment for substance abuse. armstrong says he is getting better every day and tickets for the shows that were postponed will be honored on new dates. if you felt if -- felt like you paid more at the gas pump that 2012 you are right. that year with some of the highest on record especially in the past four years. now, what can we expect for 2013? >> same -- >> reporter: same sex couples celebrate marriage in maryland. @!ósyih

maryland. a number of couples stood and waited patiently for their turn to say their vows. baltimore mayor hosted some of the first marriages for same sex couples in the state of maryland. she actually performed the very first ceremony herself. the couples brought friends and family to take part in the historic ceremony. new year's day will have a new meaning for many of the couples who can finally have the right to marry the person they love. same sex couples were able to get a license in december and today, at the were able to tie the knot with the new law. new year's day marks the culmination of years of work by gay and lesbian marylanders and the allies to persuade state legislators and voters to support full marriage rights for same sex couples. >> it gives us a little bit of security. more security with the properties and whatever and as far as inheritance wise and like that. and until the supreme court does their bit with the
