josh: breaking news tonight, it appears right now, a school bus driver strike will be averted until at least next week. good evening. i'm josh mcelveen. jennifer: and i'm jennifer vaughn. the nashua school district was already warning tonight, that if there was a strike school would be cancelled. but for now, it appears that won't be necessary. wmur's cherise leclerc is live in derry where she just spoke to the superintendent there. reporter: this evening as superintendents have been assured that buses will operate as normal tomorrow, -- as normal, at least through next tuesday, but they're already looking ahead to possible steps they need to take next week in case the strike happens. earlier this week, union bus drivers in belmont, who work for the private bus company first student, authorized a strike that they said could happen thursday morning. they're unhappy with the company's latest contract offer.

have been meeting in washington, d.c., to work out a deal. today's meetings to resolve the need -- to resolve the issue were productive. drivers outside of the month are working under a current contract and are prohibited from striking, but, other first student school bus drivers have indicated that if belmont goes on strike, they may honor it and not operate their buses either. that could affect as many as 33 districts all across new hampshire. >> really a community issue. parents have a great deal of reliance on schools to provide transportation with those will buses running in the morning and afternoon. families that have both parents at work or families that have one parent in a household, this really does pose a lot of issues. reporter: these districts are preparing plans just in case those sides do not come to an agreement next tuesday.

wmur news9. josh: right now police in nashua are investigating a shooting there. jennifer: it left two people with serious injuries and a section of a city neighborhood blocked off for most of the day. wmur's siobhan lopez is live near the scene with new details. reporter: we now know the suspect is a minor. police say he was taken into custody almost immediately after the call came in, but their investigation is far from over. a nashua neighborhood shut down, crime e were shot just before seven this -- 7:00 this morning at the corner of ash and lake streets. >> this is an area that's full of kids, there's so many kids, that's very scary. reporter: moments after police received a call about shots fired, a city hospital reported two gunshot victims had arrived on their own. a responding officer on his way to the scene saw a male juvenile allegedly tampering with evidence. he was identified as the suspect.

there was no threat to safety or anything like that. reporter: nearby schools were unaffected by the investigation after police deemed there was no threat. some neighbors say it's frightening but they feel safe. >> for the most part i mean they have cops everywhere around here so i'm not too concerned. reporter: dan st. ours, just moved in a few weeks ago and woke up to find that his street was a crime scene. >> it's something that happened a lot when i grew up and where i grew up so it happening right here right now i mean i don't find it shocking. there's a lot of drug activity here a lot of heroin. ,reporter: it's unclear what led up to the shooting, police say they're looking into the motive. >> that part is still under investigation what relationship if any the victims had to the person responsible. reporter: the suspect's name has not been released, he faces several charges including falsifying physical evidence. he's due in court tomorrow. the victims, a man and woman both adults, are expected to

life in nashua, siobhan lopez, wmur news 9. josh: tonight the appeal of seth mazzaglia has been heard by the state's highest court. the justices listened to argument today and will determine if the man convicted of killing a unh student lizzi marriott should get a new trial. wmur's andy hershberger joins us live with more. reporter: lawyers for seth mazzaglia are asking the supreme court to consider whether he was given a full and fair trial for the murder of lizzy marriott. mazzaglia was convicted of first degree m student. prosecutors say he lured the teenager to his apartment and strangled her, then threw her body in the ocean never to be found. defense lawyers claim marriott may have died during a consensual sexual encounter and her sexual history should have been explored at trial. prosecutors say that type of evidence is covered by the state's rape shield law and that the case against mazzaglia was powerful based largely on eyewitness testimony.

be outside the box. a busy day at trump tower in new york, as members of donald trump's transition team make their way in and out. advisors say the task of picking the next presidential cabinet is going smoothly, contrary to reports of turmoil. trump tweeted, very organized process taking place as i decide on cabinet and many other positions. i am the only one who knows who the finalists are. >> if anything he has obviously more choices than one to fill in each position, so we have an embarrassment of riches. reporter: as he met with thos critics. new york city mayor bill de blasio says he and the president-elect had a respectful and candid conversation about the concerns of new yorkers post-election. >> i let him know that so many new yorkers are fearful and more had to be done to show this country can heal. reporter: meanwhile, here in washington, vice president-elect mike pence met with trump advisors, including newt gingrich. then pence and his wife also had

>> i'm confident on day one everything will be in good hands. >> we're just very grateful for the hospitality today of the vice president and the second lady. we had a very enjoyable time, and we got the cook's tour. reporter: on twitter, donald trump is denying reports that he's trying to get top level security clearance for his children. in washington, i'm aixa diaz. jennifer: today college students at campuses across the u.s. are protesting against president-elect donald trump's immigration plans. >> the people united will never be defeated. reporter: organizers say students at dozens of schools including yale in connecticut are holding rallies and walkouts. they are calling for schools to become havens for people who may face deportation. >> we commend everyone of you for standing with us. we do challenge you to step

there. join us. see the pain that these families are facing everyday, face to face. jennifer: organizers are also rallying supporters on social media with the hashtag, #sanctuarycampus. josh: former maryland governor and presidential candidate martin o'malley says he will not run for chairman of the democratic national committee. o'malley released a statement today thanking friends and family who urged him to consider running, but he says the committee needs a chairman who can quote do the job fully and with impartiality. earlier this wee announced he will run for the position. at the end of the month, newly elected lawmakers will arrive at the state house for a two day orientation ahead on the 2017 legislative session that will include the task of coming up with a state budget. for the first time since 2002, republicans control the new hampshire house, senate, and the governor's office. and senate president chuck morse believes lawmakers have a great opportunity and responsibility before them. >> the reality is we gotta grow

josh: authorities say the suspected gunman was a former southwest airlines employee and was acting in retaliation, after losing his job last year. abc's lauren lyster has new details. reporter: operations getting back to normal today at oklahoma city's airport after tuesday's deadly shooting that grounded planes and had travelers sheltering in place. >> they just ground stopped the airport. they've got some situation going on over here? reporter: around 1:00 p.m. yesterday, shots fired in the airport parking lot. >> sidewalk outside of the southwest ticket counter. reporter: the airport going into lockdown. passengers stranded on plans for hours. police in tactical gear search for the shooter going from car to car for nearly three hours, and then -- >> a suspect was located deceased with an apparent gunshot wound to the head. reporter: the suspected gunman identified as lloyd dean buie a former southwest ramp agent who worked at this airport.

influence of alcohol at work one day in 2015 asking him to be tested, instead he resigned. >> it is possible the suspect acted in retaliation to the circumstances leading up to his resignation. we know his intentions were to go to the airport and hurt someone. reporter: that victim, southwest airlines employee michael winchester the 52-year-old's son , james a pro footballer with the kansas city chiefs. the team tweeting their support writou winchester family. our heartfelt thoughts & prayers are with you. police report the victim was not the suspect's supervisor and they don't know at this point if that was the gunman's intended target. lauren lyster, abc news, los angeles. jennifer: hundreds of police officers are paying their respects to a pennsylvania officer who was shot and killed last week. officer scott bashioum and officer james saieva were shot while responding to a domestic call.

bashioum also served in the u.s. air force and will be buried with full military honors. josh: investigators are trying to find out what caused a train crash in florida this morning. two trains carrying coal and phosphate rock hit each other, causing at least 20 cars to derail. the crash caused a fuel spill, but a hazardous materials team was able to contain it. two people were hurt, but are expected to be o.k. jennifer: and a new report says a tram in london was traveling at four times the speed limit when it crashed. about 50 were hurt when the train derailed last week. early investigations did not find any problems with the brakes or track. authorities arrested the tram driver on suspicion of manslaughter. josh: an air quality warning in effect for parts of the carolinas because of wildfires burning in the south. people are being warned to avoid staying outside for long periods of time and some say the smoke is so thick it blocks the sun. outdoor activities such as

could easily ignite. wildfires across the southeast have burned 80,000 acres. >> now, meteorologist josh judge with your storm watch nine just -- stormwatch nine forecast. weather: we had temperatures that were above average for this time of year. that kept its kind of mild, despite the extra clouds around. check out your current temperatures. we are still 50 degrees or higher in a lot of locations. jeffrey 48 degrees. we did make it well into the 50's today. even the mid and upper 50's. concord made it to 58 degrees. let's cap your rainfall -- recap your rainfall. any place is getting anywhere from just a couple hundred -- tenths of an inch to a couple inches. nothing major, but certainly a couple hundred up to a couple

average up helps at least somewhat. cloudiest in southern new hampshire. there has been some clearing. some sprinkles in parts of northern new hampshire. you will notice there is still a good amount of clouds around here. the storm system now pulling away up to our northeast. that will allow for the winds to turn to our northwest and for the air to start drying out over the next few days. situation. we will see the clouds clearing out overnight. things are going to get much nicer over the next few days. a very nice stretch of weather for the next three days is at hand. tomorrow morning we start p with gradually clearing clouds, stubborn in the mountains for a little while. the sun should still be up to come out. going to the day, you can see more sunshine. it will turn partly cloudy tomorrow.

it will feel a little warmer because of the sunshine that will be around. it is still looking pretty good on friday. friday looks phenomenal. some areas will hit 60 degrees or even the low 60's with a let sunshine parried as we head into the weekend, it is sort of a weekend split. saturday looking pretty good, but notice clouds closing in from both directions. that is never good news. we do have some showers that will be on the way for sunday. temperatures -- 30's to lower 40's. we keep clouds and some fog overnight, so that does not allow temperatures to fall all that much. tomorrow, similar, maybe even a couple degrees cooler than today. it will feel better because you will see more sunshine. a quick little peek ahead to friday, because it does look nice as those temperatures will be in the upper 50's. some areas could even be in the

shock when the bill arrives, saddled with thousands of dollars of medical bills from an out of network doctor. these surprise medical bills have many experts concerned, since few patients would pause to ask an er doctor, ?hey, are you in my insurance network?? a new article from researchers at yale report that many e.r. visits involve costly out of network treatment. the researchers studied more than two million visits to the emergency room. on average more than one in five emergencies were out of network for the patient. in some communities out of network docs accounting for 89% of e.r. claims. and in these cases, insurance companies only pay a small portion of the bill. patients are left holding the bag, shelling out, on average, $622. in some states, laws protect patients from these surprise costs. but in many cases the charges are hard to avoid, at least for now. a situation that unfortunately

josh: now at 5:30 the dean of students at phillips exeter academy breaks down on the witness stand in the case against the school and its handling of an expelled student. weather: as our weather fortunes change, we're eyeing more sunshine to come. a look at which days will be the nicest. jennifer: plus a new era in washington with republicans taking control of both congress and the white house. the work lawmakers plan to do before and after the inauguration. josh: and with his 4 game suspension well behind him tom brady is making fun of the deflate gate scandal in a new commercial. >> no one covers new hampshire like we do. now, wmur news 9 at 5:30.

more about a federal lawsuit against phillips exeter academy, where a mother of a student is suing the school. jennifer: the dean of students testified, saying the school conducted a fair investigation and make the right decision for both student. kristen carosa is live in concord with this. reporter: the dean of students spent most of the day on the stand talking about how the school came to the decision. advisor, and he provided insight into the process. after an investigation in march, phillips exeter academy made the decision to put a male student known as john doe on a dean's leave calling a sexual encounter he had with a female student. they were both 15 years old at the time to months later the school said the boy could not come back because he violated the schools's harassment and sexual misconduct policy.

suing for damages and dean of students testified today, saying in may of this year, the girl's parents told the school that if john doe was allowed to return, the girl would not come back, and that they would seek legal action. this case also came at a time when the school is under fire for its handling of sexual misconduct allegations. while being questioned by lawyers for the school, the dean said the threat of legal action by the girl's family had no effect on the school and they continue despite media attention. the dean says the decision to remove john doe was in the decision -- as in the best interest of both students in this case. the school questioned whether he could be successful at the school if a lot back. an advisor also testify that he was present during the boy's interview with an independent investigator hired look at the case. after the interview, the boy told him it was an uncomfortable experience, and the advisor agreed, something he reported to the dean's at the school.

will take the stand tomorrow. the trial will resume at 9:00 a.m. live in concord, kristen carosa, wmur news 9 very jennifer: right now manchester police are looking for a man who they say broke into a gas station and stole cash. in this surveillance photo you can see the suspect walking into the z-1 express on second street just before four this morning. -- just before 4:00 this morning. police say the masked man smashed the front door before taking money from the register and two packs of cigarettes. he was last seen headed toward queen city avenue. josh: devices like cell phones, tablets, and laptops are a part of our every day lives, and their users are getting younger. investigators say the exploitation of children is exploding thanks in part to apps that allow strangers to interact with children in some cases hundreds of miles away. here in new hampshire, the internet crimes against children task force receives a cyber tip every single day about a possible child victim. but officials say while the caseload is exploding the funding has been cut dramatically.

new hampshire that we just can't investigate because we don't have the time or the resources to do. josh: tonight at 11:00, news 9 investigates, going inside the forensic lab to see the tools that's helping crack cases and the one resource this team says it needs to continue their mission. a week after the general election, several state races remain in limbo. today, the secretary of state's office continued the recount in 14 house races and one senate race. >> the important thing is that ones that lost have an opportunity to see every ballot every mark on the ballot, and , see how the ballot is being counted. josh: the secretary of states office hopes to have the recounts completed and the races resolved by tuesday of next week. jennifer: for the first time in a decade republican will take control of congress, the white white house. the gop is preparing to push an ambitious agenda next year. wmur's sally kidd is in washington with how much lawmakers are expected to get done before they adjourn.

josh: some incredible video tonight of a high speed impact between a freight train and tractor trailer. jennifer: the truck driver was moving a family from georgia to florida when he got stuck on the train tracks. he says he did not even see the note trucks sign until it was too late. the next thing he heard was the horn of an oncoming train. he and his wife jumped to safety in the nick of time. no one was hurt. no doubt nike's self lacing sneakers will top many chirstmas they're not going nto be cheap. that going to be cheap. nike just revealed they will cost $720 a pair. next week select users of the nike plus app will get early access to purchase the sneakers. they are expected to arrive at stores sometime in december. josh: tonight there's a new commerical on the air that features patriots quarterback tom brady poking a little fun of deflategate. >> just because something is

conditions. this temperature is pushing in our direction. this cold way up in the pacific northwest will sweep through the entire nation. everywhere in the entire country will be talking about a time temperature drops. they have an going through some high heat in the south. places in the -- places in texas have been near 90's, but they will be down near the 60's this weekend. maybe some of the 60's on friday, and then dropping into the 30's and the spread next week. here is the high pressure that was in tomorrow and gives us partly sunny skies. that sticks around for the next couple of days. friday looking like a fantastic way. saturday looking nice as well. there is that front i was mentioning. here comes that much colder air that pushes in over the sunday to monday time.

clearing overnight tomorrow in to the morning. partly sunny to mostly sunny skies. temperature is not too much different from where we were today. with more sunshine, it will feel nicer. friday, basically nonstop sunshine. temperatures will be well into the 50's. clouds are coming in at us from both directions on saturday. you probably know that is . as you get into sunday, things deteriorate. as they can up and showers arrive worried as cold air arrives sunday afternoon and evening into monday morning, we could see some of that rain changing over into snow showers, especially in the mountain. there is the big rain or snow chance. temperatures for tonight fairly mild because those clouds are taking their time to clear. some local areas of fodder forming.

josh: thanks to a new york trash josh: thanks to a new york trash crew, a woman now has her accidentally threw her rings in the trash after cooking dinner, and by the time she realized what she'd done, the garbage truck had already come. she chased after the truck, and they dumped the trash off to the side, then, they started searching through piles of trash. >> her husband, he opened the bag and started going through all his garbage, and as he looked through it, i doubled -- double checked it. and as i was double checking it i opened it, voila, the ring.

jennifer: after digging through trash for hours, colleen now has her rings. and she says she plans to keep in touch with the workers who helped her find them. parents hold onto your hearts. tonight a nine-year-old boy is credited with saving his baby brother. the 11-month-old was on a changing table when his mom turned her back for just a moment. you can see the baby starting to roll over and fall off when all of sudden his big brother jumps into action and catches him, right before the baby hit the

returning sunshine. a look at which days will be the best as we head toward the weekend. tom: and one person is in custody at this hour, for a shooting that injured two people near a school. >> no one covers new hampshire like we do. now, wmur news 9 at 6:00. tom: breaking developments tonight about a potential strike by school bus drivers in new hampshire. the deadline for negotiations has been pushed back. good evening. i'm tom griffith. jennifer: im districts like nashua had been prepared to cancel school tomorrow if buses weren't running. tom: wmur's cherise leclerc is live in derry where school officials are still closely monitoring the situation. reporter: districts that could have potentially been impacted by the strike like derry, say they are relieved after they learned early this evening that buses would run as normal at least through next tuesday.

the private bus company first student, authorized a strike that could have happened as early as thursday morning. they say they're unhappy with the company's latest contract offer. first student says drivers outside of belmont are working under a current contract and are prohibited from striking, but, other first student school bus drivers have indicated that if belmont goes on strike, they may honor it and not operate their buses either. that could affect as many as 33 districts across new hampshire. nelson says they'll use the thanksgiving break to finalize plans should a strike happen the following week. >> we are very concerned about that, which is why we have really tried to look at what measures we could put in place to assist families, and really help them. and not make it more-based russell situation. -- more of a stressful situation. reporter: again, buses will run
