he says that a neighbor across the street ran over when he saw flames on the outside of the building, and then tried to warn all the residents to get out safely. rochester firefighters rushed to the scene and saw heavy smoke coming from the third floor. luckily the first floor was vacant, and the other residents were able to get out on their own. rochester fire rang three alarms and about 50 firefighters knocked down the fire. but there is significant smoke and water damage throughout the building and tonight five people are displaced. >> everything, tv, everything. i'm out quite a pretty penny. this isn't even my jacket. >> it a very happy ending, because unfortunately the fire occurred and there's nothing we can do about that, but we may sure that everybody is out. reporter: the red cross is assisting and they've set up those five people in local hotels. rochester fire is trying to determine the cause of the fire, but they say at this point they

stephanie woods, wmur news 9. jennifer: thank you. in manchester 20 people have been kiss placed after fire tore through a three-story apartment house there. andy hershberger is live tonight outside the building. reporter: authorities believe that this fire was started by careless disposal of smoking materials, and tonight 20 people are homeless. the fire started here on clifford avenue about 1:00 in the morning. this video was taken by one of the first responding officers. there were six units inside this apartment building, 14 adults and six children live there. firefighter had to help some of the people escape and one person was taken to the hospital for smoke inhalation. one resident said she heard an explosion and ran to her door to see what was happening. >> i could see flames dripping down, like a water fall, and i just heard a bunch of people screaming and they could small the smoke, so i had to go and wake up my husband and son who

as soon as possible. reporter: firefighters were able to keep the flames from spreading to nearby buildings. the damage estimate is about $100,000. andy hershberger, wmur news 9. tom: a second woman has died after a rollover crash on i-93 in windham last weekend. state police say they responded to a crash on i-93 north at about 3:30 sunday morning and found a car on its roof with two women from londonderry inside. 22-year-old kelsey wenfest died of her injuries at the hospital today. 20 used suzanne darcy died on sunday. police say it appears neither of of them were wearing seat belts. jennifer: lawyers for kyle witty are challenging whether surveillance footage of a crash should be entered as evidence. after his dump truck allegedly ran a red light and slammed into a car. surveillance video of the the crash isn't reliable in determining position of the

vehicles or their speed. prosecutors say the video will help back up eyewitness accounts of what happened. that trial scheduled to start in december. tom: even though he's been sentenced to one year in jail for sexual assault on a classmate at st. paul's school, owen labrie was able to walk out of the courtroom free on bail as his attorneys file for an appeal. but as wmur's heather hamel explains, even if the appeal is successful, he still serves time. heather joins us now with more. reporter: yes, the judge made it clear that his suspended felony sentence of they have and a half to seven years would be the only thing vacated. but for the defense it the requirement of registering a a sex offender that concerns them the most. prison time or not, labrie was required to register as a sex offender immediately yesterday. he was found guilty of using a computer to lure the then 15-year-old girl to meet him where he sexually assaulted her. the law dates back to 1998 and one legal expert told us that while the jury was justified in convicting labrie, the way the

enough and inadvertently includes situations like this case which he believes was not the intent of the law. >> they were thinking about older male, younger teen-age or younger vulnerable girl and male establishing, older male establishing a relationship through the internet, through deception. reporter: the representative says that it's very hard to draft legislation like this, she says while she believes labrie is a predator she feels bad that he has to register as a sex offender and doesn't believe that it was the intent of the law to include cases like this. heather hamel, wmur news 9. tom: now to commitment 2016, senator bernie sanders took part in wmur's candidate cafe at the airport diner today. where undecided voters at the new hampshire institute of politics helped to choose sit down with those running for president.

jennifer: chunks of new hampshire's maritime heritage have been washing up on seabrook beach over the last few days. tom: jennifer crompton reports tonight that the debris is believed to be part of a centuries old ship's hull, kicked ashore by recent weather and tide conditions. reporter: the atlantic was a placid blue on friday. no indication of what might lie beneath it. but on shore, some of its secrets are now exposed. sceb trees old pieces of once buried treasure, discovered on seabrook beach. the first spotted in surf on thursday, a mattress sized chunk of a ship's hull. >> there is no iron in it, it's held together totally with wooden pegs. that tell mess that it is -- that tells me that it is probably at least 200 years old or more.

friday morning when the d. p.w. helped hauled above the high tide line. >> i looked further up the coast and there's another piece that's just one rib and two planks up off of ashland street, which is about a quarter mile north of here. reporter: a friend of hers worked to secure it while awaiting help to pull it up higher on the beach as well. >> it could have been a barge that transported cole or granite or timber. it could have actually been a sailing ship. reporter: hundreds of vessels and their crews have been lost off these shores over the years. most never seen again. until circumstances like these. >> combination of king tide with with a northeast storm, it's what the fishermen call a bomb ringer, it disturbs so much of the sand and gravel that things

rae for centuries get picked up with the surf and get pushed ashore. reporter: the hope is they can be identified and cataloged and find a permanent public home in town. in seabrook, jennifer crompton, wmur news 9. jennifer: a decorated vietnam veteran returned from a very special trip to a hero's welcome. ray, his wife and family along with dozens of other veterans embarked on an honor sale to the isles of shoals. he was 17 when he enlisted, his now 65, he's battling cancer and it is believed to be connected to exposure to agent orange. the bucket list trip was arranged by concerned veterans organizations as well as peace greeters who were contacted only about a week ago by one of ray's friends. >> we started looking out for the isles of shoals and i said i'd love to go out there one

tom: look back, you might remember this scene on halloween of 2011 when an october snowstorm hit, and kids went trick or treating in the old snow boots. jennifer: but many communities canceled trick or treating there. fortunately, though, that is not at all going to be the case for tonight or tomorrow either. tom: meteorologist hayley lapoint has your halloween forecast. hayley: it was the snow-tober to remember and thankfully nothing like that tonight. a lot of communities going out and doing the trick or treating, especially at the seacoast, it seems to be a tradition in places like dover, portsmouth and some of the communities right outside of portsmouth, so lots of kids out there will be enjoying the trick or treating. here's what you can expect tonight if you're not already

keep in mind as we flip the times back one hour, the sunset will be 4:38 sunday afternoon. dry weather building in from the west. the winds have been busy all day long out of the northwest, driving in that much cooler feel across the granite state. so that's allowed temperatures to fall off as it's been building in from that direction. if you're heading out in the next hour or two, one of the fnf games, keep in mine it's going to cool quickly. by cookoff in the mid 40's. lower 40's around half time, and upper 30's on your way home. later on tonight, we're back into the mid 20's north, on average upper 20's and lower 30's for the rest of new hampshire. now, it is cool here. well. but it begins to warm up in the northern plains states. bismarck, north dakota 62 degrees for an early evening reading, it's not all that bad.

keep in mind as we advance through early november we typically can get a bit of a surge and a spring-like pattern. notice what happens to the jet stream, a little piece of that tries to move in on sunday, but really doesn't make it. but as we go into monday night especially tuesday afternoon, wednesday and thursday, look at this big bubble of warmth that rolls on in across the ohio valley in towards new hampshire. temperatures well above the average starting monday afternoon and especially tuesday, wednesday and even on thursday. so for tonight, fair skies, chilly, lighter wind later on with temperatures dipping down near 20 up north, on average 28 to 33 south. sunshine, increasing high clouds tomorrow, as we go into tomorrow night it will cool quickly and then by sunday a couple of scattered showers, monday upper 50's to near 60 with a lot of sun, and take a look at that nice stretch of weather for tuesday through thursday. almost looks like early may in terms of the temperature.
