military branch came before the senate armed services committee on the issue on tuesday. and senator kristen gillenbrand wants the military to give prosecutors rather than commanders the power to decide whether sex assault cases are investigated. she says the current chain of command system opens victims up to retaliation. she also criticizes how the military lumps all sex assaults and harassment cases together. and military leaders say sexual assault is a serious problem and one that commanders are equipped to handle and sara plumber a fellow marine raped by a fellow marine and describes reporting the crime to her commander. >> it is like saying a brother or sister has assaulted or raped you and your father and mother is the one legally deciding the case. i don't think it is reasonable to even expect that that person can be impartial, which is a foundation of our legal system. >> it is shameful. it is repulsive. we're failing our efforts to fully protect our people from sexual assault and sexual

harassment. >> now the military has been hit hard over sexual assault among its ranks and the defense department reported 26,000 cases of unwanted sexual contact from rape to groping in 2012, a 35% jump from 2010. back to you. a 10-year-old girl is in desperate need of a lung transplant. her name is sara and her parents are asking that she be placed on the adult donor list because the odds are better. and federal guidelines say that you have to be 12 to get an adult lung. ler parents even contacted kathleen sebelius, the secretary of health and human services. sebelius says that she feels terrible for the family, but there are other sick people ahead of her on the list. sara is running out of time. and her parents say she knows it. >> she followed up and asked us, if i go to sleep, will i wake up tomorrow? as a parent, i mean there is

nothing more devastating than to have a child look in your eyes, and ask that type of question. she is very aware that this is a serious situation. >> this morning, she is stable but her parent does not expect her to survive another month. it would be the largest doping scandal in american sports history. dozens of major league baseball players including superstars like alex road rigs and ryan brawn could be suspended for using performance enhancing drugs. and sources tell espn the league obtained documents linking about 30 players of miami's now debunked bio genesis clinic oodged the clinic owner reportedly told investigators he provided peds and injected rodriguez himself. >> i worry about baseball being affected. as a game. the whole thing. >> no comment right now from the league or the players union about the scoping investigation. or any announcement of suspensions. those could come within two

let's get to meteorologist lin ert charles with what could be a repeat of yesterday. >> that's exactly right. 54 degrees in urbanna. yes, it is cool out there this morning. the winds out of the north 3 miles an hour. and here is a picture of urbanna this morning. look at the sunshine that we are seeing. this will continue through the day. we will continue to have high clouds filter in. as we go through the day as well. so be prepared for that. and mostly sunny skies will prevail. 62 degrees in annapolis right now. and in perryman, the temperature at 52. so with these temperatures in the low 50s this morning, grab the jacket, grab the sweater as you head out and about this morning. and maryland's most powerful radar is dry and it will stay that way as we continue through the day and as we plan, as we do every day, look at that temperature, plan for a temperature of 80 degrees. and it is going to be another nice day but then we will start to see change. i will talk more about that change coming up. let's get a check of the traffic with lauren. >> well, lynette, your commute could be a little hectic if you're traveling on the southwest corner of 95. dealing with a crash along the southbound lanes at 695. speeds have dropped down to 29

named amanda. and after seeing the reports of the homecoming to baltimore, she was texted to let her know about the search and she will reunite for the first time here in baltimore since the deadly bombing. they are sticking by their product. chrysler is defying the government by refusing to recall more than 2.5 million jeeps even though safety experts say they're dangerous and shouldn't be on the road. if you drive one, what do you do? abc shari johnson is here and surprising that they are rejecting this recall. >> you know what? chrysler is refusing the recall. saying the government's 3-year- long investigation is based on an incomplete analysis. chrysler says the governments are too severe and the government says older models of jeeps have safety defects with fuel tanks vulnerable to rupturing in a rear end collision. and crash tests show a simulation of fuel spilling from a jeep grand cherokee and

the national transportation administration called on chrysler to fix the jeep cher kiss. and they say it is an unreasonable risk because people have burned to death with the rear impact crashes and the problem is the fuel tank is below the rear axle and below the bumper and chrysler says they are safe and not defective and janelle was in a rear end car crash after a tractor trailer smashed into her jeep cherokee in october. her father pulled out one passenger but two others died in that crash. >> something lass to be done. it can't be done soon enough. >> we believe that chrysler has little time to think about this, and after they have time to think about this and see the public reaction and dot right thing and recall the jeeps. >> chrysler says it does not intends to recall the calls. the government can force a recall but it needs a court order first to do that. now back to you. chrysler is not the only major manufacturer recalling this morning. toyota announced overnight it is recalling 242,000 hybrid

vehicles worldwide. they include certain toyota prius cars built between march and october of 2009. and the lexus hybrids built during that same time period. toy is a says the defective vehicles could have a braking problem and received more than 90 complaint from drivers saying they needed to apply more pressure than previously thought for the brake pedal to stop. and so far, no reports of crashes or injuries. thousands were evacuated from the russian metro in moscow, following a fire that closed a transit lane earlier this morning. and the there are several dozen injured and four people hospitalized and it happened at the peak of the morning rush. the fire broke out in a tunnel. investigators say a power cable caught fire. and today, another candidate enters the race for governor. ron george is expected to make his announcement in annapolis. he has been serving in the maryland house of delegates since 2007 representing ann arundel county. he joins lieutenant governor an thrown brown and harford county executive david craig in their quest for the state's top job.

the army sergeant accused of going on a rampage in an afghan village killing 16 people, is expected to plead guilty today. media reports say that robert bails will talk about what happens the night i went on the attack and give specific details about the massacre. his lawyer says that bails will tell his story to try to avoid the death penalty. he says bails was suffering from post traumatic stress disorder. and was on his fourth deployment. it is 10 minutes before the hour. funeral services happening today for new jersey senator frank lautenberg at a synagogue in new york and buried at allegation -- arlington national cemetery since he served in world war ii. he was best known for helping to raise the drinking age to 21. he was 89 years old. unique appreciation for the ocean and jimmy buffet's words of mother ocean, holding a holiday for her own. >> the world ocean day is set

and columbia at 55. and frederick now as you head out and about this morning, grab the jacket. because it is a little bit on the coolish side. but this afternoon, it is going to be nice and pleasant. get out there and enjoy. it because we will have change coming. i am going to talk about that in just a second and take you outside in towson with the blue skies and the high level clouds. those will continue flew -- through the morning and into the afternoon. i will say we will have more clouds on tap for today than yesterday. but we will still get the sunshine in here and you can see the clouds pushing in from the west and from the south, because we have all types of things happening. high pressure will continue to slide off to the east. in the meantime, we will stay dry but what we're watching from the south is this area of low pressure. right now. the national hurricane center is watching this. to see if this becomes tropical. or subtropical. and it will begin to work its wayed to north and east. by friday, we can be seeing some very heavy rain. and abc 2's most accurate future trend goes into motion picking up on exactly what i'm talking about, as we go into
