wmur's jennifer crompton live in hampton where police are saying those charges could be upgraded. reporter: it was in a motel room behind me that police say they found a panel of fentanyl, open and accessible, the same room where a young child was found unresponsive hours earlier. tonight what happened in that room and how that child died are still not clear. 30-year-old leo witham faces misdemeanor child endangerment charge as well as drug possession and falsifying evidence felony charges, all in connection with the death of his 19-month-old stepson. this after police say he left the powerful opioid fentanyl open and accessible to the child. the case unfolding last wednesday morning, when police say witham brought the boy to the hampton fire department after 11:00. >> he was very distraught, obviously, the child was unresponsive and trying to make

trying to help contact his wife. reporter: it was later confirmed that the boy had died. police say when they searched the nearby motel room where witham and his wife had been living with the toddler and a 6-year-old, they found the open package of fentanyl and a bottle of pills they say witham tried to mild under a child's blanket. according to police, witham fled to massachusetts where he was arrested two days later. >> extreme tragedy, further investigation is happening, but mr. witham is the one who brought his young stepson to the fire department for emergency response, when he noticed his condition was nonresponsive. he's obviously very distraught about all of this. reporter: paperwork in the case has been sealed, police saying very little as they await autopsy results and the investigation continues. >> that's why we are waiting the toxicology results before we make determination as to whether

reporter: witham is held on $25,000 cash bail. family members were in court but declined comment. jennifer crompton, wmur news 9. jennifer: tonight a rochester man held without bail accused of selling a deadly dose of fentanyl. the fatal overdose happened back in june with ryan kirk's arrest coming this past weekend. andy hershberger is live in the newsroom with this. reporter: if convicted of this charge, kirk faces the possibility of life without parole. kirk appeared before a superior court judge today, charged with dispensing a controlled drug with death resulting. authorities say it happened in june when kirk allegedly sold a fentanyl dose, a lethal dose to a man in a rochester apartment complex where kirk lived at the time. court records say that one person witnessed the transaction and later watched as the victim took the drugs. prosecutors say they will continue to aggressively pursue

cases. >> there was a lengthy investigation conducted by the rochester police department, they conducted a number of interviews and spoke with individuals who provided information which led to the arrest of mr. kirk. reporter: the judge ordered kirk held today without bail. i'm andy hershberger, wmur news 9. tom: right now the investigation continues into a deadly crash on interstate 93 south just before the 293 split. state police say a f came up on slow moving traffic and couldn't stop in time. investigators say the 50-year-old driver from hudson hit several vehicles, causing one of them to roll over. 62-year-old cynthia perkins of derry was killed. no one else was seriously injured. jennifer: tonight a police deck has been charged with d.w.i. after a crash on 95. state police responded to the accident last night, they found a truck driven by 37-year-old

investigators say his truck struck the guard rail twice after gilroy failed to negotiate the ramp. gilroy has been charged with with with d.w.i. the hampton police department says it is handling the personnel matter, while the state police conduct the criminal investigation. tom: right now authorities are investigating an incident that happened along the daniel webster highway in meredith on sunday when someone found a seriously injured man along the road. wmur's kristen pope spoke with police h think might have happened. kristen? reporter: police say that right now they're looking into this as either an assault or a hit-and-run investigation. and they're calling on the public for more information. here's what they know and what they say happened. sunday morning a man passing by called police saying a body was lying in the road on daniel webster highway in meredith. when authorities arrived the man appeared unconscious, and officer called for backup and an

performance plastics plant. to connect roughly two dozen homes to a public water source. negotiations have been under way since this summer when pfoa from the nearby st. gobain facility was found in well water in this southern most area of manchester. 26 homes will transition from pfoa contaminated wells to city water, with the 1.2 million cost of the work being covered by st. the job is expected to last until mid mayor gatsas says the deal the city reached with st. gobain is a good one and he wanted to provide some relief for people living in this part of the queen city. >> because they've been drinking bottled water for a long time, and i just think that their patience has been great and we should get it done. reporter: similar work is being done in merrimack now to connect 15 homes in that town to a public water source. but in litchfield where there are many more wells contaminated

from plymouth in the upper valley and monadnock region. hard freeze in many of those locales, down to 31 in concord and also nashua for the first time this season below the freezing mark right at 32 in row chester and a little above in manchester and right along the coast. right now it's somewhere in between that and where we were earlier this afternoon, but certainly much closer to the highs of the day. 50's and low 60's. not nearly as chilly as it was at this hour last evening. clouds moving in it will not be as cold tonight, but still chilly. near freezing in the great north woods, 30's to around 40 elsewhere and milder downtown manchester and right along the coastline. for now at least tomorrow into thursday, we're under this air mass, so that means temperatures at or above the average through thursday night into early, early friday morning. and then notice it will turn much cooler, we're not going to look for highs in the 30's, but it will start to drop.

as for clouds moving in, very few if any for this evening. then during the overnight some of these back around toronto and buffalo will begin to move in. but no rain with them. so it stays dry into the morning commute tomorrow. could dawn with a few clouds mixing in with partial sun and during the late morning and afternoon a lot of the clouds thin out, for full sunshine for the rest of the day. thursday a few more changes develop. winds freshen a little bit on shore, so a few more low clouds, could be a little drizzle around, maybe through midday, early afternoon. best afternoon, and early evening. anywhere in the state, as for rain tallies, maybe up to a quarter inch. but you know the story about the extreme drought, could use a lot more than just that. as for highs tomorrow, mid to upper 60's in many spots. notice a little cooler with that seabreeze at the coast. lower 60's along the water's edge. speaking of the water, take you out to the busy tropics, this is now hurricane nicole.

organized, much better organized, and kind of symmetrical there in terms of thunderstorms developing north, south, west and east of the center. notice the track if you have friends out in bermuda or heading in that direction, it's going to be some rough going beginning later tomorrow night into thursday. it could hit as a major hurricane. right now it's a max cap two, which means top sustained winds of 110. but they could get higher than that. but after thursday it races out to sea, well east of new england. around here mild through thursday, couple of showers, then it's bright, breezy cool for friday. chilly start to the weekend and milder to finish. a fairly typical mid fall-like pattern. tom: quite a sight on the mound at fenway last night. >> it really was, we'll share that with you, david ortiz.
