if a former conviction against a student will stand. owen labrie was convicted of five students back in august. the defense wants the judge to set aside the conviction for certain uses of computer services prohibited. ray brewer live to explain the arguments. ray: the felony conviction for certain uses on the computer services prohibited meaning he used a computer to lure a 15-year-old girl to a sexual assault. it also means he'll have to register as a sex offender. they said it is too harsh and the law wasn't meant to be used for two teenagers. legal analyst said the state made the point it is too late to object to something the jury was considering. >> under the law the defense is required to

they are given. the statement's argument is very simple which is you didn't object when the jury was instructed on how they would apply the law in this case. it is too late for you to raise it now. ray: the judge has 60 days to issue his decision. it is likely it will be made before labrie's sentence on october 29th. reporting in the studio, ray brewer, wmur news 9. sean: thanks. a man accused of murdering a madbury teen admits he was there, but he says he did not kill aaron wilkinson. >> i know i was committed the robbery. i was not okay with the fact he had been murdered. i didn't know how it would look. it looks bad. i didn't know they would try to say i murdered him because i was there. i was trying to stay away from that situation. i lied to everybody. sean: tristan wolusky took the

he wants to take responsibility for his actions. he says he was with when pinette and tatum stabbed him to death. both of them pleaded guilty to second-degree murder in exchange for testifying against wolusky. police are looking for an inmate that walked away from a halfway house in concord. 50-year-old robert mozeika of chichester never returned after leaving his work site early yesterday. he is 5'9", 200 pounds, black hair and hazel eyes. he was serving time for theft. he was not eligible for parole until next june. state leaders are urging anyone that needs treatment for addiction to use the web site. people say there's a problem with the patient's ability to access treatment even when it is ability. the list of crews says the state should be putting pressure on

insurance companies to cover more treatment services. >> we have a kid here that's been hanging out with us for a couple of by the river. he wants recovery. he doesn't qualify for any. sean: the most important thing someone struggling with addiction can do is get an assessment to determine the level of care they need. nashua police say they've arrested two dozen people over the last six weeks who were involved in the sale and possession of drugs, including heroin, fentanyl, cocaine, meth, and marijuana. it follows several investigations over the last few months. house republicans are set to meet and discuss their nominee for speaker after kevin mccarthy abruptly withdraw from the race moments before a planned vote. stephanie ramos has more on the surprise move and what it means for congressional leadership. stephanie: no one saw this coming. in less than two and a half hours, kevin

kevin: friday morning, october 9th. 40's elsewhere. huge rainfall. a couple of spots of up north could see an inch. sean: thanks. a member of the new hampshire red cross is in south carolina. she joins more than 500 others red cross workers. homeland security director, jay johnson, plans to tour some of the hardest hit areas of south carolina today and get updates. the governor of south carolina is urging many residents along the coast to evacuation because many flooding is expected as storm waters flow down river. officials say 14 dams have failed. they are keeping a close eye on 70 more right now. the city of nashua is teaming up with the red cross to provide and install smoke alarms. teams will spread out

and go door to door in neighborhoods that are considered high risk for fires. seven people die in house fires every day in the u.s. their goal is to reduce the number of injuries by 25% over the next five years. granite staters really stepped up during the tackle hunger campaign. so far they have collected 54,000 pounds of food, enough to provide 45,000 meals. most schools have finished the program, you can still donate at tonight's game between salem and spaulding. a big thank you to everybody. speaking of which the effort got a bigger boost when kas bar realty donated more than $7,000 to help. that money will provide 15,000 meals. a big thank you to them. 5:12 right now. the hometown hero is competing with some of the best in the country.

>> no one covers new hampshire like we do. now wmur "news 9 daybreak." sean: good morning. it is friday, october 9th. it finally had to arrive. the rain is on the way today. kevin will talk about the forecast in just a moment. first the top stories on friday. forprosecutors with responding to a request that a felony charge be thrown out against a concord prep school graduate. and investigation is underway this morning into what sparked a fire that badly damaged a hotel at hampton beach. and a man from arizona has been sentenced after pleading guilty to assaulting his baby during an argument with the child's mother in merrimack. more on the stories in a moment. rain is on the way a little later this morning.

kevin: it doesn't feel like rain this morning. mainly because you have temperatures in the 30's to lower range of the 40's. it is cool for the rain. we get into the 50's to even mid 60's in southern areas today. notice the first wave of rainfall basically moving toward the northern two-thirds of the state. southern areas waiting until afternoon to see the showers make their way in. those will pull away later on this evening. temperatures near the freezing mark up north. could be a little bit of a wintry mix as it starts over the next few hours. 50's north and 60's south today. then cooling off and turning crisp for the first day of the three-day holiday weekend tomorrow. sean: what do you mean wintry mix? rain and heavier rain? kevin: yes. sean: oh, boy. we're getting into that category. kevin: for a look at morning drive here, we're joined live by deb davidson. good friday morning, deb. deb: good friday

defense's request that the conviction be set aside. ray brewer live in the studio to explain why both sides stand. ray: the response spells out why they think the conviction should stand. it is an uphill battle for the defense. >> the chance of the judge actually dismissing or setting aside the verdict in the case is very, very small. ray: owen labrie was convicted of certain uses of a computer services prohibited, a felony level offense that basically say he used the internet to lure a 15-year-old into a sexual assault on the campus of the exclusive st. paul's prep school in concord. >> the defense has filed a motion specifically targeting the one felony conviction because they are doing everything they can to avoid having mr. labrie have to report for the rest of his life as a sex offender. ray: legal analyst said the response filed by the state makes the point it is too late

now to object to something a jury was considering as the trial wrapped up. >> under the law the object to jury selections at the time they are given. the state's argument is simple. you didn't object when the jury was instructed on how to apply the law in the case. so it is too late for tow raise it now. ray: the judge will likely hold a hearing on the issue. the judge does have 60 days to issue an order. it is likely the decision will be made before labrie's october 29th sentencing date. sean: thanks. two men arrested during a drug investigation in keene are set to face a judge today. 19-year-old robert ervin of marlborough and 21-year-old nathaniel wallace were arrested yesterday. ervin is accused of selling heroin. wallace is accused of possessing the drug. wallace is charged with a felony due to a prior conviction for sale of a

controlled drug in 2013. three people were indicted by a federal grand jury for conspiring to distribute heroin and fentanyl. donald feith says jeannette hardy and zakee stuart-holt and jose casellas were planning to distribute 400 grams of heroin and fentanyl. they seized several kilos from the suspect's home and a total of $770 in cash. the department of health and human services says new hampshire is averaging 27 drug-related deaths per month. 91% of those are related to opioids, especially heroin and fentanyl. one person has seen the crisis firsthand is the president of the largest owned funeral home. buddy phaneuf says they have responded to more

than 20 overdoses. >> ten years ago if we had a younger person that passed away from a overdose, it is shocking. fast forward ten years, it is almost desensitized my staff. sean: phaneuf says the average age is 32 years old. the majority have been women. fire officials are trying to determine what sparked a fire that damaged a hotel in hampton. the flames broke out yesterday afternoon at the beach view in on ocean boulevard. officials say the fire started on the third floor and in the back of the building. hotel guests and others stays nearby were evacuated. no one was hurt. officials say the bulk of the fire damage is on the third floor. there's also water damage to the lower levels. an arizona man has pleaded guilty to assaulting a baby in merrimack. 20-year-old chase mariscal dropped his seven-week-old baby while he was arguing

the baby is expected to be okay. he was sentenced to eight days behind bars and must attend parenting classes when he returned home to arizona. the army corps has agreed to settle $85,000 against the epa claims it mishandled in ammonia. they claim the lab had emergency dump system for which it could be discharged into a detention pond that drains into the connecticut river. because of the harm to the river, the corps will be disabling that system. several presidential candidate will be making stops in the granite state today. chris christie is holding a town hall meeting at the pancake house in henniker. lindsey graham is holding a news conference in portsmouth.

dana griffin is in sacramento with the latest on the 23-year-old's condition. dana: airmen spencer remains in the hospital in serious condition. doctors say he is expected to survive his stab wound. surveillance video captured the brawl early thursday morning. new clips show the suspects rushing into a getaway car after the stabbing. police are continuing to search for two men this morning. he grabbed international headlines when he helped thwart a train attack. >> i pray for that guy. they found 100 pounds of marijuana while searching the suitcases of a delta airlines passenger. the suspect, trang pham, of california, was charged with drug trafficking. let's talk sports right now. the bruins hosted the winnipeg jets on the opening night of their season. boston scored their first goal of the year in the first period. the jets scored three goals to take the lead. they scored one more goal in the game. the jets went on to win this 6-2. boston played at the new jersey devils tonight. yesterday. they will play the first two exhibition games this weekend. the red sox are offering a special deal to fans who get a head start on buying tickets for next season. the team announced that tickets purchased before december 31st will be the same price as this

to look good. a little bit more variable in southern areas than it is up north which is more of a steady stream of color. as far as our weekend is concerned, looking very nice. we'll have a few extra high clouds on sunday morning. beyond that, partly to mostly sunny skies for the weekend. temperatures slowly climbing the ladder. by the time we get to monday, temperatures in southern areas of the state up to either side of 70. it will not be like that today. we're looking at clouds and showers making their way in. this is a general east to northeast movement. concord north best chance of picking up on the rainfall. extreme southern areas may be waiting until the afternoon to get in on some of the showers on the tail end. there could be downpours commute. this is a fairly quick-moving system. around. later on tonight, skies should start to clear. that eventually sets up what should be a pretty nice holiday weekend for us. temperatures starting off early this morning in the 40's in southern parts of the state. you'll notice as you

pumpkin festival gets underway today. this is always fun. 35,000 people are expected to attend the three-day event. the weather is supposed to be nice. relax. the festival features plenty of activities, life bands, and the pumpkin catapult which is fun to walk. there will be a zombie walk, which kevin does every morning on the way to the show. i can't read when you are looking at me like that. farther north, attitash is hosting the 18th annual oktoberfest. it is being held with 19 breweries. admission is $12 for adults ages 21 and olding and $7 for ages six-20. five and under get in free of charge. looking like it is beautiful for the weekend. easy enough. we're all good. kevin: just about three dozen events. sean: get back to your zombie
