with more. reporter: the gun used to kill gregg smart will remain in state's evidence, and prosecutors say there's a very good reason they need to keep it. it is perhaps the most infamous% handgun in new hampshire history. and a judge ruled that it will be staying in a state evidence room for at least the foreseeable future. this after the father of advance latimy jr. asked for the return of his firearm, according to paperwork filed at rocking hall county superior court. it's the .38-caliber revolver that prosecutors say william flynn used to kill gregg smart back in 1990. >> his weapon was taken by his son, essentially stolen and then used to kill a man. so because of that, the weapon went from something that was just a gun in someone's home to a piece of evidence in a murder case, a murder weapon. so that's why we've asked the court to allow us to retain it. reporter: advance was one of fourteens at the time convicted convicted in connection to the homicide.

orchestrating the crime and is serving life without parole. a lawyer for advance latimer says the gun is lawfully his and after 25 years it's time he get it back. but prosecutors say pamela smart continues to file appeals in this case and they have no idea what type of claims she will file in the future. assistant attorney general says he's pleased the court chose to hold onto the weapon. >> in this case you have a defendant who is doing a life without parole sentence and she's contested her sentence and her conviction in the past and she's indicated recently that she plans to connest it in the future. because of that we're trying to be careful in order to preserve the conviction against her and maintain justice for the jim by keeping a handle on the important evidence, and certainly the murder weapon is evidence. reporter: a spokesperson for pam smart released a statement, saying this gun is a painful reminder of the murder of her young husband greg who was beaten and then shot to death

coconspirators, all of whom are now enjoying freedom. josh: more troubling numbers in substance abuse. as of monday there have been 342 drug deaths according to the state medical examiner, another 73 cases are spending. pending. officials expect overdose deaths to top 400 by year's end. jennifer: the mother of an overdose victim in rochester may soon be out on bail. prosecutors say that jasmine rud% knew her daughter was being provided drugs. reporter: the 41-year-old has been in jail about a month. today the judge noted $10,000 cash bail for someone who is indigent, is as out of reach as a million dollars bail.

the judge that eve tarmey's mother is charged with reckless conduct and child endangerment, but not with giving the deadly dose of fentanyl to her 17-year-old daughter who was found dead in a motel room in october. danger to self and danger to the community is weighed during bail hearings, and the county attorney entered strong concerns about both, citing rud's known heroin use and allegations of prostitution to support it. >> it is known she has a problem. people mo use heroin are a danger to the community, they operate motor vehicles and they make bad decisions when they're on heroin. reporter: for now jasmine ruud is at the jail, but once the conditions are met she can trade the cell for a g.p.s. bracelet. josh: the governor ordered all

in honor of u.s. army ranger andrew amesbury. his family and friends will gather friday afternoon at dover baptist church where the funeral will also be held the next day. the 21-year-old was seriously wounded a week ago during a live fire exercise in georgia. he later died from those injuries. and way up and now way down, the unusually warm december pattern took off today with temperatures 10 to 20 degrees lower than yesterday, but another warmup isn't all that far off. keeping track of all this is hayley lapoint. hayley: it's amazing because today's temperatures while they were much cooler than yesterday, still are a good 10 degrees above the average high. doesn't look like it's really going to end, even as we push forward toward the end of the month. here's where we stand now. it's definitely chilly tonight, we've fallen to 36 in concord, 37 manchester, 38 nashua, 20's in whitefield, berlin. we've got clouds on the increase

as that pushes through during the overnight hours, there will be some freezing rain that falls, in the northern part of the state. in coos, northern grafton, carroll counties, you'll have freezing rain, it's basically for secondary roads, the bridges, ramps that may be slick. for the rest of us in central and southern new hampshire it's a drizzly day tomorrow. i'll have more coming up. josh: just days after a raging fire destroyed a home in hampstead the community and the power of social media are helping the family that lost everything. jennifer: just over a year ago john ward and his family dealt with the loss of his wife and mother of his three children. wmur's suzanne roantree was in hampstead today to see firsthand how the wards are being helped now. reporter: she and her husband are only casual friends with john ward and his family, but

done to help as soon as possible. they heard about the fire that destroyed their home. when they set up the gofundme account on monday morning the mcdonald's had no idea of the response it would get. rsh everybody at that point was wanting to help out. he goes why don't you set that up so people have somewhere to give. reporter: she says she didn't know what to expect when the link was posted on facebook and twitter. >> the next thing i knew the computer was dinging and dinging and dinging, and i said oh boy. reporter: then to her surprise, her kids told her that the patriots jewel an edelman on tuesday retweeted the wards' gofundme page. nearly 500 of his half million followers retweeted tight and it was sent to the ellen degeneres show, all in response to this fire that happened state night in hampstead and left the ward family homeless. a neighbor of the wards says he saw john on wednesday.

ever. if december ended today, the average temperature would be 39.6 degrees, that would break any record epically. but we still have a long way to go for the rest of the month and mother nature can balance things out, it tends to happen. look at this, the number one warmest december had an average temperature of 35.4 degrees, remember that includes the low temperatures overnight. and that was set in 1891. so most of these records go all the way back to the 1800's. so it's been a long while since we've had warm air like this and we'll see if it continues throughout the rest of the month. 36 in concord, 37 in manchester, 38 in nashua. the seacoast in portsmouth 36. already in the 20's up north. so it's a cold night up there. and that's key. because we have a storm system that's on the way, you can already start to see clouds increasing, but when the storm system rolls on through, it's going to fall, the rain will

so there is the potential for freezing rain during the overnight hours tonight. and also during the morning hours tomorrow. if you live in coos county, northern grafton county, northern carroll county, you have a freezing rain advisory. this has been posted, it goes from # a.m. tomorrow morning until 1:00 tomorrow afternoon, so be very careful if you live in those areas, especially once you get to mid morning tomorrow, still will be cold enough that the rain can freeze on contact. here's how things go on future cast, you can see the clouds increasing and by tomorrow morning most of us waking up to that nasty drizzle and mist. it's going to be similar to monday if you remember, up north though, freezing rain until noon or 1:00 in the afternoon. rain steadily gets heavier, especially during the evening commute tomorrow night, it will be one of those commutes again, big puddles, low visibility, fog, not very nice. but the good thing is this system pulls out and friday will be brighter, and then some

doherty gets it past the goalie. he had a hat trick in the game. salem will get another one. but pinkerton erupted with five goals in the third period and they win 7-2. more highlights at 11:00. the patriots have a deficit at the runningback position. today they signed former denver bronco monte ball to the practice squad. they were reportedly in talks with steven jackson who has played for the rams and falcons, he has not been in the league this season. a treat for us tonight, the londonderry marching band plays celebration by cool and the gang, the lancers have a history of playing it big. college football goal parades like the rose bowl, four times. on december 30 they'll be marching in the citrus bowl parade before florida plays michigan, all 245 members of the band are going.
