be mac the case that led to these proceedings was the joseph sledge case, a man who spent ready seven years in prison for eight double murder that he didn't commit. it was one of the largest coal ash builds in us history. nearly two years ago 39 tons of toxic materials building to the dan river near eden sparking an environmental disaster. since that time, duke energy has worked to clean up the river. jonathan rodriguez toured the site today and has more on what the company is doing to make sure it doesn't happen again. >> february 20 second, eight pipe burst spilling nearly 39 tons of cool ash into the river. duke is racing against the clock. it is this bill that open north carolina's eyes to coal ash and

clean it up. >> we've moved 60,000 tons of coal ash and expect to exponentially increase that with our real system. be mac duke energy is at full speed at taking out 30,000 tons of ash, per month, loading it into train cars. each train car is lined with a thicker material to make sure no ash blows out while it is being hauled off. >> and it separated from moisture. >> it's not as simple as going out and digging up coal ash. there's a lot of work that has to be done to perform this safely and efficiently. >> once they make room the other half will be stored on- site and sealed. >> we will ensure that our activities don't adversely impact groundwater in the area. >> they say they are waiting on permits from the state before they can start excavating. >> what you will see in 2016 significant progress made
