vote. >> no one covers new hampshire like we do. now wmur "news 9 daybreak." sean: friday morning right before a holiday weekend. good morning, everybody. thanks for waking up with us. i'm sean mcdonald. we had beautiful weather yesterday. today that will not be the case. don't worry. this is like a temporary thing before we get to saturday. kevin: kind of gets us into the weekend with the clearer skies and stretch of really nice weather. one weak system over the weekend itself. we start off with the clouds continuing to move in. rainfall on the door step especially for the northern half of the state. it looks like the northern two-thirds of the state with rainfall around. southern areas will get the tail end with scattered showers and maybe a brief downpour later this afternoon or in time for the evening commute. 30est up north. 40's in southern areas. highs today in the 50's up north. it will be in the 60's in southern spots. we'll look ahead to what should be a nice holiday weekend in just a bit. let's look at your friday morning ride

convicted on five counts back in august. the defense wants the judge to set aside the conviction for certain uses of computer services prohibited. ray brewer is here to explain the arguments on both sides, ray? ray: the felony conviction for certain uses of computer services prohibited means owen labrie used a computer to lure a 15-year-old girl into a sexual assault. it also means he'll have to register as a sex offender. the defense says that's too harsh and it is not innocent apply to two teens that knew each other. they say the law is not limited and it is clear requirement. the state also made the point it is too late to object to something a jury was considering as the trial wrapped up. >> under the law, the defense is required to object to jury instructions at the time they are given. the state's argument is very simple. you didn't object when

the jury was instructed on how to apply the law in this case. so it is too late for tow raise it now. ray: the judge has 60 days to issue the decision. it will be made before the sentence on october 29th. in the studio, ray sean: thanks. the man accused of murdering a madbury teen admits he was there. he says he did not kill aaron wilkinson. >> i know i committed a robbery. what i was not okay with was the fact that he had been murdered. i didn't not know how that would look. it looks bad. i did not know if they would try to say if i murdered him because i was there. i was trying to stay away from that situation. i lied to everybody. sean: tristan wolusky took the stand in his own defense yesterday. he says he wants to take responsibility for his actions. he was there with

zachary pinette stabbed wilkinson to death and sent a text to the victim later to make it seem like he had left. both pinette and tatum pleaded guilty for testifying against wolusky. state leaders are urging anyone that needs treatment to use the web site of nhtreatment.org. they say there's a problem to access the treatment even when it is available. they say the state should be putting pressure on insurance companies to cover more treatment services. >> we have a kid here that's been hanging out with us for a couple of weeks and living in a tent by the river. he wants recovery. he doesn't qualify for any. sean: the new hampshire providers associate says the most important thing someone can do is get an assaysment to determine the level of care they need. nashua police have arrested two dozen people over the last six

in the sale and possession of drugs. the arrest follow several investigation over the last few months. house republicans are set to meet this morning to discuss their nominee for speaker after the majority leader, kevin mccarthy, abruptly and unexpectedly withdraw before the planned vote. more on the move and congressional leadership. reporter: no saw this coming. kevin mccarthy went from a confident candidate to a withdraw. >> i think i shocked some of you, huh? the one thing i found in talking to everybody if we're going to unite and be strong, we need a few face to help do. that. ray: the decision throws house republicans deeper into chaos. it leaves republicans, especially those who supported mccarthy, at

a member of the red cross in new hampshire carolina. she will help with the devastating floods there. shannon meaney joins more than 500 other workers. jay johnson plans to tour some of the hardest hit areas in south carolina today and get efforts. the governor of south carolina is also urging many residents along the coast to evacuate because more flooding is expected as storm waters flow down river. officials now say 14 dams have failed. they are keeping a close eye on 70 more. the city of nashua is teaming up with the red cross to provide and install smoke alarms. teams will spread out across the city and go door to door in neighbors that are considered high risk for fires. seven people die in house fires every day in the u.s. their goal is to reduce the number of deaths and injuries by 25% over the

granite staters really stepped up during the third annual tackle hunger campaign. the local effort has collected 54,000 pounds of food. most schools have finished the program. you can still donate nonperishable food items spaulding. great effort by the students. the effort got another big boost yesterday when kas bar realty donated more than $7,300 to support the new hampshire food bank tackle hunger program. the money will provide 15,000 meals. a big thank you to them. this week's hometown hero is competing with country. she's been swimming, years. sea world is moving forward with expansion plans. the park is facing some strict rules. this week's adopt is pet is payton. the seven month old

to wmur.com/pets. sean: we are following breaking news out of arizona. one student is dead and four others hurt after the shooting on the campus of northern arizona in flagstaff earlier this morning. a university spokesperson says the suspected shooter is in custody. shots rang out near a dorm that houses students involved in greek organizations. right now it is not clear what may have sparked the violence. this week's hometown hero is a young triathlete that had a to compete against the best in the world. haley markos is a senior at dover. she competed in her

first triathlon when she was 12. she competed for team usa in the triathlon world championships in chicago. she finished seventh in her age group. she's a member of the national honor society and the fifth in her class. she hopes to run and swim in college while studying engineering. the bobsled and luge track in lake placid, new york is open. tryouts for the world cup bobsled team are at the end of the month. you have a chance to ride one of the most difficult tracks in the world. starting next week, you can take a test run professional. kind of neat. it is official. killington report in vermont will host a giant slalom and slalom race. it could include mikaela shiffrin. it is usually in aspen, colorado.

this will be the first resort in the eastern u.s. toest an event since 1991. regulators in california have given sea world permission to expand the killer whale tanks. they ban the park from breeding cap orcas. it will triple the size. it is set to open in 2018. sea world is not allowed to keep any new whales from the wild at the park. officials say they orcas in more than 30 years. the leaves are starting to turn. maybe you noticed. one of the most popular events is this weekend. the sandwich fair starts tomorrow. the always popular parade steps off at 1:00 sunday afternoon. floats, livestock, bands, even puppet people will be there. for more information about sandwich fair, head to the escape outside section of wmur.com. right now the weather is looking gorgeous. turn around and look at foilage at the same

that's the place to do it. kevin: no precipitation expected. you start cool and crisp tomorrow and warm things up. back here 70 in southern areas. we start off with clouds and periods of rainfall on the door step this morning. a lot of this skewed to the northern half of the state this morning. winding down there by mid afternoon while the focus after that will be for southern new hampshire. this afternoon and early this evening. temperatures today in the 50's up north. the rain cooled air out there initially. for southern areas, you wait on the rain chances. kind of the tail end of the front slides through late morning and into the afternoon. temperatures by then will have a chance to get their way up into the 60's. looking at a quick inch of rainfall out of the batch moving through central parts of new york and moves northeast. the end game is to push to the east in time for tonight with gradual clearing after midnight. tomorrow with partial sunshine. you see a good batch of rain here. northern half of the state lakes region northward pretty good chance you get in on the rainfall this morning.

then it starts to dwindle with the back edge moving across the state. at least the northern half of the state into the afternoon. southern areas will see it linger longer. temperatures mid 30's up north. mid 40's in southern areas. not necessarily the proverbial warm start. again with rain-cooled air, you are probably only talking 50's up north into the afternoon. there's warmer air back to the west. a couple of days will get that in there. highs today as cool as 52 in pittsburgh as warm as 58 or 59 in south eastern areas. there's the rain for the back edge of the northern half of the state. southern areas, you'll notice a couple of downpours. we could have a couple of rumbles of thunder. clearing skies and lingering clouds up north. those even there should give way to partial sunshine. mostly sunny mid afternoon stretch. then we cool off tomorrow night into the 30's to lower range of the 40's. from there, looks like

quite a few high and mid level clouds. likely starting as overcast on sunday morning. then giving way to some sunshine as the day moves along. from there, looks like mostly sunny skies on monday with the west to southwest wind bringing in the warmer temperatures. highs in the 60's to lower 70's. highs today climbing into the 60's in southern parts of the state. we're waiting on the rain chances into the afternoon. farther northern where the rain chances come in earlier, likely in the low and mid 50's. we drop into the 40's as the rainfall chances wind down by 7:00 or 8:00 this evening. up north, chances are you are done with the rain chances after 4:00 or 5:00 this afternoon. coolest of the three days over the holiday weekend will be tomorrow. 50's to near 60. it will be with any early clouds giving way to sunshine. early high clouds sunday giving way to sunshine on sunday afternoon. high in the 60's. 60's to lower 70's for columbus day. really not expecting any precipitation over the weekend. just kind of in and out of the clouds from time to time. >> i suspect a lot of

>> no one covers new hampshire like we do. now wmur "news 9 daybreak." sean: welcome back. it is friday, october 9th. a live look outside. another cool night out there. 45 degree. today it is going to be gray and rainy. once you get past today, it is going to be nice. kevin will talk about that in a moment. first the top stories. prosecutors are responding to a request that a felony charge be thrown out against a concord prep school graduate convicted of sexually assaulting a 15-year-old girl. an investigation is underway this morning into what sparked a fire that badly damaged a hotel at hampton beach. and a man from arizona has been sentenced after pleading guilty to assaulting his baby during an argument with the child's mother in merrimack. had a chance to check

campus of -- on a campus in arizona university. a judge will decide if one of the convictions against a former prep school student will stand. owen labrie was convicted of several times in august, including a felony charge of certain uses of computer services prohibited. yesterday prosecutors responded to the defense's request that the conviction be set aside. ray brewer live in the studio to explain why both sides stand. ray: the detailed response spells out why they think it should stand. it is an uphill battle for the defense. >> the chance of the judge actually dismissing or setting aside the verdict in the case is very, very small. ray: owen labrie was convicted of certain uses of a computer services prohibits, a felony level offense that says he used the internet to lure a 15-year-old into a sexual assault on the campus of the exclusive st. paul's prep school

in concord. >> the defense has filed the motion specifically targeting the one felony con vices because they are doing everything they can to avoid having mr. labrie have to report for the rest of his life as a sex offender. : legal analyst, david ruoff says the response files makes the point it is too late now to object to something a jury was considering as the trial wrapped up. >> under the law, the defense is required to object to jury instructions at the time they were given. you didn't object when the jury was instructed on how to apply the law. it is too late for tow raise it now. a hearing. it is likely the decision will be made before labrie's 29th sentencing date. sean: thanks. two men arrested during

keene are set to face a judge today. 19-year-old robert ervin of marlborough and 21 -year-old nan than yell wallace were arrested. wallace is charged with a felony due to a prior conviction in 2013 for sale of a controlled drug. three people were indicted by a federal grand jury for conspiring to distribute heroin and fentanyl. u.s. attorney donald feith says jeannette hardy and jew key stuart-holt along with jose casellas were charged of distributing. they seized several kilos from the suspects homes. a total of $770 in cash. the department of health and human services says this year new hampshire is averaging 27

91% of those are related to opioids, especially heroin and fentanyl. one person seeing the crisis first hand is buddy phaneuf is the president of the largest funeral home. he says most of the deaths he says are contributed to heroin overdoses. >> ten years ago if we saw a person that passed away because of a drug overdose, it was shocking. fast forward ten years, it is almost desensitized by staff. sean: phaneuf says the average age is 32 and the majority have been women of those who have died. they are trying to determine what sparked a fire that damaged a hotel in hampton. the flames broke out at beach view in. the fire started on the third floor in the back of the building. hotel guests and others

no once hurt. the bulk of the fire damage is on the third floor and attic. there's water damage to the lower levels. an arizona man is pleaded guilty to assaulting a baby. in 20-year-old chase mariscal dropped his seven-week-old baby while he was arguing with the boy's mother. the baby is expected to be okay. mariscal was sentenced to eight days behind bars and must attend parenting classes when he returns home to arizona. they agreed to pay $85,000 in the u.s. army corps at a search and engineering lab in hanover. it did not comply with regulations in handling of the ammonia. they claim the lab had an emergency dump system for which it could be discharged into a detention pond that drains into the connecticut river. because of the harm, the corps will be disabling the system. several presidential

sean: sounds good. 6:41. we continue to follow the breaking news out of arizona this morning. an early morning shooting on northern arizona university's flagstaff campus has left one person dead and three others wounded. a university spokesperson says the suspected shooter is in custody. one person is dead and three others wounded after a shooting on the campus of an arizona university. the amtrak vermonters service will run on its normal schedule following a derailment on monday. a car went down a bankment when the train derailed. crews have been working to get the car out of the woods. afternoon, it was not yet back on the track. an airman credited for helping stop a terror attack on a french train is in the hospital after being stabbed in california. dana griffin from our sister station is in sacramento with the latest on the

dana: spencer stone, hospital. she's expected to survive the stab wounds. surveillance video captured the video. the suspects rushed into a getaway car. they are continuing to search for two men. stone grabbed national headlines in august when he helped thwart a terrorists attack on a train in france. >> i pray for that guy. he's a really nice guy. he's a really nice people. everybody know that. this is his hometown. it is just crazy. dana: friends and family are grateful he escaped a violent encounter yet again. sean: a drug task force made a major pot bust at logan airport in boston. massachusetts state troopers and dea agents say they found 100 pounds of marijuana while searching the

passenger. the suspect was charged with drug trafficking. turning now to sports, the bruins hosted the winnipeg jets on the opening night of their season. didn't go so well. boston scored the first goal. in the second, the jets scored three goals to take the lead. the bruins scored one more goal. boston plays at the new jersey devils tonight. monarchs media they was held last night at the fiat dealership inman chest person they started training camp. they will play the first two exhibition games this weekend. the home owner is friday, october 16th. the red sox are offering a special deal to fans who can get a head start on buys tickets. at the tickets purchased before december 31st will be the same price as this season's tickets. after that, prices will increase by 1.4% on average.

until now, the red sox had only offered this deal to season ticketholders. this month marks the tenth anniversary of the devastating flood that raff averaged the town of alstead. many people don't want to dwell, they want to remember how alstead rised above it. tom griffith has a look at how the history was preserved. >> i was at home. i had one leg of my pants on. i was putting the other one on when the lights went out. i went to the front door. i could hear the roar. >> bruce witnessed not just as a resident but president of the historical society. >> i said we need to document this now. not having people trying to document it oo 50 or 75 years from now. >> that launched a unique part of the clean up and healing. people were asked to pick out any photographs

>> it will come off. >> this is a lot. memory. >> at least 7,000 photographs poured in. >> this is where the culvert was. reporter: the town also saved pictures drawn by children. >> my house got flooded by austin, seven years old. reporter: and a few pieces of crushed metal. flooded over that day. >> it shows again the power of water and -- it is not the water so much as the content of the water. this just wasn't water flowing down the river. it was telephone poles and trees and cars and rock. >> they call it the darkest day in alstead's more than 250-year history. the rebuilding, the rising again, one of the town's greatest and most memorable accomplishments. >> it looks completely different than it did before. that's the end result.

of putting us back together. the support from overwhelming. sean: you can find more stories by heading to our web site at wmur.com/special reports. there are a million stories that came out of the flood. today it looks a lot better. right after the flood, damage. kevin: yes. you go through the long stretches where you can have nice weather. there's the rain chance. like last week with the heavy rain. today is one of those rain chances. we have anywhere between a half an inch to a full inch of rain. then for southern areas, it will be more scattered mostly late morning and afternoon through early evening before pulling away. it is just the clouds moving in early this morning. what should be certainly a cooler day out there for us. temperatures in the 50's after starting in the 30's. it will be rain cooled air into the afternoon. note here that the moisture that is making its way in from new york early this morning

the heaviest of this will go from about concord north with a couple of heavier downpours. then we wait on the other portion of this, which is the scattered shower activity. it could even be a couple of rumbles of thunder by the time we get into the afternoon. temperatures up into the 60's because you are starting in the 40's. this pocket of heavier rainfall. a quick half inch from that alone. that will be around for the next few hours from the upper valley. in southern areas. you are waiting on the rainfall here. nothing more than just a quick shower between now and lunchtime. likely to get temperatures up into the farther north we're looking at temperatures in the 30's to near 40. it doesn't feel like rainfall is moving in. as you saw on storm tracker, rainfall from the west here just in the next couple of hours. you are waiting on the rain showers until at least late morning, but likely early to mid afternoon. temperatures have an opportunity to rise into the mid 60's.

lower 60's to lower to mid 60's in central parts of the state along with the clouds. rainfall heavy at times. mid to late morning and into the afternoon. certainly the north country the potential for a half an inch to a full inch of rainfall as we continue to watch the chance of showers across the area through about 7:00 or 8:00 this evening. you can see a couple of heavier downpours and rumbles of thunder in time for the evening commute. for a lot of folks, this is the getaway day. any lingering clouds giving way to partial sunshine. temperatures tomorrow in the 50's to lower 60's. then those look like as we work our way through time, we'll continue to see the better chance of a few extra high clouds drifting south. weak system will be gliding through. with that, we'll continue to see that chance of an isolated shower mainly in northern areas. the rest of the state will be dry throughout weekend. any high clouds early sunday giving way to sunshine. highs by then in the 60's. it is 60's to lower range of the 70's for highs as we work our way
