jean: a new bill coming up in concord could help the state's battle against heroin abuse, good evening, i'm jean mackin. josh: i'm josh mcelveen. this proposal provided about $3 million in grant money to put drug courts in every county. jean: andy hershberger explains how these courts would work. reporter: the bill announced today would put drug courts in every county and the state and provide extra funding for counties that already have this program. the $3 million plan was announced today at manchester city hall. the move is largely in response to the heroin and opioid crisis currently facing the state. the bill's sponsors say state grants would provide half the cost to set up the courts with the other half coming from the counties. these courts provide an 18-month program for hard core drug addicts who submit to random drug testing, constant supervision and counseling. supporters say they work in the time for this type of aggressive move is now.

>> i saw people graduate and go onto return to their families, return to work, to be a positive influence in the society when they were a drag on it in the past. it will work, run right. reporter: officials say if this legislation is passed quickly the new court could be operational as early as april. andy hershberger. josh: friends and family will gather tonight to remember sue hutchinson, whose body was found in her apartment saturday after having been missing for three weeks. shelley walcott has details. reporter: friends of sue hutchinson are already starting to gather here in front of her home on calef road as they prepare for a vigil in her memory. the gathering was organized by hutchinson's coworkers that. hutchinson's body was found in her home sunday night after someone reported a strange odor. police found a body in the

hidden crawl space. hutchinson's roommate, steven andrade, went missing around the same time she did. police say he killed himself in a massachusetts motel room, and an investigation into whether he's connected to hutchinson's death is under way. an autopsy is being held on the body found today. again, taking a look back out there live, friends and family planning to hold a vigil tonight in hutchinson's memory. some have already gathered. again the investigation into her alleged death is under way. live in manchester, shelley walcott, wmur news 9. jean: thanks. administrators met with parents today to discuss a threatening school. a student reported a classmate who had a book called death note with 17 names in it. the book is based on a japanese anime cartoon where characters can write down the names of people who wronged them. in the story, the book has the power to cause harm to the people listed.

were never in any danger. josh: after the death of 21-month-old sadie will cot last month, governor hassan has announced an independent review of the department of children and families, and today a commission heard recommendations on ways to improve services to children who are victims of abuse or neglect. suzanne roantree has more on dcyf's main request that came out of that meeting. reporter: amongst the list of ongoing recommendations made to the commission was a proposal to increase the hours dcyf staffs its hotline, making it available 24 hours a day. currently it's 8:00 a.m. to 4:30 monday through friday with an answering machine letting people know to call police to report abuse if the office is closed. >> we think it would be better to have dcyf available 24 hours a day, seven days a week, at least to receive the reports so that they can gather the information that they feel is appropriate and that they can

reporter: the director lorraine bartlett says the agency continues to battle the need for more resources. >> we need the financial support to do that, we also need the staff resources. if that was something that the department was going to explore with the support of this committee or other committees, obviously we need to look for what the appropriation would be to be able to support staff working after hours. reporter: bartlett says she's optimistic that the dialogue between the commission and dcyf will be beneficial in the long run. >> these particular commissions are going to be helpful in identifying where there might be potential resources and opportunities for us to look at how we can improve the work we do. and make things better for children and families. reporter: the commission will meet again at the end of the month and is expected to submit a report on its findings and recommendations for proposed legislation by november 1. suzanne roantree, wmur news 9. josh: commitment 2016 now. the new hampshire primary once again under attack.

this time coming from a retiring senate majority leader harry reid. in an interview over the weekend with the "washington post" the democrat said he's always been upset with new hampshire and iowa's early places in the presidential selection process but was particularly critical of new hampshire's population makeup. >> you go to new hampshire, there are not any you minorities there, nobody lives there. and i don't mean to deny great new hampshire or iowa, but they shouldn't be the ones choosing who will be president. josh: those comments prompted an immediate response from both new hampshire senators, shaheen and ayotte who said that reid doesn't know what he's talking about. governor hassan is now demanding an apology. so did reid apologize? you can be the jf his sincerity, coming up at 6:00. and the democratic candidates getting ready right to you for their first debate of the 2016 campaign with far fewer candidates than the crowded

every democrat is hoping to make an impression tonight. brandi hitt is in las vegas where final preparations are under way. reporter: for the first time voters will see hillary clinton and bernie sanders finally face off. >> let's transform america. reporter: clinton appeared at a union protest rally outside donald trump's hotel monday ahead of the high stakes national debate that will also include jim webb, martin o'malley and lincoln chaffee. also nearby an extra podium. this photo posted by cnn just in case vice president joe biden, had is still undecided, gets into the race. but his official schedule has him at the white house all day. >> it's highly unusual for a possible important contender not to be in the first national debate. reporter: a new abc news "washington post" poll shows clinton's favorability rating increasing two points to 47%, biden at 45, and sanders 35. it's a much smaller debate field

than the republican counterparts. >> rand paul shouldn't be on this stage. >> yes, you did. you wanted it. reporter: and will likely have a more civil atmosphere. >> it will be very different from the republican debate. reporter: that's because attacks between the democrats have been minimal, more on policy, less personal. president obama though did weigh in on the clinton e-mail controversy on cbs's "60 minutes." >> she could have handled the original decision better and the disclosures more quickly. reporter: that e-mail scandal will likely come up tonight on the debate stage along with gun control and immigration reform. and it is a key moment for the lesser known candidates to try and stand out. vegas. josh: some republicans spent the day in new hampshire. jeb bush chose manchester to roll out his health care plan to replace the affordable care act. he says his plan would give people more control over their health care budget and let plans. >> medicine has changed and it

regular ballots. this has to do with the budget cuts there. the town clerk ordered 2500 ballots saying derry has never had that many votes in a special election. so far 3800 people have shown up to vote, the polls are open until 8:00 tonight. certainly a rough morning for commuters after an accident shut down 93 north at windham this morning. turns out the driver of a box truck fell asleep behind the wheel around 5:00 a.m. his truck hit the guard rail and rolled over, completely blocking the interstate. one other driver then hit the truck. no one was seriously hurt. let's turn to the traffic watch, see if there are any obstacles for the ride home. live pictures from 293 in manchester, not bad in this spot. josh: peggy james joins us with a look at the evening commute. >> hi josh and gene. definitely a better ride on 95 northbound than we had this morning. we still see some slowdowns

way up to derry. but it about 25 minutes to get through the border up to manchester. once you're into the queen city, 293 is moving well the both directions. further north at the hooksett tolls it's a little slow going, but no accidents at this time. and you're bus any the bow junction. concord things are moving well in that stretch as well. everett turnpike has a lot of volume and you get bogged down northbound between exits 10 and 11. 101 west you're slow as you approach milford going through bedford. 101 eastbound is a good ride. and 95 is in decent shape at the hampton tolls, although we do want to mention that the ez pass, the open toll lanes are going to be shut down between 7:00 tonight and 5:00 tomorrow morning for some maintenance work. you'll be directed to use the ez pass and the cash lanes instead of the open toll roads for that work tonight.

from the wzid traffic network, i'm peggy james for 95.7wzid. jean: thanks. monday's holiday traffic set a record for columbus day. the department of transportation says more than 390,000 cars passed through new hampshire's tolls yesterday. holiday traffic for the weekend was up 4% from last year and the most traffic for all holidays so far this year. about 600,000 people were expected to spend the columbus day weekend in the granite state. we love the leaf peepers. josh: crowded roads indeed. so a distracted driver came dangerously close to sideswiping a state trooper. jean: straight ahead, what the driver was doing in the moments before she lost control. josh: and a deadly day in jerusalem, several people have died in what's being pegged as a day of rage. mike: showers for some this evening before it begins to dry out later on tonight. do we see more showers as the week wears on. josh: at 5:30, new concerns

josh: welcome back. parts of jerusalem are on lockdown tonight after a violent day that saw several people killed and dozens more wounded. jean: the violence included to men who boarded a bus and began shooting and tabbing passengers. abc's molly hunter is in jerusalem. reporter: in just 90 minutes tuesday morning, chaos, at least five people killed today and 21 wounded. the palestinians call for a day of -- but the violence concentrated in jerusalem. in this dramatic video near the city center, a car ramming turned to stabbing, the attacker was shot, injured but not killed. then something new. israeli police say two palestinian gunman boarded a bus, opened fire, kill two, injuring more than a dozen. the most casualties we've seen in just one attack. back in washington, the obama administration condemned the violence. >> both sides need to take

actions that, a firm active actions that reduce tensions in the region. reporter: to more stabbings in a north town, and down south the israelis closed the gaza border due to riots. in the west bank a young man was shot during demonstrations in bethlehem. the israel prime minister vowed to use every weapon in his arsenal to stop the violence. others called for a greater crackdown, beefing up security and shutting down neighborhoods. following this morning's chaos, quiet now. these streets heading into the old city are normally bustling and tonight it's mostly security, because no one wants to be on the streets. josh: a new report on the crash of malaysia airlines flight 17 says it was destroyed by a russian made missile. the dutch safety board says the missile exploded less than three feet from the cockpit, breaking off the nose of the aircraft. 289 people were on board the

july, 2014 flight from amsterdam to kuala lumpur. it crashed over ukraine. a criminal investigation has begun to decide who will be held responsible for this deadly crash. jean: yesterday we showed you the post office truck picked up by a water spout in florida. tonight it's fed ex deliveries that will be a little late. this truck fell off an overpass in orlando after the driver hit another car. no one was hurt, but you can see the mess left behind by the crash. fed ex says in these cases it sends special teams to pick up every item, examine them for damage and get them back on track for delivery. in utah, a driver looking at a cell phone nearly sideswiped a trooper making a traffic stop. the driver looked up just in time to see the trooper and swerved. that sent her car tumbling off the side of the road. the trooper and several witnesses ran after her to help. that driver did have serious injuries but is expected to survive. josh: and it was an unusual

start to rush hour in boise, idaho when a small plane made an emergency landing on the interstate. apanel the pilot forgot to use the second fuel tank and couldn't make to it the airport, when his engine cut out it was still dark so the only lights he had to go by were the once on the interstate. mike: hopefully not too many complaints weather wise over this past holiday weekend, temperatures well above average on sunday and yesterday, well into the 70's. right now still a lot of fall color out there for those leaf peepers, that will continue this week. temperatures have remained above average, but starting to cool down a little bit. this is the scene, we're trying to see mount monadnock, but they're covered in cloud cover right now. but you see some nice color there in rindge. elsewhere in new hampshire, peak color in a good part of the white mountains, great north woods, lake sunapee zone, including plymouth.

a lot of beautiful color despite the cloud cover. with more sun it looks even brighter and i think we'll squeeze out a little partial sunshine during the day tomorrow. notice right now the latest system building in from northwest to southeast, and there's a lot of unsettled air in the great lakes, pushing in our direction. and this is the leading edge of some cooler air that takes over for tomorrow, and especially the end of the week with yet another system that will drop temperatures big time over the upcoming weekend. right now a scattering of showers, mostly on the light side trying to move through central and southern new hampshire, few and far between. if you'll be out over the next few hours, have the umbrella handy. most of the showers are in northern and western parts of new hampshire. isolated downpour over central massachusetts may survive the trip in to southern zones in the next couple hours. later tonight these showers will fall apart. it's dry to start off tomorrow, but yet another disturbance may trigger a popup shower for wednesday afternoon.

yesterday, but still above average. 60's to around 70 statewide. when we compare them to what we at this hour yesterday it is from five to 12 degrees cooler. again the cooling trend does continue right through this upcoming weekend. overnight tonight a little above average, normal low in the 30's. we'll be in the 40's to around 50, courtesy of some clouds this evening and a breeze stirring the atmosphere up and not really allowing temperatures to cool off. some are holding on big time in the deep south and the fall chill certainly have it in the northern great lakes, and it's nosing in our direction, we'll really feel it saturday and especially sunday of the upcoming weekend. notice the jet stream flow, a lot of blue on the map and that means all the summer warmth and spring-like conditions will be taking a trip to our south at least through the upcoming weekend. tuesday and wednesday we'll start to warm up once again as we go into a warmer patter with temperatures above average.

tonight it's seasonably chilly. tomorrow we'll see temperatures running a little above the norm. overall it's not too bad in terms of temperatures, at least into the start of the weekend. come sunday and monday that's off. so here we go with a look at future cast, we've got scattered showers this evening, it will tend to dry up later tonight. afternoon. sunshine tomorrow. friday we've got some partial sunshine with a couple of spot showers in the north country. there's a look at the highs tomorrow, mid 50's north, generally low to mid 60's central and southern new hampshire. once we get beyond this time frame, again look for temperatures to be much much cooler. again 48 to 50 for tonight, and once we go beyond that for thursday and friday it's low 60's south and much much cooler for the weekend. josh: up next, is text messaging as addictive as gambling? a new study says it has the same effect on teenagers' brains.

number of teens are compulsive texters, like compulsive gamblers if they text too much they lose sleep, they don't get their work done, and apparently lie to cover it all up. jean: people in new hampshire and across the country are trying to hand el addictions sparked by prescription drug use. dr. johnson has more on a national report on opioid usage and steps you can take to keep addiction out of your family. reporter: addiction is a problem that most of us think we will never have to deal with. but for millions of americans with chronic pain, that little pain pill which seems like a quick fix for the throbbing pain good. a new study in the journal of the american medical association reveals that americans on opioids have a high risk of addiction overdose and death, even when they get their drugs legally from their doctors. and more americans who are legally taking these drugs are addicted to them than ever before. twelve years ago the proportion

are plans to have him released. reporter: yes, and richard penny's brother was surprised, he worries that if released his brother may head straight to his neighborhood. >> i'm concerned about what he could do, you know, he has nothing to lose, you know, he has nowhere to go, and i don't know what he's going to do. and makes me nervous. reporter: robert penny is talking about his brother richard. three years ago robert says that richard held a pistol to his head and stole several of his guns, moments later he allegedly forced his way into a woman's home and held her hadn't for three hours. richard was arrested and charged. but court paperwork says he was found not competent to stand trial and not likely to be restored. the paperwork also says that he was ordered to be civilly commit through the probate court. but all records there are sealed. county attorney can't talk about specific cases due to privacy rights, but says generally a commitment can last up to five

years. in penny's case his brother was told three years. but in a motion to dismiss the charges filed in august, it says mr. penny has been compliant with the orders of the probate division and under the treatment of mental health professionals who now wish to plan for mr. penny's return to the community. >> i fear for my family's safety. i'm not sure how he feels about me. reporter: there will be a hearing thursday regarding the dismissal of charges. if granted the criminal case is officially over. >> i don't have any control over the decision to medically clear someone, and that can be very frustrating when you see someone who committed significant crimes that have affected whole aspects of the community, and then it's very likely that that person will return be within a year back into that community without having any criminal liability whatsoever. >> since he's been locked up, i can go out on my front porch at night and i don't have to worry about looking over my shoulder. i'll be back to looking over my shoulder again.

reporter: i did speak with with with the woman who penny allegedly held hostage. she says if he is released he'll be dealing with the same set of circumstances that he was back in 2013, homeless, no money, no place to go with winter setsing in and she is terrified it could fuel his actions. heather hamel, wmur news 9. jean: lebanon police want your help identifying a man who broke into the k nart and stole julie. police responded to the k-mart this morning for an alarm. officers found the store was broken into and jewelry was taken. you can see the surveillance image, anyone with information is asked to call lebanon police at 448-1212. josh: a massachusetts judge has delayed the double murder trial of former new england patriots player aaron hernandez. both sides in fact had asked the judge to dray his trial that was set to start on december 1. hernandez is accused of killing two men after an encounter at a boston night club. prosecutors also want to get ahold of physical evidence

details of that evidence have not been released. hernandez is already serving a life sentence for the 2013 murder of odin lloyd. jean: good samaritans called florida police after seeing an alleged drunk driver. they weren't anywhere near her, they saw her online. she used an app to live stream her drive and brag about it. >> i'm driving drunk. let's see if i can feet a d.u.i. >> i just saw a girl on periscope driving drunk, she doesn't know where she is and she's driving fast. reporter: police are saying a smart phone app helped them take an allegedly intoxicated driver off the street and put her behind bars. >> how do you know she's drunk? >> she's slurring her speech and she's going from one point to another on the street. drunk.

reporter: police a 23-year-old whitney be aal was using the app periscope to share her saturday night out in lake land, florida with the world, in real time, starting off at a bar and then getting behind the wheel of her car. >> i really don't know where the -- i am and i am so -- drunk. reporter: people who didn't know her saw the video and called police. >> do you have her name or anything? >> no, i don't know her. it's just random people that pop up. reporter: a police officer used his personal account to find her location. pulling her over, reportedly smelling alcohol on her breath, arresting her and charging her with d.u.i. after failing several field sobriety tests, and refusing to take a breathalyzer. >> you her her saying she's drunk. after 30 years in law enforcement, i haven't seen anything like this before. jean: i don't think anyone has. that was ryan smith reporting. beal's attorney is reviewing the

jean: a down day for the dow, losing 49 points. the s&p off by 13. nasdaq down 42. massachusetts' only nuclear plant is closing. josh: owners of the pilgrim nuclear power station the plymouth say the facility is too expensive to keep running. its safety rating was downgraded and it needs millions in upgrades. about 600 people worked there, it's scheduled to close by june of 2019.

for anheuser-busch and miller brewers have agreed on the a deal that will create the world's largest beer maker. sab-miller has issued a $106 billion offer from anheuser-busch. that was the sixth offer. earlier ones were rejected as under valued by sab-miller. the deal still needs regulatory approval. if that goes through the new company is expected to be based in belgium where anheuser-busch currentry has its headquarters. jean: twitter is cutting 300 jobs. the company has struggled in recent months with falling stock prices and failing to gain traction among new users. two weeks ago twitter brought back jack dorsey as permanent c.e.o. in hopes of resolving problems that have slowed the message service's user growth. and pay pal will help cover the costs of returning any unwanted gifts this holiday season. it will reimburse shoppers for up to four returns between now and january 31st. pay pal is accepted in many

josh: fish and game helped rescue two lost hikers in franconia notch last night. jean: officers responded to the call of lost hikers in lincoln. the two hikers from massachusetts got lost in the dark when descending the pace entrail. the two did not have lights, warm clothe or a map. they found the pair around 10:30, the hikers were not hurt. a hunter stranded in the australian desert for six days says he survived by eating ants. josh: after a massive land and air search, rescuers found 62-year-old man nine miles from where he went missing, he was extremely dehydrated and delusional but otherwise doing well. survival experts say it's even more extraordinary that fogerty survived without any water in a

region that has temperatures that rise routinely above 90 degrees. a colorado's decision to legalize recreational marijuana has put a crimp in one toys for tots campaign. jean: the annual fundraiser collects toys for children at christmas time. it's a project that requires a lot of space for collecting, sorting and businesses usually offer their extra warehouse space. problem is, denver doesn't have any empty warehouses this year. they're all full because of the booming marijuana industry. >> those warehouses that were vacant are being bought up and i totally get the business as respect. consumer versus charity, it's getting tougher for us to find space. jean: real estate agents say warehouse leases have tripled in recent years, bought up by marijuana growers. mike: a little cooler than yesterday, but still above

we take you to where place where the peak color is hitting. clouds are winning the battle, but certainly plenty of fall color to be had. not much in the waive find from this shot, because we are fogged in at the coast. portsmouth showing visibility under a half mile, that dense fog could be out there through about midnight before the winds shift around a little bit and begin to break up that low cloudiness and fog, and will eventually get back into dryer air by early tomorrow morning. you'll notice on satellite imagery, big upper level system parked out over the great lakes yesterday, slowly building in our direction right now. that's starting a transition into a more seasonably cooler weather pattern. that does not mean temperatures below average through this week, but come this weekend we will certainly see the coldest so far this season and colder than average temperatures. but the next few days is a gradual cooldown with temperatures back to average by thursday and friday.

between now and then a few scattered showers this evening. most of them on the light side. and few and far between over central and southern new hampshire, most of them falling in the up country. later on tonight it's parly cloudy to clear southern new hampshire with a few extra clouds and possibility a lingering sprinkle in the north country. once we got beyond tomorrow temperatures begin to drop back closer to average. still well above mid 60's up north, we should be on average in the lower to mid fifth in time of year. lower 60's in the lakes region, concord checking in at 68 degrees. the dew point is not all that impressive, typically this time of year it's down into the 20's, 30's or low 40's. it's way up there at 58 degrees, that indicates that tonight will not be all that chilly. so if you're out and about on average in southern new hampshire, low 60's, about eight in the evening, near midnight about 55 and lower 50's during the predawn hours of tomorrow morning. so it gets cool but remains above average. below average temperatures in

the great lakes states, and eventually that builds on in here towards the upcoming weekend. between now and then it's just a gradual cooldown. could be a brief shower tomorrow afternoon, but a good part of the day dry, and thursday more in the way of sun. should be a fairly nice sunup in the queen city right around 6:55. the sunrise getting closer and closer to 7:00 in the morning. then we'll see that sun and cloud combo with with temperatures in the mid 60's in southern new hampshire. for tonight, 48 to 54. so all above average for overnight lows, tomorrow a little cooler than today but still above average. right at the average for thursday and friday with the most sun on thursday. could be a brief shower far north and a couple scattered showers friday that could mix in with a few wet flakes up north later friday night early saturday. notice the highs on sunday only in the 40's and that's in southern new hampshire. it's coming. jean: it is coming, all right.

josh: the rest of california is following san francisco's lead when it comes to chewing tobacco. the governor signed a bill banning smokeless tobacco in california ballparks. that makes it the first state with this kind of ban. san francisco and boston have already adopted city laws making it illegal. jean: talk about a quick welding, one couple tied the knot during the chicago marathon. he wanted a big ceremony with lots of people. she wanted something short and sweet. so they compromised, they stopped at mile marker 8 and got married in three and a half minutes. they had a gatorade toast, and then finished the race. one couple in san diego was delighted to find out they had a wedding crasher. josh: that's because it was president obama. the couple was preparing for their ceremony at torre pines
