the jury is being asked whether concert promoter aeg was negligent in hiring dr. conrad murray. murray is the doctor who injected jackson with a fatal dose of drugs. millions of dollars in damages are at stake. a former montana teacher convicted of raping a student is a free man after serving just 30 days in prison. the case was drawing worldwide condemnation for the length of that sentence. the 14-year-old victim in the case committed suicide. her mother is struggling to understand how her daughter is dead and the convicted rapist is free. >> she was good. she was smart. artistic. >> the judgment is that he needs to serve more time. he'll have to serve more time. >> there's been calls for the judge who handed down the sun tense to be removed. in italy, a top executive at barilla pasta is apologizing for his statements. he said his company ads could never feature same-sex families. that comment caused for a

welcome back. the markets open this morning after breaking a five-session losing streak. traders sent all of the major averages there higher yesterday. thanks to news about jobs and the retailers. that positive news is enough to outweigh concerns about the fiscal issues in washington. you would think that the big complaint to apple is the new iphones are hard to fine.

instead, consumers say the features on the old iphones are making them sick. the phone lines are flooded with users saying the zooms and animations are causing them headaches and nausea. for all the others, it's user e beware. 615,000 toyota vans may shift out of park. vans made from 2004 to 2009, may have the defect. the recall comes after 21 accidents. owners are being contacted about free repairs. big changes coming to mcdonald's. the fast food giant says it will retire its coffee cups, replacing them with paper cups. the new cups are more environmentally friendly. the changeover will take several years. customers will soon be able to choose a salad, fruit or vegetable instead of fries with their value meals. mcdonald's will roll out that option beginning next year. potatoes are a vegetable.

here's abc's david kerley. >> reporter: remarkably, the two pilots, asleep at the same time. that's right. a british airbus a-330, on autopilot with both pilots sleeping. we only know of this because one of the pilots self-reported the incident of six weeks ago. admitting the two pilots had only five hours' sleep over two nights because of long shifts. even though british pilots are allowed to take naps, that country's pilots association says its government is too complacent when it comes to pilot fatigue. here in the united states -- a different story. after this deadly crash in buffalo four years ago. 49 people were killed. pilot fatigue was one of the contributing factors to that crash, which led to sweeping changes for american pilots. they must have a ten-hour minimum rest between flying days. flight time limited to eight to nine hours a day. and they're required to have 30 consecutive hours off every week.

trouble this morning in a case of sextortion. jared abraham is freed on $50,000 bail yesterday, after surrendering to the fbi. he was charged of hacking web cams of teen usa, cassidy wolf. he faces up to two years in prison. watch this guy. wow. he stumbles right on to the subway tracks in boston wednesday night. others on the platform went right to work getting him safely back on the platform. the 33-year-old man admitted to drinking to celebrate passing his medical boards. he doesn't remember anything else. transit authorities say all trains have been stopped. so, he won't be in danger of getting run over. my goodness. >> good for those good samaritans. and six people have been arrested in connection with a huge labor day party of a former nfl player. brian holloway learned of the party after pictures of twitter.

400 teens were there. holloway asked them to come forward and take responsibility. but only four of them did. so, he authorized the arrests. police say many more arrests are expected. usually first responders get the credit when someone's life is saved. but in arizona, even the fire crews are calling a 3-year-old boy a hero. earlier this month, a little boy named guy saw that his mom was suffering a seizure. that's frightening for any child. but only at 3 years, he managed to stay calm and call for help. >> yeah. my mom not feeling better. >> what's more amazing is that guy had never before witnessed a seizure. now, he says he wants to be a doctor someday so he can save even more lives. >> just incredible. >> and his mom says he's always very cool and calm during situations that are stressful. and if you don't understand what he's saying, he tries to explain it in a different way. >> that's awesome.
