several stadiums. >> no one covers new hampshire like we do. now wmur news 9 at 5:00. jean: he is accused of kidnapping a north conway teenager and holding her captive for more than eight months. today nathaniel kibby appeared in court for a hearing that could determine the course of his trial, and the discussion today was disturbing. good evening, i'm jean mackin. josh: i'm josh mcelveen. kibby's defense team includes four attorneys who filed dozens of motions in the wake of the 250-count indictment against the gorman. jean: amy coveno is in laconia with the defense from those attorneys. reporter: good evening. the defense says emphatically their client is innocent. their first motion today was to try to get the lead prosecutor the this case thrown out the the wake of an alleged jail house threat made by nathaniel kibby to associate attorney general jane young. nathaniel kibby appeared relaxed

and at ease when he walked into belknap superior court tuesday morning, a dress shirt, blue tie, khakis and leg shackles. the court was warned the testimony and evidence in this case will be ex-place and it graphic. kibby is accused of a pattern of sex assaults on a teen under the age of 16. today's motions revealed some of the evidence the state will present to include the victim's eyes being taped shut during part of her captivity and that she was raped nearly every single day of the 282 days she was held against her will. >> during that initial statement she indicated that her captive wore a mask. she described it as a scream style mask, in the subsequent interview on the 27th she repeatedly discussed the defendant wearing a mask. the defendant in his motion would like this court to believe that there was no further conversation of a mask. that is in fact just simply in one word false.

reporter: the motion to recuse was denied. coming up a look at some of of the evidence the jury will see when the trial get national weather service way next year including a scream style mask that nathaniel kibby allegedly wore when he was assaulting this young girl. we are live in laconia, amy coveno, wmur news 9. josh: the body of a student who disappeared from plymouth state university has been found in the pemigewasset river. jake nawn was reported missing last thursday, today the school confirmed that a body found in the river is the young man from holden, massachusetts. a candle light service will be held at 6:00 tonight at the hub fireplace lounge. jean: authorities are hoping for a break in a 30-year-old mystery, by today providing new information about a woman and three children found did in the woods of allenstown. andy hershberger joins us now live. reporter: investigators say they

have new sketches of the victims and that sky ends has been able to determine more about their backgrounds and where they were just before they were killed. in 1985 an adult woman and child allenstown. 15 years later to more children were found in a metal drum not far from the first discovery. today officials announced that the adult and two of the children were related, most likely mother and daughters. they also said they were most likely from the northeast. they say the middle child is not related to any of the victims and is probably from the northern midwest. officials say they were in the new hampshire area for up to three months before their deaths and they were all killed at the same time between 1980 and 1984. >> if we can get to the right person, the person that recognizes the face, the person that says i remember somebody who had a child like that in that time period, i think that can be anything that will break it open. it cot just be one phone call. reporter: officials say they

cooperation after confirming that a bomb destroyed a russian passenger jet over egypt. isis has claimed responsibility for that crash which killed 224 people, the russian government is now offering a $50 million reward for information about the bombers. russian war planes conducted the air strikes in several spot around syria today and that includes the town of raqqa which isis considers to be its capital. jean: in the wake of paris, russia and other attacks linked to isis, pressure is mounting to top the flow of syrian refugees into the u.s. one of the terrorists it's said may have entered the u.s. posing as a refugee. sally kidd is in washington with the plans being considered by u.s. leaders. reporter: well, the house is actually considering legislation that would temporarily halt the president's plan to allow some country. citing national security

concerns, house republican leaders called for a time out. >> we think the prudent, the responsible thing is to take a pause in this particular aspect of this refugee program in order to verify that terrorists are not trying to infiltrate the refugee population. reporter: the senate majority leader taking it a step further. >> we need to pause or a moratorium, because the american people are quite concerned. reporter: including more than two dozen governors who say syrian refugees are not welcome in their states. >> i have to protect the people of the state of alabama and keep them secure. >> this is despicable and cowardly and precisely the kind of reaction isis wanted. reporter: the u.s. has admitted about 2500 syrians since 2011. and wants to allow at rest 10,000 more in over the next year. the obama administration says syrians receive extra scrutiny. >> it's stringent, it's thorough, there's a vetting process that includes our national security team, the

isis is in washington today testifying before congress. diane foley is demanding documented proof that americas current policy of not negotiating with terrorists protects american lives. wmur's adam sexton joins us live from the newsroom with more from her testimony. reporter: well, jean, in addition to mrs. foley's impassioned testimony in support of changing current policy, she also shared details of the family's ordeal during james foley's captivity. she said for a long time she and her family believed federal official was be able to secure the release of her son. but as time dragged on and the family began trying to pull together resources of its own to pay a ransom to isis, she says they were threated by an army colonel to stop or face prosecution. >> did you get a sense that your son was going to be freed at some point? >> not at all. however, our government told me, anyone i talked to at state or

a wintery picture up there at mount washington, dealing with a bit of snow over the past couple weeks. right now snow capped across all of the presidential range from the view in conway. you notice the trees are bare, and that means we're working further into the month of november. so you might expect it to get quite cold by night, and indeed last night was chilly. teens north. 20's for many, a few upper teens in tupper valley. tonight will actually be a little colder than we were last night. so get ready for some of of the coldest air so far this season. right now temperatures are already sub freezing in the great north woods, below 32 in berlin and whitefield. right at that magic 32-degree mark in lebanon and jaffrey. of course the sundown a while back and that's allowing temperatures with light winds to tumble quite a bit already, mid to upper 30's lakes region through concord and low 40's in manchester. with the temperature and the dew point well apart from each other

so right now in concord at 37 we're going to look for readings by morning about 16 or 17 degrees. again that marks the coldest we have seen since last march. low to mid teen as cross the great north woods. upper teens and lower 20's for many. the warmest will be, quote, warmest, right along the coastline, in portsmouth, hampton, 27, 28 should do it by early in the morning. is there a wedge of warmer air trying to build in from the west. tomorrow afternoon into thursday, even early friday we'll be under this air mass in terms of temperature. we will not get into the 60's, but 50's cannot be ruled out, especially as we go into the day way. once that clears, we're back weekend. saturday back to the low to mid 40's and cooler with a few mixed or snow showers early on sunday. so again here is that storm, stretched out from the mississippi valley points south with a lot of heavy rain. tornadic thunderstorms a possibility arkansas, western

reckless conduct and running an unlicensed day care. josh: jennifer crompton was in the courtroom for opening statements today. reporter: this is the brown hooded jacket that 4-year-old willa clark was wearing when prosecutors say she was found hanging from a stick lean-to structure in the back yard of mary ellen bird's unlicensed home day care in enfield. >> when the defendant finally noticed her, willa was limp as a wet noodle, that's the defendant's towards. reporter: willa died days later. it was march 24, 2014. the state claims that burit was not only unlicensed but reckless, putting children in danger when she allows four of them under the age of 5 to play on the stick fort without an adult present. they say she was inside feeding a baby and making lunch, checking on them from a window. 85 feet away. >> and because of her limited vantage point, she was not properly monitoring willa and couldn't see her properly.

thus she didn't respond to see willa's coat off with any urgency. reporter: but the defense argues that she could see or hear them at all times, so she was supervising them. >> she's sitting here with the window up, so she can continue to have discourse with the children, they're talking to each other, through the window, and she can see them. reporter: he says willa was likely unconscious within 10 seconds of the pressure on her throat, with her hood up and her face turned towards the woods. >> whether mary ellen was outside 5 feet away from her or inside looking through a window, there were no signs of distress. and this is a, my word, one in a million horrible, horrible accident. reporter: the trial is expected to take three days. in north haverhill, jennifer crompton, wmur news 9. jean: the mother of a massachusetts teacher took the stand in the murder trial of her daughter's admitted killer.

14-year-old philip ch had ism killed and raped 24-year-old colleen ritzer in a high school bathroom. her mother explained her daughter's daily routine, she says the family became concerned when colleen did not come home and couldn't be reaped by phone -- reached by phone. >> she still wasn't home, and at that point we started to get worried. laura became very upset, because she could see that colleen had not been on facebook all day, because you can tell when people have been on facebook and colleen was regularly on facebook. reporter: after the lunch break in court, chism refused to leave his holding cell, the judge had to call for a recess for a medical evaluation. josh: a cell phone video showing black lives matter protesters marching into the dartmouth college library and disrupting students has gone viral. while some say insults were hurled, the college says they had had no complaints of physical violence.

say it began as a peaceful demonstration. reporter: in a statement dartmouth says this began as a large peaceful meeting in response to a black lives matter art installation being vandalized on campus. but afterwards a smaller group launched a political protest. protesters dressed in black, some holding signs, entered the baker barry library in dartmouth college. cell phone video captured the images and sounds, and ins it was posted three days ago, more than 566,000 people have watched it on youtube. it was thursday evening, many students in the library studying for finals were caught off guard, as the group circled the room and chanted. they ran support of the national black lives matter movement that promotes freedom and justice and racism. there are reports that protesters berated white students, some swearing and some shoving, however the video doesn't show that, and both the college and police say they

aren't aware of any violence. >> the only, it's people who observed the video and made comments, but there's been no individual that has come forward against them. reporter: the police chief says one of his officers saw a large group thursday evening, it lasted about an hour and a half and appeared peaceful. the chief says he watched the video too and didn't see anything criminal. >> you have to have a victim, and there has to be a crime. so i know certainly when things like this happen people get passionate and we're trying to be respectful of rights and everything like that. reporter: dartmouth college released a statement saying the college is investigating and will continue to follow up on any complaints related to the protest. if a violation of college policy is identified, we will follow our policy and hold those individuals and or groups accountable. although the video went viral, we spoke to dozens of students who hadn't seen it yet. those who had or at least heard about the protest said they support the cause, but are upset
