reporter: state officials tell us this is not considered an outbreak. they're trying to get ahead of to it prevent further spread. some of the things that you can do, cover coughs and sneezes, don't share utensils and cups, and wash your hands. there have been a total of nine reported cases this year in the state of new hampshire. live in durham, naoko funayama, wmur news 9. jennifer: tonight a driver is now taking responsibility for the crash that killed a retired teacher at a busy intersection today 25-year-old jordan heath pleaded guilty to a lesser charge. heather hamel is live with why she won't be spending any time behind bars. reporter: jordan heath pleaded guilty to vehicular assault in the death of michael fells, she received a 12-month suspended sentence. the victim's family says it is a step in the right direction, however they are not ready to forgive her.

birthday, miss heath took away a husband of 45 years. reporter: through tears, eliza morris told the judge about the lasting heart ache the death of her father caused the family. michael phelps was on his way to volunteer at a local cancer center when his motorcycle was hit in a busy intersection in allenstown. today the 25-year-old driver, jordan heath, took responsibility, but she was spared any jail time. >> i certainly regret my actions that day,nd the weight that they hold. reporter: heath had first said faulty brakes were to blame, but prosecutors say she had been texting prior to the crash. heath was charged with negligent homicide, but her trial in may ended in a hung jury. today she pleaded guilty to a lesser charge of vehicular assault. >> my dad had a big heart and he would have wanted us to forgive you, and perhaps in time we will fine it in our hearts.

to hear you admit guilt brings our family a bit of peace and closure. reporter: heath received a 12 month suspended sentence and her license was revoked for five years, something the family says eases their minds. heath will also be required to participate in a distracted driving video. and the phelps family can also be part of. that the family hopes her community service will help others. heather hamel, wmur news 9. tom: we now that of miss nashua teen jacob goulet. police say that autopsy results are still pending. the 16-year-old's body was found sunday in the river in tyngsboro, mass. police brief he may have fallen into a storm drain on friday. jennifer: three people were hurt in a crash on route 125 in rochester. police say a 78-year-old driver rear ended an s.u.v. which was supposed to turn left onto hemingway drive. the impact pushed the s.u.v.

then into a tractor trailer, causing that truck to roll onto its side. we don't yet know the extent of any injuries involved. tom: a convicted sex offender heading back to prison for violating his pa proposal. carl blake pleaded guilty to three charges that included aggravated flown youths sexual assault back in 2001. he was released in 2007 and placed on the sex offender registry. earlier this month he was accused of engaging in lewd behavior and while no criminal officer testified today that he admitted to inappropriate conduct. >> based on the statement that carl blake made in writing saying that he did expose himself, he did it out of desperation, that this would be the same thing as a drug use. he admitted to it. he stated that he did this. i don't see how it could not be found -- tom: blake is going back to

tom: rochester police looking for answers after prescription medication was found in a vending machine. jennifer: courtney jones says she found the drugs inside a plastic container that she got from a toy machine at the rochester house of pizza back on friday. the restaurant's owner telling us that he has no idea how the drugs ended up in the machine, and has since removed it. >> we went over to the machines and i put the quarters in and she got two toys, and then the third one came out. >> two of them were a form the third was a kidney stone type medication. >> so police are working with the vendor who says he buys in bulk and then pours all of that into the machine and they are also reviewing surveillance to make sure the machine was never tampered with. tom: we go to now the weather picture, and it is chilly mornings now. josh j.: frosty and even snowy in some parts of the state. those flakes were flying today, we'll tell you if that could happen at any other point this

jennifer: a sculptor from maine is transforming this prize winning pumpkin into a work of art. the pumpkin believed to be the biggest one ever grown in the granite state. tom: as shelley walcott explains, work is now under way to trick it out, get it out in time for halloween. reporter: like any great story, pumpkin carver mo says the plot for this giant pumpkin so for us it's about looking at the pumpkin and deciding really on the spot what we're going to be doing. reporter: he's a retired middle school teacher from maine, he's been sculpting and paining for over 35 years and carved his first giant pumpkin nearly 20 years ago. he says today's pumpkin theme is scream. >> so we had his head tilting and we saw that tilt because of where the nose was going to be,

decided to put a hand on the left-hand side, making it look like a leaning tape of face. reporter: at 2,066 pounds, this pumpkin was the prize winner at the dear fielder their and is believed to be the largest pumpkin ever grown in new hampshire. the grower of boscawen says that was no easy feat. >> it a lot of hard work, and it started with a seen from this line of giants. report manchester, he and his team will be scraping and peeling with pottery tools, transform, an award winner into a work of art, hoping to bring some halloween happiness to this corner of southern new hampshire. >> this is going to stay right here for everybody in manchester to enjoy and hopefully they'll come out and see it. we're going to light had this thing up tonight. when these things light up, it will glow like the moon, so it will be a traffic stopper for sure. shelley: in manchester, shelley

josh j.: people are going out of their gord with snow and cooler weather today. here's a look at your unofficial high temperatures, only making it into the 30's in northern new hampshire, and the 40's elsewhere. the highest we could muster in concord was 47. and mid to upper 40's everywhere else. 43 in keene and lebanon. 41 in plymouth. and the winds of course have been gusting as well, making these temperaturee your current temperatures a few degrees lower than what i just showed you where we maxed out today and there's the winds, these are the current wind gusts from 15 to 25 miles per hour. and they gradually settle down through the night tonight and through the day tomorrow, but tomorrow it will still be breezy, but not as windy as what we saw today. here's a sneak peek at what it might look like tomorrow, 5 to 15, maybe 20-mile per hour gusts

clouds, this is all being caused by the wind bumping into the mountains. unlike a thunderstorm, for example, that moves across the screen, notice how this is stationary, and the reason for that is the winds come up over the mountain, forcing the air to rise. the air cools down and condenses, forms clouds, and snow. then it comes down the other side and dries out a little bit and warms up through to compression, and that's why we see a change over pulls away, the upsloping or there's a technical term, it's a tough term. these systems pulling down colder air from can darks it's chilly up there, so even cooler air pushing in, it means a cold night tonight, a chilly day tomorrow and a colder night for tomorrow, wednesday into

so a freeze for most likely tomorrow night, and frost and some freezing for tonight as well. those snow showers will wean a bit overnight and into the day tomorrow, still some flurries possible. but otherwise sunshine and some clouds at times. so partly to at times mostly sunny for tomorrow. the wind a little calmer so that's all better, however the temperatures don't really go up a lot from here tomorrow. as it will stay in the 40's a hampshire. because of the cold night tomorrow night, we have a system coming in thursday that will approach as snow. but because of the timing, and the timing is key on this, as long as it pofs in in the afternoon you'll see it warms up just enough to keep it as rain in most of the state. but areas north and west could have snow and in fact it could be sizable amounts of snow, could be several inches in the mountains as the cold air tries

jamie: we have to do it, let's get it over with. 30 years ago today, game 6, bob stanley, mookie wilson, the his wicked legs, mets end up winning, they go onto game 7, mets end up winning. but we've won three times since, the red sox, and now we are onto 2016. and here we go. game one is tonight, chicago cubs at the cleveland indians. should be great. both teams have outstanding pitching staffs, which is why they're here in the fall classic in the first place. they both have exceptional starters going in game one. here they are.
