if a former conviction against a student will stand. owen labrie was convicted of five students back in august. the defense wants the judge to set aside the conviction for certain uses of computer services prohibited. ray brewer live to explain the arguments. ray: the felony conviction for certain uses on the computer services prohibited meaning he used a computer to lure a 15-year-old girl to a sexual assault. it also means he'll have to register as a sex offender. they said it is too harsh and the law wasn't meant to be used for two teenagers. legal analyst said the state made the point it is too late to object to something the jury was considering. >> under the law the defense is required to

now to object to something a jury was considering as the trial wrapped up. >> under the law the object to jury selections at the time they are given. the state's argument is simple. you didn't object when the jury was instructed on how to apply the law in the case. so it is too late for tow raise it now. ray: the judge will likely hold a hearing on the issue. the judge does have 60 days to issue an order. it is likely the decision will be made before labrie's october 29th sentencing date. sean: thanks. two men arrested during a drug investigation in keene are set to face a judge today. 19-year-old robert ervin of marlborough and 21-year-old nathaniel wallace were arrested yesterday. ervin is accused of selling heroin. wallace is accused of possessing the drug. wallace is charged with a felony due to a prior conviction for sale of a

controlled drug in 2013. three people were indicted by a federal grand jury for conspiring to distribute heroin and fentanyl. donald feith says jeannette hardy and zakee stuart-holt and jose casellas were planning to distribute 400 grams of heroin and fentanyl. they seized several kilos from the suspect's home and a total of $770 in cash. the department of health and human services says new hampshire is averaging 27 drug-related deaths per month. 91% of those are related to opioids, especially heroin and fentanyl. one person has seen the crisis firsthand is the president of the largest owned funeral home. buddy phaneuf says they have responded to more

than 20 overdoses. >> ten years ago if we had a younger person that passed away from a overdose, it is shocking. fast forward ten years, it is almost desensitized my staff. sean: phaneuf says the average age is 32 years old. the majority have been women. fire officials are trying to determine what sparked a fire that damaged a hotel in hampton. the flames broke out yesterday afternoon at the beach view in on ocean boulevard. officials say the fire started on the third floor and in the back of the building. hotel guests and others stays nearby were evacuated. no one was hurt. officials say the bulk of the fire damage is on the third floor. there's also water damage to the lower levels. an arizona man has pleaded guilty to assaulting a baby in merrimack. 20-year-old chase mariscal dropped his seven-week-old baby while he was arguing

the baby is expected to be okay. he was sentenced to eight days behind bars and must attend parenting classes when he returned home to arizona. the army corps has agreed to settle $85,000 against the epa claims it mishandled in ammonia. they claim the lab had emergency dump system for which it could be discharged into a detention pond that drains into the connecticut river. because of the harm to the river, the corps will be disabling that system. several presidential candidate will be making stops in the granite state today. chris christie is holding a town hall meeting at the pancake house in henniker. lindsey graham is holding a news conference in portsmouth.
