unconstitutional. wmur's jean mackin spoke to one of the people who challenged the law, and joins us live. jean: 40 days from now when you vote, it will be legal to snap a photo of your ballot and post it on social media. though some who argued it's freedom of speech have been doing just that all along. even when you pull the curtain to vote privately you now have the right to make your vote public. federal appeals court upholding a lower court ruling that declared new hampshire's ban on ballot selfies unconstitutional. in 2014 in an effort to curb potential voter fraud, the state outlawed displaying photos of marked ballots a violation that carried a fine up to $1,000. that didn't stop people from posting so-called ballot selfies like state representative leon rideout did.

facebook page for state rep. to me, it was just another incremental infringement on our constitutional rights. jean: the aclu challenged the law on behalf of rideout and 2 other voters. legal anaylst kirsten wilson says the court saw the ban as a first amendment violation. >> it's really freedom of speech, and political speech, in history of the united states. jean: representative rideout says he's undecided on posting his next ballot, but glad he has the choice. >> the ban on ballot selfies was unconstitutional and i think that made today a great day for free speech and our constitution. jean: we are still waiting for reaction from the state. while this ruling applies to the entire jurisdiction of the first circuit court of appeals, meaning ballot selfies are also allowed in maine, massachusetts,

wmur news9. tom: to commitment 2016 now. and democratic presidential nominee hillary clinton is making a direct appeal to younger voters with the help of the man many of them voted for in the primary. vermont senator bernie sanders joined her in durham today to talk about her plan to make college more affordable. wmur's cherise leclerc was there. cherise: supporters stood outside for several hours just to make sure they got a seat inside the field house with six about 1200 people. there were protesters out your making sure their voices were heard. speaking to a group made up largely of college students, hillary clinton detailed her plan on college affordability. it includes free tuition at any state school for families who make under $125,000 a year. ms. clinton: we've got so many young people graduating with debt who aren't able to get

here. they deployed about 40 extra officers to make sure the crowd control went smoothly. they did not report any major problems. shelley: meanwhile, donald trump made stops in illinois, iowa and wisconsin. in illinois he held a private fundraiser at bolingbrook, golf club. at a rally at council bluffs in iowa he asked how many christian conservatives are backing him and joked whether they should be kept in the room. tomorrow early voters in iowa can begin casting their ballots. and he reminded voters of last week's big endorsement. mr. trump: even senator ted cruz endorsed me the other day, and i know the people of iowa like ted cruz. he endorsed as the other day and i thought that was very good. shelley: tomorrow trump head's to the granite state. he is holding a rally in bedford at the new hampshire sportsplex. doors open at noon.

>> children are inquisitive. they are going to do things when the parents are not looking that could potentially put themselves and others in danger. she put both her children in great danger. tom: police say dcyf has been contacted and are involved in this investigation. shelley: tonight, there is a new twist to a mystery at sea. a son rescued after 8-days in a life raft. but tonight, authorities have questions about that deadly boat ride off the coast of martha's vineyard. and police say that son, was also once questioned about the death of another family member. >> nathan carman spoke to abc news about his 8 days lost at sea. >> i didn't know we were sinking till we sank. >> carman spoke to reporters from his home in vernon, vermont.

scooped up by a passing ship. the coast guard questioned the 22-year-old about how his boat took on water and sank, during a fishing trip with his mother off the coast of rhode island. nathan has asperger's syndrome, a high-functioning form of autism. he told investigators he lost sight of his mother as he scrambled into a life boat. >> i did see the life raft. i did not see or hear my mom. i was calling out to my mom. shelley: his mother, 54-year-old linda carman of middletown, connecticut, is presumed dead. and just hours before nathan carman returned to shore, police in vermont were seizing items from his home. a search warrant revealed he is under investigation for reckless endangerment, resulting in a death. the warrant saying that the boat was in need of mechanical repair and that nathan could have rendered his boat unsafe for operation. nathan says he thought the boat was safe. >> i would not have brought my mom out fishing with me had i not believed the boat was seaworthy.

in the 2013 murder of his grandfather, john chakalos. a millionaire real estate developer, who had a home in chesterfield, new hampshire. nathan was the last person to see him alive. nathan's mother inherited millions after nathan's grandfather's death. nathan's own father defended him to reporters when asked if his son could have killed his grandfather and mother. >> most definitely not. they were the most important people in his life. shelley: nathan says he is devastated about the loss of his mother, and says she would have wanted him to survive. tom: today marks 35 years since the first of two murders in portsmouth that remain unsolved to this day. the body of 23-year-old laura kempton was found in 1981. a year later, the body of 19-year-old tammy little was found. both were students at portsmouth beauty school and showed signs of blunt force trauma. today, we spoke to the original

the shooting may be tied to a murder just miles away from the school. elizabeth: police swarming a south carolina elementary school, on the ground and on the roof. responding to reports of a gunman opening fire at the school's playground. authorities wasting no time, evacuating the building and asking parents pick up their asking parents pick up their children at a church nearby. want to get. >> it is scary. you don't think anything like this would happen around here. elizabeth: officials revealing the outcome could have been much worse, if not for the quick action of the first responders rushing to the scene, when the calls for help came in at 1:45 in the afternoon. >> deputies were on scene within 7 minutes, and we did have the shooter in custody before 2:00. >> we are heartbroken about this

response of law enforcement and school employees who prevented more injuries. elizabeth: now, the search for answers, with investigators so far confirming the 14-year-old alleged shooter in this case is a suspect in the shooting death of his father, 47-year-old jeffrey osborne, just 2 miles from the school. >> we believe they are connected to the incident at townville. there is a relationship between the victim and the shooter. this appears to be elizabeth: the school will be closed for the rest of this week as the investigation continues into a motive and why that school was targeted since officials say the suspect was home-schooled. tom: new details tonight in the shooting death of a black man at a strip mall in el cajon, california. police say the victim identified as alfred olango, was acting erratically and was shot just a minute after officials arrived.

and at one point pulled an object out of his pocket, pointed it at officers and assumed a shooting stance. now protestors are calling for justice. >> we want more than justice. we want morals and humanity brought back into this society. i'm tired of walking around like i'm a target. my son's a target, my family members are targets, just because of the color of my skin. tom: the police chief says one of the officers tried and failed before the other officer fired several times. shelley: tonight, the fbi says the man who stabbed 10 people inside a minnesota mall was motivated partially by radical islamic groups. director james comey told congress that he's not ready to confirm the attack was an act of terrorism, but the bureau is still working on it. dahir adan went on a rampage september 17, stabbing 10 people before he was shot dead by an off-duty police officer.

accused of taking evidence in the new york and new jersey bombings. surveillance video shows the pair walking away with a suitcase allegedly left behind by bombing suspect ahmad rahami. a law enforcement official told the a.p. that the two men are egyptian tourists that have returned home. investigators have notified eqyptian authorities saying that they want to question the men. shelley: officials say more than 600 soldiers will head to iraq to help reclaim mosul from isis. thoo iraqis when the operation begins in the next few months. according to officials, this is expected to be the final addition of u.s. military troops in iraq. currently there are alread 4600 american troops in iraq. tom: this morning it was cold out there, for half of the day anyway. mike: it was the coolest day
