the welfare of a child. police say he went to a building in manchester to buy crack cocaine with a 4-year-old child in his car. >> there were special enforcement undercover detectives in the area of a suspected drug house. they observed a jeep pull up in front of that residence. the male left the jeep and went inside the apartment building for approximately 20 minutes. reporter: court documents say emerson came out of the apartment, got back into the jeep and td signal. police followed him for a short distance, and approached his vehicle at derryfield park. >> upon making contact with mr. emerson they found crack cocaine and a crack pipe in the vehicle, and a young 4-year-old child in the back seat at the time. reporter: emerson was arrested and appeared before a judge. the child was released to family. >> when you place a killed in an

is a dangerous situation, whether it be drug activity or violence, certainly you're not providing and caring for the child at that point. reporter: emerson's bail was set at $1,000. i'm andy hershberger, wmur news 9. jennifer: a medical call to a concord hotel led to drug charges. police charged timothy malone and briana demoore with possession of a narcotic with intent to distribute. officers seized a bag which meth, they also found needles, cash and a scale. tom: tonight we're getting our first look at the driver who is now charged with kill five teens in a crash in vermont. steven burgoyne was shackled to a hospital wheelchair and surrounded by state troopers in a conference room converted into a courtroom. his lawyer entered a not guilty plea to seven counts, five of those are for second degree murder. prosecutors allege he was driving the wrong way on

in. he's being held without bail until he undergoes a judge-ordered competency evaluates. the man who took hostages at hillary clinton campaign office back in 2007 went before a federal judge in concord today for a different crime. jennifer: a trial date was set for leeland eisenberg, charged with robbing a manchester bank. heather hamel has the story. reporter: eisenberg came in shackled at the feet and he looks much different now, thinner, older, his hair all gray. he had little to say, only answering the judge with polite responses as he heard the serious charges he's now facing. on bank robbery and drug charges, leeland eisenberg is now before a federal judge. >> they asked us to take a look at it, see if we were interest. reporter: the case dates back to early august, eisenberg alley went into the citizens bank in

threatening note. the assistant u.s. attorney says it's not uncommon for bank robbery cases to end up in federal court and says sometimes the penalty can be stiffer. >> the statute for the bank robbery under federal court is a 20-year maximum by statute. and generally it's more significant than state sentences are. reporter: eisenberg also allegedly had a mall amount of cocaine on him. this is not the fir been in trouble with the law. in 2007 he held police at bay for five hours as he held hadn'ts in hillary clintons campaign office in rochester. he was released in 2009 but served more time for probation violations. he's only been out of jail since june. >> the name rang a bell but i wasn't sure why, and then i realized why. so we made our judgment based on the facts of this bank robbery. reporter: leeland eisenberg

is set for december. jennifer: tonight police have arrested a man suspected of two recent bank rob rose in rochester. the first was at the citizens bank inside the hannaford, six days later the td bank was robbed. in both cases the suspect presented a note demanding money, but no weapon was shown. he's being he charges. tom: new details tonight about why owen labrie's lawyers say he should get a new trial. he's appealing his conviction ?n troalings an on campus assault. reporter: former st. paul school student owen labrie claims that ineffective counsel during his 2015 trial resulted in his conviction for a computer offense.

the argument. labrie is serving a one-year sentence and must register as a sex offender for life, convicted of three misdemeanor assault charges, and the felony certain uses of a computer for alley using it to lure in a 15-year-old freshman. in court paperwork his current lawyer refers to a recent interview they had had with an i.t. employee at the school, and claims that e-mails between labrie and the young wom left the st. paul's school internal intranet server, and thus mr. labrie did not utilize a computer online service, internet service or local bulletin bore service as is required by state statute. the appeal contends that by failing to investigate the source of the e-mails, attorney carney jr. failed his client. jennifer crompton, wmur news 9. jennifer: there are some answer tonights for hundreds of

tom: when seacoast residents wake up tomorrow they will notice a major change in the skyline over the river. jennifer: that's because right now crews are working to prepare for the removal of the first piece of the sarah long bridge, the center span. wmur's mike cronin live in portsmouth tonight with a front row view. reporter: the preparation is done, and now the rising tide is doing the work to lift and move

bridge, that's what's being removed. and this is a milestone in the project. at 2 million pounds, 250 feet long, the center span of the sarah mildred long bridge will be gone by tomorrow. and within the next hour, the tide will move it off the bearings and then the department of transportation workers from new hampshire and maine will float it to the state peer to take it out of the water. eventually the towers and rest of of the bridge will be remove to make way for the new bridge which is being b being demolished. it a $158 million replacement project with with about 100 to 150 people working on it daily. >> very complicated, a lot of intricate work going into preparation for it. the primary focus is having a safe removal, so a lot of care is being taken to make sure everything is done correctly. reporter: river traffic will once again be able to pass through here starting on monday,

to be open to automobile traffic in september of 2017. mike cronin, wmur news 9. mike: we've reached peak color in many parts of new hampshire. look at the time lapse photos, we start off in warner today from sunup to sundown, full sunshine. it was a little breezy, certainly on the cool sigh. but a lot of nice fall color to be had out there. speaking of which, peak color now from the great north woods, although in past, but peak in the white mountains through tupper valley and then you get down to the plymouth area all the way into the lake sunapee zone, the monadnock region as well, right at the coast 40 to 60%. so some of the favorite routes over the weekend, roux 117 franconia to sugar hill offers fine color. winds will be fairly light, so not a big leaf drop over the weekend. route 16 conway to jackson, also

and elsewhere route 113 in tamworth and also 108 in stratham to exeter, a fine ride this weekend. and look at temperatures right now, on the chilly side, lower 50's from manchester towards the coast. back into the monadnock region, already dropping into the 40's. same story through the lake sunapee zone through new london and newbury. upper valley, upper 40's to around 50. a right around tupper 40's, give or take two or three degrees and then take a look at the winter chill as you go from 40's into 30's from the white mountains and the northern parts of coos county. heading for the upper teens to around 20 by daybreak. so frosty cold state wild. this will be the first frost of the season along the coast. everyone else has seen some frost, and freezing temperatures. so overnight tonight we'll be back interest the chill in a big, big way. but unlike the last 24 hours

those temperatures starting sunday. look at the warmth building in the nations my section. it turns warmer in parts of the rockies, denver of all places sitting at 81 degrees. and can't rule out if everything works out just so with enough sun, sometime during the middle of next week tuesday or wednesday, we could make a run close to 80 degrees. fair skies tonight, a little valley fog later on, but the big key here will be the temperatures that drop back below freezing. so a saturday. by sunday a few changes, the next front draws near. so a blend of sun and clouds during the midday and afternoon after a sunny start. then very late in the afternoon a couple of these showers in upstate new york may clip northern parts of the state. and everyonees will have to wait until the evening or overnight to get in on a passing shower. highs tomorrow very close to where they were today, but the winds not as strong, so it will
