like we do. now, wmur news 9 at 5:00. josh: rochester fire is investigating a three-alarm blaze in an apartment home this afternoon. thank you for joining us, i'm josh mcelveen. jean: and i'm jean mackin. it happened around 12 fp 30 on chestnut street. officials say it appears to have started on the outside of the building but worked up boo all three floors and the attic. rochester fire says the entire building suffered smoke and water damage. no one was hurt. the red cross is now helping the tenants displaced. the fire is under investigation. and 20 people have been displaced after another fire early this morning in manchester. the flames ripped through the three-story apartment house trapping some people inside. new tonight firefighters say improper disposal of smoking materials is to blame. andy hershberger is live on clifford street with more.

looks like this fire was den al and may have started on one of the porches in the rear of the building. this video shot by the first arriving officer shows what they were dealing with when they arrived at clifford avenue in manchester. >> the rear of the the approximately, the porch and second and third floor were fully involved. reporter: the fire was reported just before 1:00. christy lives in the building and says she her an explosion. >> it shook the house. >> then went to her door. >> i could see names dripping down like a water fall. and i heard a bunch of peep screaming and they could smell the smoke, so i had to go wake up my husband and son and get them out at soon as possible. reporter: there were 20 people inside the apartment house at the time, 14 adults and six children, firefighters did have to help some people get out. >> this --

although one person was taken to the hospital to be treated for smoke inhalation. as the fire continued a third alarm was sounded. >> every fire truck in the city of manchester was on the scene here including all off due personnel. reporter: the district chief says this was a very labor intensive fire, as they had several major concerns they had to deal with simultaneously. >> it's a very large building, people were trapped, animals trped, so it was very labor intensive. reporter: fortunately firefighter were able to rescue the people and animals and keep the fire from spreading to surrounding buildings. the red cross is helping the people who are displaced. the damage estimate at $100,000. andy hershberger, wmur news 9. josh: a newmarket man is in the hospital with injuries after colliding with a tractor trailer in portsmouth. police say it happened just

ocean road. 84-year-old soucie's car somehow jammed under the bed of the tractor trailer, the road was closed for a few hours. a crash in franklin, two vehicles collided head on on south main street. officials say the driver of a compact car was trapped and took crews about an hour to extricate that driver, who was then air rifted to dartmouth hitchcock. the driver of the s.u.v. only suffered minor injuries. jean: an unmarked cruiser was involved in a crash on 39 this morning, in north feel around 8:00 a.m. while the state police aircraft enforcement. during that time a parked cruiser was struck from behind at exit 19 by a passing car. state police say the first first attempted to take exit 19, then veered back onto 93, striking the cruiser. >> when they're conducting

signage that's set up, warning traffic ahead that the aircraft unit is working. so we just ask that the motoring public be cognizant of that. reporter: both the trooper and driver were taken to the hospital and they are expected to recover. josh: attorneys for owen labrie are appealing his conviction and a day after being sentence he's now home with his family. this comes after a judge jail. the sentence for using a computer to lure the 15-year-old victim was suspended, and as heather hamel reports as the law reads, he is allowed to be released. reporter: yes, in the court yesterday the county attorney read the state law and says since labrie was sentenced to serve time only on the misdemeanor charges, he could be released penning appeal but still has to register as a sex offender. sentenced to one year in jail, la pree is still free on bail adhering to a curfew while the appeal process goes on. >> it's not uncommon that somebody in this circumstance would be on bail pending appeal.

reporter: legal experts say sometimes that can take up to to years. in court the judge told labrie's legal team he encourages them to appeal but made it clear that if successful it would coming vacate his suspended felony tonights and would still have to serve 12 months for the misdemeanor sex sought conviction. but the biggest concern is over his name being placed on the sex offender rent city -- >> the law as it's written applied to his client. there's no question about that. reporter: but attorney sheer believes the 1998 house bill isn't narrow enough and wasn't intended to include cases like la brady's. >> they were thinking about older male, younger teenager or younger vulnerable girl and a male establishing, older male establishing a relationship

report representative agreed and told news 9 while she feels labrie is a predator, she feels bad that he's required to roamer as a sex offender. but sheer says the jury was justified in convicting him. as for it being overturned? >> the judge is a very careful judge, he's got a lot. experience, he's one of the more senior judges on the bench. so that suggests that there's not going to be easily appealable issues. reporter: will bree had to register as a sex offender immediately and his attorney he had done so even before he went home yesterday. heather hamel, wmur news 9. josh: nashua police are looking for the man they say robbed an elderly man near the td bank on main street and west pearl. anyone with information is being asked to call nashua police. jean: big news from the white

operations forces to deploy to syria, aiding forces there in the fight against isis. landa zak has details. reporter: the white house tried to emphasize the limited scope, less than 50 american special operations forces deployed on the ground in syria, in the fight against isis. >> this is an intensification of a strategy the president announced more than a year ago. reporter: the white house spokesman on the defensive saying this is not a reversal of president obama's previous statements that he would not send u.s. troops into syria -- >> our strategy in syria hasn't changed. reporter: according to the administration these troops would not be involved in trying to oust syrian president ashad, they would focus instead on the fight against isis by training local fighters inside syria. >> we are intensitying our counternash campaign and our

diplomatic efforts to end the conflict. reporter: at the same time the troop movement was announced, secretary of state kerry was in vienna with 17 other nations including russia discussing plans for peace in the civil war. russia has urged the u.s. to stay out of the con nick with assad. >> i believe that neither the u.s. nor russia want to go back to the so-called proxy war. reporter: president obama was notably absent from the announcement today, and already several republicans and at least one democrat have begun to criticize the move as insufficient. jean: let's turn to the traffic watch, see how we're wrapping up the work week. 293 near exit 5, the granite street bridge, the view from our elliott at rivers edge camera, a nice view tonight. josh: peggy james joins us now with a live look at the road

>> hi josh and gene. we're heading into the weekend with a pretty good start, 93 northbound coming up from salem is a good ride all the way into manchester and 293 is moving well as well. in the stiff manchester we do have a repert of an accident at pine and amherst streets, so you may want to avoid that area and the delays that will bring. beyond that heading north towards concord it's a good ride through hooksett, plenty of company but no crashes at this time. concord is busy but moving. 101 a good ride east, and west you have your slowdowns as you make your way through bedford. the everett turnpike busy south and northbound busy especially through the exit 10 stretch. from the wzid traffic network, i'm peggy james. josh: thanks. jean: still to come at 5:00 tonight -- josh: fire in a chemistry classroom in virginia sends five to the hospital, two with life threatening injuries.

josh: a rare early morning vote, very early in the morning when the u.s. senate approved a budget deal. now it's headed to president obama. that means the government will stay open and pay its bills for the next two years and will raise the borrowing limit through 2017. cruz and paul fought the passed. the remaining parts of a blimp that broke loose in maryland and came to rest in the pennsylvania country side will be removed this weekend.

clearing in the trees. a fire in a high school chemistry classroom in virginia injured five students and the teacher. the teacher was using chemicals to demonstrate different colors of flames. two of the students are in a burn center with potentially life threatening injuries. the student body was moved to the school's football stadium as a precaution. fire officials say the fire was an accident. josh: flash flooding, heavy downpours and possible tornado, texas getting hit by severe weather today. leaving behind a path of destruction. evacuations are under way as rescue teams rush in to try and help. brandi hitt has the latest. report warning sirens blaring as floodwaters roar through central texas. overtaking roads and entire neighborhoods today. >> this is our fifth flood, three of them have made to it the house in the 20 years we lived here. reporter: this home bricking apart at the edge of a river.

some sort of creek. reporter: trapped inside his flooded car, he called 911 from his cell phone, then abandoned his floating vehicle for a tree. >> i'm up in a tree, about need to. reporter: the car is now under water and he was rescued. it's believed the powerful storm also spawned a tornado, leaving behind this wide path of destruction. self homes and restaurants now leveled. that is a tractor trailer, somehow swept up onto the roof of this holiday inn. >> across the road, the farmhouse in the back, the roof is taken off. reporter: san antonio rescuers also saved school children trapped inside two busses overrun by raging water, one was carrying special needs children. all are now safe, seen here holding onto first responders. evacuations are under way in several towns while rivers continue to rise, some already 13 feet above flood stage.

as emergency crews respond to dozens of high water rescues. jean: around here it hit the 70's in parts of the state yesterday, but the weather is now a little more seasonable. though the mount washington observatory is having a lot. fun dealing with 100-mile an hour plus wind at the summit. look at this video of them deicing the equipment. hopefully no one will experience this while closer to sea level trick or treating. let's head over to hayley lapoint for your trick or treat forecast. hayley: i was in we berlin earlier today and the wind were whipping even at the elevation. an update for the halloween forecast, lots of communities actually going out tonight for their trick or treating. so here's what you can expect for the spooky forecast. tonight, you can see the temperatures falling into the 40's across the state. by 6:00 a few people still in the low 50's like manchester, nashua.

don't forget it's returning to daylight saving time gone, eastern standard times returns later tomorrow night, early sunday morning. so the sunset on sunday, 4:38 in the afternoon. notice right now dry air nosing in. there are some clouds back to the west. good news, as haley pointed out for trick or treating not only tonight but into tomorrow night, it will be on the dry side. again that fall chill has returned after record warmth at the coast yesterday and a run well into the 70's in many spots back into the lower 50's. compared to yesterday, much colder, anywhere from 10 to 20 degrees lower than we were at this time last night. winds beginning to come down, but still on the breezy side out of the west northwest, that's a cool air direction for new hampshire and that means we'll start to see temperatures

next couple hours. fnf games tonight, expect the child. but dry weather, and a breeze early this evening will eventually diminish but half time. shortly after that on your way home the winds will be fairly light, but temperatures will be back into tupper 30's in many locales from lakes region south. colder to north and west. early tomorrow morning it's mid to upper 20's great north woods through the upper valley. right fear freezing along the coast. for the time being, seasonably chilly air. however, not too far away, temperatures warming a little more, to the mid to upper 50's. that will begin to move in for sunday and especially on monday. preceded by a round of showers. most of these will dry up in time, so we're not talking about a washout on sunday, but there is the chance of a shower or two the weekend. skies, plenty of sunshine tomorrow morning. it will be bright sun, and then during the late morning and early afternoon a few high

jean: type 2 diabetes is often known as adult onset diabetes. josh: but a growing number of young people are being dieing a noised with it as well. between 2001 and 2009 the cases of type 2 diabetes jumped over 30% in children ages 10 to 19. american diabetes associates says about 30 million u.s. children and adults have the disease. nearly 95% -- and for a new parent a good night's sleep can be rare. jean: why that sleep disruption is so difficult. here's dr. tim johnson. reporter: sleep like a baby. usually means waking up every few hours. for many new parents it's a surprise how such sleep interruption can make them more than ally crabby at a time they think they should be all smiles.

today scientists say this crabbiness isn't connected to how little sleep they're getting is. researchers at johns hopkins took 62 healthy adult and divided them into three groups, one could sleep as much as they wanted, the two other groups were either kept upt late, then allowed to sleep or briefly awaked up to eight times through the night. next day. but as the experiment continued a surprising twist. the group that was interrupted felt worse and worse in both mood and energy levels. it grew with time even when they were getting the same overall amount of sleep as the others. scientists think the fact that the interrupted group got less slow wave sleep results in those mood and energy changes, perhaps it's a first step to help the 10% of americans who stuff from

on nbc, so why is -- jean: the 2015 wildfire season is setting records, find out how a federal program is helping restore the landscapes charred by hundreds of fires. jean: in manchester alone there have been 65over dose deaths this year. more than 500 overdose calls, and those numbers continue to climb, welcome back, i'm jean mackin. josh: i'm josh mcelveen. those staggering numbers and the fallout from new hampshire's heroin epidemic are what got law enforcement officials, elected officials and members of the medical community together in concord today. wmur's chris tone carosa has more on their discussion. reporter: congressman guinta and congresswoman kuster held a

address the heroin epidemic. in addition to introducing problem. >> if we don't start helping other people we're going to have communities full of addiction. reporter: tammy lost a loved one to addiction in august. she was part of this discussion friday that included police and medical professionals. >> had this happened 15 years ago, could have prevented many deaths. reporter: according to health and human service there's have been 558 drug overdose deaths in new hampshire since 2014. members of congress, annie kuster and frank guinta, are working to create a federal task force on heroin addiction, improve the monitoring of controlled subject stands, improve access to treatment and reauthorize grant programs. >> our goal is to make that happen on a federal level so that the types of programs that can be brought to bear will respond across the board. >> we put together legislation that we think is a good first start at, number one, ensuring the congress know what is the

true problems are. report friday they heard from those work, on the front lines, and a about what's still needed to reverse the epidemic as well as what's working. >> taking a balanced approach is the way to go to address addiction as a whole. report willard says more support programs are needed and they're on the way to manchester. a privately funded 24-hour recovery center will be created inside the former hoyt's furniture store on wilson street. >> so if somebody needs help, they can go to the facility as opposed to going to a police station or an emergency room. reporter: the new recovery center in manchester is stoat open in a few months. hope for new hampshire will be the first tenant to offer services. kristen carosa, wmur news 9. josh: commitment 2016 now. the republican national committee suspended its partnership with nbc news, it will not allow the network to cohost a presidential primary debate in february.

the party chair sent a letter to nbc news after this week's heavily criticized debate. the rnc says the cnbc debate did not focus on economic issues as promised. also that candidates were asked questions that were, quote, offensive. end quote. and republican candidate senator lindsey graham returned to new hampshire today, he greeted voters in concord, manchester and talked with employees at divine law firm. he spoke about foreign policy and defeating radical islam. >> this -- to distort israel, and attack him. the iranian people are different. josh: as far as the news today that president obama plans to send special forces to syria, graham criticized the announcement on twitter saying that there isn't a clear strategy. and democratic presidential candidate bernie sanders is expected to formally file for

week. he was back the the granite state today with stops that included a senior have in manchester, sanders spoke on an important issue to older americans, protecting the future of social security. he says it will take work, but it's possible. >> social security today has $2.8 trillion in the trust fund, which can pay out every benefit owed to every eligible american for the next 19 years. now, 19 years is not enough, we want it to be longer. josh: for a look at the numbers in sanders' social security plan, you can fine them by going to the politics section of wmur.com. also sanders sat down with us for another stop today where he showed a much more personal side, including some impressive knowledge on baseball as well as a sense of humor, more on that at 6:00. jean: the new hampshire republican party will hold a preprimary town hall in new hampshire, this january.

as political reporter john distaso first reported on wmur.com, the event on january 22 and 23 is expected to draw all of the candidates and 1,000 activists, each candidate will be given a half-hour to make a presentation and answer questions with the venue set up as a town hall style meeting at the radisson hotel in nashua. josh: londonderry schools have reached an agreement with the usda over classifications of the school's lunch program. the usda says the high school will not be identified as a food processing plant, it latest be considered a sub distributor. awe drink lunches are made at the high school. the district recently pulled the high school out of the national lunch program after seeing how much food wound up in the trash. jean: wildfires, hurricanes, tornadoes, pick a natural disaster and you'll find a ravaged landscape somewhere in america. the new plan to bring devastated earth back to life.

reporter: it's a time critical job after a disaster, getting native plants 'the dprund before they get choked off by exotic species. the soda fire raged on for 13 days in august, destroying 280,000 acres of range land in idaho and oregon. next week a major restoration effort begins to restore the native grasses and plants that once thrived here. >> seeds essentially are, it's the foundation, right, it's what you start with to get the restorative effects that you desire. reporter: more than a million pounds of seed are going in to protect the land from erosion and invasive plants. it one of a first tests of a new national seed strategy. >> the entities that gr seed will know where we are going. reporter: it's supposed to end the guessing game, having the right seed available at the right time has been a problem for years. >> it's not a widget you create overnight. sometimes it can take two to

three years to get the right seed or enough of the right seed. reporter: after super storm sandy, a chronic short an of the right seed delayed restoration efforts. the seed industry says coordination will be key for the strategy to work. >> the biggest challenge is going to be defining some of those terms. and making sure that we're speaking the same language so we don't get off track somehow. reporter: and she says that won't happen overnight. the new plan sets up a nationwide network of seed growers, farmers and huge warehouses to store the seeds. from washington, sally kidd, wmur news 9. josh: thanks. nearly 900,000fiat chrysler vehicles are now facing recalls. jean: fine out which s.u.v.'s could are antilock brake and airbag issues. >> it's a challenging growing year for most grers in the united states. josh: could the pumpkin shortage cause concerns for your pumpkin pie?

closing bell today so everybody was in costume. the dow ended on a down note. s&p off by 10, nasdaq down by 20. gas prices, nationally at 2.18. in new hampshire we're averaging 2.11. fiat chrysleres recalling nearly 900,000 vehicles to fix problems with the antilock brakes and the airbags. josh: this includes jeep, dodge and fiat s.u.v.'s, the first recalls for the 2012-2015 dodge journeys and fiat fremonts, moisture can build up in the antilock brake control module which can disable the system and the stability control. the other recall is for 2003- 2004 grand cherokees and liberties due to issues with the airbags, they can deploy for no reason. seven people have been hurt in connection to this problem. honda is recalling 300,000 sedans for side airbag issues. the auto maker says the side airbags of 2008 and 2009 honda

accords can deploy if a door is slammed too hard. there have been 19 injury claims filed against honda because of this problem. dealers will update software to try to adjust the threshold for airbag inflation. jean: macy's will open for business on thanksgiving day. the retailer announced the stores will open at 6:00 p.m., again this year. it's the third year macy's has opened on thanksgiving. a number of other big retailers will also be open for the holiday. and target is once again offering free shipping on all online orders this holiday season for the send year in a row. this follows wal-mart's announcement that it will continue to charge a shipping fee on all orders under $50. target is also launching a website to sell products to more than 200 countries and beginning a curb side pickup service at 121 stores next week. it's friday, and that means friday night football.

story just josh: it's the great pumpkin, shortage. may be plenty this halloween, but come thanksgiving might be a different story. jean: nikole killion has more on how it could impact frferg your pumpkin pie to your pumpkin spiced latte. reporter: many folks are being told to stock up now, and the craze for pumpkin items only going up. at this maryland orchard, plenty of pumpkin pickings. but elsewhere it hasn't been a good year for gordz. >> it was a challenging growing year for most growers in the united states. reporter: tyler butler is one of them. >> this is a cinderella pumpkin. report his yield is lower than in years past. caused in part by wet weather. >> it was a wet year and then we had a really dry middle of the growing season, so it was challenging.

affecting your jack-o-lantern pumpkins. for the most part you'll see it in the supermarket when you're buying canned pumpkin. reporter: libby's and nestle say their harvest was cut in half. once it ships the rest, quote, wee have no libby's pumpkin to sell until the harvest of 2016. >> i hope that doesn't add too much, i'm doing the pie. reporter: demand increases for all things pumpkin from pies to breads, donuts, ice cream, cookies, even orioles, generating more than 36 # million the sales last year, according to nielsen. even though some products are not made with real pumpkin, many of them are including starbucks which just added to its popular pumpkin spice aday recipe. the coffee maker says it's not concerned about the impact from the shortage. in washington, i'm nikole killion. mike: so many people have outdoor man's, of course this halloween weekend.

of course it starts off tomorrow with temperatures right at seasonable levels. yesterday we made a run into the 70's. high enough to set a report at the coast, but a big change has moved in, temperatures returning to the norm and it looks the part of light october and early november in littleton, a lot of clouds, they'll dissipate in the next couple hours. farther south and west the sun has set. in dublin where we have clear skies and temperatures are seasonably chilly. on satellite not a lot to speak of, a few clouds drifting in up north, but they'll tend to dissipate in the next couple hours, so it's mainly a clear sky for all of new hampshire by late evening and during the overnight. so fair and chilly tonight. halloween day itself tomorrow, a sunny start and even some filtered sun later in the day as high clouds begin to advance in advance of the next system. while there could be a couple of

sunday morning, once they clear by midday we could squeeze out a bit of partial sunshine. across new hampshire tomorrow, temperatures at seasonably cool levels, anywhere from keene at 52 to as high as mid 50's in manchester, nashua and towards the coastline. concord as well, row chester in the mid 50's. cooler in tupper valley in claremont about 50 to 55 from the southern part of the white mountains points south and just a bit colder in the greatest, upper 40's to lower 50's. so tonight, clear skies, in many spots, up north the clouds will eventually give way to clearing, low 20's far north to 30 in southern new hampshire. the next several days, after a seasonably cool weekend we warm up in a big way. by tuesday and especially wednesday and thursday, when we may make a run at near 70. another check on the forecast
