shelley: well, jen and tom, that 30-year-old former teacher at the shaker road school in concord has been charged with sexually assaulting a student. donald la vect has been in custody and bail has been set. according to the records, the assaults happened in 2013 and 2014. when the male student was 13 years old in the 8th grade. the alleged incident happened off school grounds. leveque is charged with knownfully sexual assault, endangering the welfare of a child and manufacturing sex abuse images. the master at the school tells me that lavek que resigned. and had no other comment. we'll have more details at

jennifer: governor maggie hassan announced her plans for 2016 today. she is challenging incumbent republican kelly ayotte for her u.s. senate seat. it's a story our political director josh mcelveen broke this morning. after the governor's announcement, josh sat down with her for an exclusively interview. he's here now with more on that. josh: this sets up what will likely be one of the most watched and expensive races in new hampshire as hassan and ayotte enjoy strong support from voters and within their own parties. while she would have been a good bet to win a third term in the governor's office, hassan says she's ready to take her experience to washington. what kind of campaign do you hope to run? >> i think it's going to be a vigorous campaign. josh: that might be an understatement, governor hassan will now engage that what could be a political battle for the ages, taking on kepty ayotte, someone hassan says has gone washington. >> she has stood with special interests rather than the people

it important to note that this survey was taken last week before hassan announced her decision to run for u.s. senate. tom: breaking news now from the new hampshire motor speedway. jared gavins has resigned as executive vice president and manager. he worked there for 23 years. vice president of corporal sales, david mcgrath has been promoted to lead nhms. he joined the speedway as director of advertising and promotions in 2011. jennifer: a man appeared in court this morning following a dramatic crash in the marking lot of the mall at rockingham park. the collision was captured by a surveillance camera. police initially found the driver slumped over in the still running car. andy hershberger has more. reporter: salem police say it was a very dangerous situation. customers were leaving and people were getting out of work when an officer on patrol noticed a man unconscious in his

alexander dimaggio facings three charges after police say he was found passed out in his running vehicle in the parking lot of a sunday. surveillance video shows when his s.u.v. was approached by an officer it drove forward, hitting another car, then ran over a tree before getting stuck on a fire hydrant. >> several observations were made, he was apparently under the influence of a narcotic, specifically heroin. there was heroin in the vehicle. reporter: dimaggio faces two felonies, one of reckless conduct, and another drug related charge. he is also accused of driving under the influence of a controlled drug. dimaggio appeared in court briefly monday morning asking for a lawyer before his arraignment, which will be held on tuesday. salem police say the officer was on routine patrol when he saw the idling cadillac escalade. >> after several minutes the male didn't wake up, observed that, and an officer was

immediately hit the gas pedal, the vehicle lurched forward. reporter: police say the officer was able to get out of the way and was not hurt. court record say dimaggio refused medical attention at the scene. lieutenant dolan says this all happened around 6:00 sunday when the mall was closing. >> there's a lot of pedestrian traffic there, you're going to have shoppers and customers of the mall coming in and out as well as employees leaving to go home for the evening. it's a busy mall, and to have this happen there, he really put a lot of lives in danger. reporter: bail was set at $2500. i'm andy hershberger, wmur news 9. jennifer: merrimack police say a woman unconscious behind the wheel of a stopped car was on drugs. officers discovered shannon glavin in her car on carter road friday, she's now charged with operating under the influence of drugs and did have a suspended drivers license.

responders have been using to save heroin overdose patients is now available to the public in rochester. first pharmacy to have it will be walgreens. frisbee memorial hospital is providing area pharmacies with prescriptions available for anyone of age who express tess need. if you think someone is overdosing the first thing you should do, though, is call 911. jennifer: today hillary clinton was in new hampshire who roll out her plan to crack down on gun violence in america. clinton says the numbers of mass shootings in this country, that the country has endured, that good intentions just aren't enough, that it is time that the country acts. heather hamel is mere now with the details. reporter: hillary clinton is making gun control a key issue in her campaign, she says regulations need to be strengthened, useful background checks are necessary, and gun show and internet loopholes need to close. clinton also wants to repeal the legislation that grants gun manufacturers immunity against

jennifer: concord police say they arrested the would-be thief who made chicken noises at sears employees last month. investigators say nathan la sage hit the store twice, on september 13th he got way with two drill sets worth about $500. and two days later police say la sage was trying to steal more drills, but employees confronted him. he made chicken noises at those employees before running away without the drills. tom: a fired sea police officer has pled guilty to assaulting a man in his custody in 2009. mark richardson was one of the

three officers seen in police surveillance video that went viral. he was the only one charged and was tried on an enhanced simple assault charge back in may. but a jury couldn't reach a verdict. instead of a retrial, richardson has pleaded guilty to using excessive force against the then 19-year-old michael bergeron, who was being booked on suspicion of d.u.i. >> we have entered into a capped plea agreement, which means the state can argue for up to the maximum under the cap, which in this case is 12 months, all but 21 days suspend forward a period of two years. tom: the victim in the case feels richardson should serve more than the 21 days available under the cap, he'll be given the opportunity to speak at the sentencing in november. mike in now with a little bit warmer weather. mike: seasonably cool now, feels the part of mid to late october, but temperatures are heading higher over the next couple days. how long will the warmth stick around.

mike: beat start off with our live web cam network, the sun getting lower and lower. you notice a few high clouds around, same story out at the coast with a few low clouds mixed in as well. a pleasant evening out there at strawbery banke. a few clouds building in from the south and west, but no precipitation as a major storm moves out to see and of course that is hurricane joaquin. what impact does it have in new hampshire in terms of rain, none. but here's josh with more. josh: we are not seeing a direct hit of any kind, it's pretty far out to sea. however, we do have, if you can see here, a small craft advisory in effect through tonight, tomorrow and into wednesday morning, because of those choppy seas that are being created, as

well as the small craft advisory. we have i high surf advisory. the surf, the winds, the waves rather, about four to eight-foot waves, and strong rip current are definitely a possibility. so certainly the sea will look angry over the next couple of days as the storm passes near by. here's how close it's going to be. it's still a distance away. we can show you the track projected and take our measuring tool and show you that at its peak during the overnight hours, still about 550 to 600 miles away during the nighttime hours tonight into tomorrow, and the track, by the way, if you're curious, continues into a tropical low. but actually france could be in the line of this storm, but it will be significantly weakened by then. back home around here, the temperatures have been cooler, but we're warming back up. mike: that's right.

over the next couple days. amazing to see that storm a few hundred miles off shore with no impact except for the surf, which is great news around all of new england. the temperatures on the back side of that system are seasonably cool, but we've got warmer air on the way starting as early as tomorrow afternoon. it chilly tonight, but not as cold as last night. low to mid 30's great north woods, upper 30's and lower 40's elsewhere. but tomorrow and wednesday this little wedge of some spring-like warmth will begin to move on in here, we're not talking about record heat by any stretch. but at least warmer than it has been. again, for two days. once we get to wednesday afternoon, a few sprinkles may develop up north and behind that weak front will be more seasonably cool air, just like we had today, as we go into thursday and friday. speaking of which, friday offers the best shot of a few showers statewide. but none out there for tonight, clear skies will develop, clouds will melt away. plenty of sun tomorrow with a few patchy clouds, temperatures topping off nicely into the 60's to around 70.

once we get into wednesday that's when the next weak front sprinkles up north. outside of that it will be bright and warmer than it will be out there for tomorrow. here's a look at sky cast over manchester, again some patchy cloud for tonight. they'll tend to melt away by early tomorrow morning with a nice looking sunrise, and temperatures beginning to climb from the 40's into the 60's, a few spots may jump near 70. for tomorrow we'll top off in the mid 60's up north, mid to upper 60's lakes region through the merrimack valley. cooler during the afternoon at the coast. and places like nashua and manchester will likely hit right around an even 70. for tonight clear to partly cloudy, patchy fog develops later on, low to mid 30's up north. upper 30's to around 40 in a good part of central new hampshire. and about 40 to 45 south. winds fairly light. nice looking stretch for tuesday and wednesday, temperatures
