convicted on five counts back in august. the defense wants the judge to set aside the conviction for certain uses of computer services prohibited. ray brewer is here to explain the arguments on both sides, ray? ray: the felony conviction for certain uses of computer services prohibited means owen labrie used a computer to lure a 15-year-old girl into a sexual assault. it also means he'll have to register as a sex offender. the defense says that's too harsh and it is not innocent apply to two teens that knew each other. they say the law is not limited and it is clear requirement. the state also made the point it is too late to object to something a jury was considering as the trial wrapped up. >> under the law, the defense is required to object to jury instructions at the time they are given. the state's argument is very simple. you didn't object when

the jury was instructed on how to apply the law in this case. so it is too late for tow raise it now. ray: the judge has 60 days to issue the decision. it will be made before the sentence on october 29th. in the studio, ray sean: thanks. the man accused of murdering a madbury teen admits he was there. he says he did not kill aaron wilkinson. >> i know i committed a robbery. what i was not okay with was the fact that he had been murdered. i didn't not know how that would look. it looks bad. i did not know if they would try to say if i murdered him because i was there. i was trying to stay away from that situation. i lied to everybody. sean: tristan wolusky took the stand in his own defense yesterday. he says he wants to take responsibility for his actions. he was there with

zachary pinette stabbed wilkinson to death and sent a text to the victim later to make it seem like he had left. both pinette and tatum pleaded guilty for testifying against wolusky. state leaders are urging anyone that needs treatment to use the web site of nhtreatment.org. they say there's a problem to access the treatment even when it is available. they say the state should be putting pressure on insurance companies to cover more treatment services. >> we have a kid here that's been hanging out with us for a couple of weeks and living in a tent by the river. he wants recovery. he doesn't qualify for any. sean: the new hampshire providers associate says the most important thing someone can do is get an assaysment to determine the level of care they need. nashua police have arrested two dozen people over the last six

a member of the red cross in new hampshire carolina. she will help with the devastating floods there. shannon meaney joins more than 500 other workers. jay johnson plans to tour some of the hardest hit areas in south carolina today and get efforts. the governor of south carolina is also urging many residents along the coast to evacuate because more flooding is expected as storm waters flow down river. officials now say 14 dams have failed. they are keeping a close eye on 70 more. the city of nashua is teaming up with the red cross to provide and install smoke alarms. teams will spread out across the city and go door to door in neighbors that are considered high risk for fires. seven people die in house fires every day in the u.s. their goal is to reduce the number of deaths and injuries by 25% over the

first triathlon when she was 12. she competed for team usa in the triathlon world championships in chicago. she finished seventh in her age group. she's a member of the national honor society and the fifth in her class. she hopes to run and swim in college while studying engineering. the bobsled and luge track in lake placid, new york is open. tryouts for the world cup bobsled team are at the end of the month. you have a chance to ride one of the most difficult tracks in the world. starting next week, you can take a test run professional. kind of neat. it is official. killington report in vermont will host a giant slalom and slalom race. it could include mikaela shiffrin. it is usually in aspen, colorado.

keene are set to face a judge today. 19-year-old robert ervin of marlborough and 21 -year-old nan than yell wallace were arrested. wallace is charged with a felony due to a prior conviction in 2013 for sale of a controlled drug. three people were indicted by a federal grand jury for conspiring to distribute heroin and fentanyl. u.s. attorney donald feith says jeannette hardy and jew key stuart-holt along with jose casellas were charged of distributing. they seized several kilos from the suspects homes. a total of $770 in cash. the department of health and human services says this year new hampshire is averaging 27

91% of those are related to opioids, especially heroin and fentanyl. one person seeing the crisis first hand is buddy phaneuf is the president of the largest funeral home. he says most of the deaths he says are contributed to heroin overdoses. >> ten years ago if we saw a person that passed away because of a drug overdose, it was shocking. fast forward ten years, it is almost desensitized by staff. sean: phaneuf says the average age is 32 and the majority have been women of those who have died. they are trying to determine what sparked a fire that damaged a hotel in hampton. the flames broke out at beach view in. the fire started on the third floor in the back of the building. hotel guests and others

no once hurt. the bulk of the fire damage is on the third floor and attic. there's water damage to the lower levels. an arizona man is pleaded guilty to assaulting a baby. in 20-year-old chase mariscal dropped his seven-week-old baby while he was arguing with the boy's mother. the baby is expected to be okay. mariscal was sentenced to eight days behind bars and must attend parenting classes when he returns home to arizona. they agreed to pay $85,000 in the u.s. army corps at a search and engineering lab in hanover. it did not comply with regulations in handling of the ammonia. they claim the lab had an emergency dump system for which it could be discharged into a detention pond that drains into the connecticut river. because of the harm, the corps will be disabling the system. several presidential

passenger. the suspect was charged with drug trafficking. turning now to sports, the bruins hosted the winnipeg jets on the opening night of their season. didn't go so well. boston scored the first goal. in the second, the jets scored three goals to take the lead. the bruins scored one more goal. boston plays at the new jersey devils tonight. monarchs media they was held last night at the fiat dealership inman chest person they started training camp. they will play the first two exhibition games this weekend. the home owner is friday, october 16th. the red sox are offering a special deal to fans who can get a head start on buys tickets. at the tickets purchased before december 31st will be the same price as this season's tickets. after that, prices will increase by 1.4% on average.

until now, the red sox had only offered this deal to season ticketholders. this month marks the tenth anniversary of the devastating flood that raff averaged the town of alstead. many people don't want to dwell, they want to remember how alstead rised above it. tom griffith has a look at how the history was preserved. >> i was at home. i had one leg of my pants on. i was putting the other one on when the lights went out. i went to the front door. i could hear the roar. >> bruce witnessed not just as a resident but president of the historical society. >> i said we need to document this now. not having people trying to document it oo 50 or 75 years from now. >> that launched a unique part of the clean up and healing. people were asked to pick out any photographs

>> it will come off. >> this is a lot. memory. >> at least 7,000 photographs poured in. >> this is where the culvert was. reporter: the town also saved pictures drawn by children. >> my house got flooded by austin, seven years old. reporter: and a few pieces of crushed metal. flooded over that day. >> it shows again the power of water and -- it is not the water so much as the content of the water. this just wasn't water flowing down the river. it was telephone poles and trees and cars and rock. >> they call it the darkest day in alstead's more than 250-year history. the rebuilding, the rising again, one of the town's greatest and most memorable accomplishments. >> it looks completely different than it did before. that's the end result.

the heaviest of this will go from about concord north with a couple of heavier downpours. then we wait on the other portion of this, which is the scattered shower activity. it could even be a couple of rumbles of thunder by the time we get into the afternoon. temperatures up into the 60's because you are starting in the 40's. this pocket of heavier rainfall. a quick half inch from that alone. that will be around for the next few hours from the upper valley. in southern areas. you are waiting on the rainfall here. nothing more than just a quick shower between now and lunchtime. likely to get temperatures up into the farther north we're looking at temperatures in the 30's to near 40. it doesn't feel like rainfall is moving in. as you saw on storm tracker, rainfall from the west here just in the next couple of hours. you are waiting on the rain showers until at least late morning, but likely early to mid afternoon. temperatures have an opportunity to rise into the mid 60's.

lower 60's to lower to mid 60's in central parts of the state along with the clouds. rainfall heavy at times. mid to late morning and into the afternoon. certainly the north country the potential for a half an inch to a full inch of rainfall as we continue to watch the chance of showers across the area through about 7:00 or 8:00 this evening. you can see a couple of heavier downpours and rumbles of thunder in time for the evening commute. for a lot of folks, this is the getaway day. any lingering clouds giving way to partial sunshine. temperatures tomorrow in the 50's to lower 60's. then those look like as we work our way through time, we'll continue to see the better chance of a few extra high clouds drifting south. weak system will be gliding through. with that, we'll continue to see that chance of an isolated shower mainly in northern areas. the rest of the state will be dry throughout weekend. any high clouds early sunday giving way to sunshine. highs by then in the 60's. it is 60's to lower range of the 70's for highs as we work our way
