freedom of speech have been doing just that all along. even when you pull the curtain to vote privately you now have the right to make your vote public. that's the decision from a federal appeals court upholding a lower court ruling that declared new hampshire's ban on ballot selfies unconstitutional. in 2014 in an effort to curb potential voter fraud, the state outlawed displaying photos of marked ballots a violation that carried a fine up to $1,000. that didn't stop people from posting so-called ballot selfies like state representative leon rideout did. >> i took a picture of my ballot and posted it on twitter and my facebook page for state rep. to me, it was just another incremental infringement on our

law on behalf of rideout and 2 other voters. legal anaylst kirsten wilson says the court saw the ban as a first amendment violation. >> it's really freedom of speech, and political speech, in particular, is one of the most protected areas of speech in the history of the united states. jean: representative rideout says he's undecided on posting his next ballot, but glad he has the choice. >> the ban on ballot selfies was unconstitutional and i think that made today a great day for free speech and our constitution. jean: we are still waiting for reaction from the state. while this ruling applies to the entire jurisdiction of the first circuit court of appeals, meaning ballot selfies are also allowed in maine, massachusetts, rhode island and puerto rico. live in the studio, jean mackin, wmur news9. tom: to commitment 2016 now. and democratic presidential nominee hillary clinton is making a direct appeal to younger voters with the help of the man many of them voted for

contacted and are involved in this investigation. shelley: tonight, there is a new twist to a mystery at sea. a son rescued after 8-days in a life raft. his mother believed to have accidentally drowned. but tonight, authorities have questions about that deadly boat ride off the coast of martha's vineyard. and police say that son, was also once questioned about the death of another family member. >> nathan carman spoke to abc news about his 8 days lost at sea. till we sank. >> carman spoke to reporters from his home in vernon, vermont. back on dry land, after being scooped up by a passing ship. the coast guard questioned the 22-year-old about how his boat took on water and sank, during a fishing trip with his mother off the coast of rhode island. nathan has asperger's syndrome, a high-functioning form of autism. he told investigators he lost sight of his mother as he scrambled into a life boat.

i did not see or hear my mom. i was calling out to my mom. shelley: his mother, 54-year-old linda carman of middletown, connecticut, is presumed dead. and just hours before nathan carman returned to shore, police in vermont were seizing items from his home. a search warrant revealed he is under investigation for reckless endangerment, resulting in a death. the warrant saying that the boat was in need of mechanical repair and that nathan could have rendered h operation. nathan says he thought the boat was safe. >> i would not have brought my mom out fishing with me had i not believed the boat was seaworthy. shelley: another twist in this story, nathan was also a suspect in the 2013 murder of his grandfather, john chakalos. a millionaire real estate developer, who had a home in chesterfield, new hampshire. nathan was the last person to see him alive.

millions after nathan's grandfather's death. nathan's own father defended him to reporters when asked if his son could have killed his grandfather and mother. >> most definitely not. they were the most important people in his life. shelley: nathan says he is devastated about the loss of his mother, and says she would have wanted him to survive. tom: today marks 35 years since the first of two murders in portsmouth that remain unsolved to this day. the body of -y a year later, the body of 19-year-old tammy little was found. both were students at portsmouth beauty school and showed signs of blunt force trauma. today, we spoke to the original head detective in both cases. >> i used to go to bed at night and wake up out of a sound sleep thinking if i had covered everything and if there was anything i missed.

the man who stabbed 10 people inside a minnesota mall was motivated partially by radical islamic groups. director james comey told congress that he's not ready to confirm the attack was an act of terrorism, but the bureau is still working on it. dahir adan went on a rampage september 17, stabbing 10 people before he was shot dead by an off-duty police officer. tom: investigators believe they have identified the two men accused of taking evidence in the new york and new jersey bombings. surveillance video shows the suitcase allegedly left behind by bombing suspect ahmad rahami. a law enforcement official told the a.p. that the two men are egyptian tourists that have returned home. investigators have notified eqyptian authorities saying that they want to question the men. shelley: officials say more than 600 soldiers will head to iraq to help reclaim mosul from isis. the troops will train and advise iraqis when the operation begins in the next few months. according to officials, this is
