in a dorm room. a mob later she went to the school's health center and reported what happened. the school notified exeter police and dcyf because the two students were 15 years old and cannot lawfully consent to sex. exeter police did not investigate, but a private investigator for the school found that john doe vile lated the school's misconduct policies. the school says that jane roe did not clearly consent, although it's important to note it was assault. john doe was placed on leave with the possibility of returning in the fall after seeking therapy, but then the school decided he couldn't come back. his lawyers say the school did not treat john doe fairly. but phillips exeter said the policies clearly say it can take immediate action if necessary. following opening statements, john doe testified, he says the sexual encounter was consensual and feels as though he's being punished for something that did

initially was put on dean's leave, he saw a therapist, complying with what the school asked him to do. his mother also testified she says her son is a responsible good person, she feels the school wrongfully kicked him out. the trial will start up again tomorrow morning at 9:00 a.m., it is expected to go until friday. kristen carosa, wmur news 9. tom: tonight lebanon police and hospital security stepping up patrols after a woman was attacked. it happene o trail across the street from dartmouth hitchcock medical center. wmur's that bond lopez live now with the latest. reporter: police have been driving by this area all evening and hospital security also making themselves more visible following the attack that happened just around this time last night. police say a 23-year-old woman was walking alone when a man came up from behind and jumped her, knocking her to the ground, she was able to fight him off and only receive minor injuries,

these trails say they'll be keeping an eye out when walking in the area. >> today you gotta keep your eyes open any way, your car at night, somebody could be trying to rob you. >> i wish it was safe here. it used to be, i guess you could always say that. but it hurts. reporter: the suspect is described as an 18 to 25-year-old white man with shaggy dirty blond hair, six fight a clark colored accident -- dark coloredded vehicle. tom: tonight investigators say the men forced their way into an apartment on nashua road saturday morning. the victim was treated for a cut to his head, a woman inside the apartment was not hurt. police say they do have two suspects.

went off it extinguished almost like a white powder onto their clothing, we eventually put out information to surrounding law enforcement agencies and they were able to -- dracut, mags called us and said they had contact with subjects that had white all over them. tom: police say this appears to have been a targeted attack. jennifer: dozens of firefighter are battling brush fires across the state, in albany a large fire has scorched more than 300 acres, and that fire is only 15% contained. jennifer crompton has the latest. reporter: being called the covered bridge fire started saturday and has grown to 325 acres. white smoke could be seen billowing above the forest near albany. 45 firefighters have been able to prevent the flames from threatening any buildings.

happening over new england. there are a few high clouds right now, but the thicker clouds with the steady rain holding off until sometime tomorrow morning, and right now it's lined up over southern new jersey, back through the nation's capital and into portions of the appalachian mountains. tomorrow morning we see the thick clouds already moving in with a couple of light showers, but late morning and afternoon steady rain, possibly over an inch in many spots, but how much more than that could we see and when will that to return. jennifer: vice president elect mike pence says he is recruiting people with character and the competence to implement donald trump's vision for the country. as the trump administration slowly takes shape, new hampshire could play a major role in several key positions. josh mcelveen takes a look at the possibilities. josh: with no experience in the federal government until now, the task at hand for donald trump is daunting, so as he

josh: and perhaps the biggest new hampshire wild card. >> if we don't stab up to them sooner and more strongly. reporter: although ayotte lost her re-election bid, the former state attorney general could provide value in areas from the department of justice through the department of defense. while ayotte has made it clear she's not lobbying for anything, those with transition team experience know, plenty of others are. >> mike pence will be invaluable, but he's got some other seasoned people around him, certainly newt gingrich and othe this process before. it just takes a while, but they're being overreturn and they need to take a deep breath and let it sort out. reporter: senator ayotte had no comment except to reiterate that she's not lobbying for any position. others are eager to make the case in homes of hearing the president elect say two words, you're hired.

available for granite staters having trouble paying their heating bills. tom: the new hampshire fuel assistance program helps vulnerable families and seniors heat their homes. this year the program opened two weeks early because federal funds have already been released. so far about 14,000 homes have been approved to take part in the program. >> it's extremely important. last winter we all know we had a very mild winter. we never know from one year the next how it will be. for them to get the assistance now and manage their fuel through the winter is very important. tom: the program served more than 35,000 households last year. looks like we're going to get some rain tomorrow. mike: it is a good thing, we're still below average for rainfall here, so the drought continues. the rain will help and there it is, another look at your super,

designs. speaking of cool, how about the start we had today. look at the time lapse in warner, we had the crystal clear skies. those temperatures bottomed out well below freezing. it was a thick frost and take a look at the low in concord this morning, 24. but look at the big jump we had during the afternoon. we spiked up to 67, only four off the record high, and that report set back on this date in 1989. while we had a chilly cold morning, record 1986. 30's right now up north, and some spots near freezing. 43 atop mount washington, indicating that the air mass is relatively warm. but tomorrow we won't really feel the warmth due to the clouds and light on shore breeze. 40's for many, and a couple of low 50's at the coast and in downtown manchester. by later tonight we bottom out in the 20's to slow 30's, right around freezing in manchester, about 34 at the coast, so

tomorrow morning. speaking of cold, most of the wintery air is locked up into canada for now and should remain there a good part of this week, that means the next system that arrives tomorrow will be in the form of rain showers early in the morning, in southern parts of new england, those showers will eventually make their way into southern new hampshire. in the midday and afternoon over a good state. for tonight, mainly fair, a few high thin clouds. by tomorrow morning any breaks of sun quickly give way to thickening clouds. with the rain off shore and to our south it's dry through the morning commute. except for an isolated shower. different story for lunch time into the evening commute. take a look at this wall of rain that moves in, some of these downpours could produce over a

hours and you're over an inch and a half by tomorrow night and early wednesday. wednesday we dawn with some clouds, a few light showers to the north, then developing partial sun did you to the afternoon. by the way, the super moon, that means a high astronomical tide, there is a coastal flood warning along the coast for 10:00 in the morning through 2:00. the high tide kicks up during the mid to late morning, that means minor slooding and splashover likely in those hours. not much rain through 10 or 11:00, but after that time frame up to an inch plus in some areas, even near the coast. that would put a nice dent in the drought. if we get over an inch of rain tomorrow, we would work out of the top 10 driest years on record. we will not even make into it
