involved a member of the sorority. that they had concerns about recent activities that had taken place during the most recent rush and bid period. according to the duke website, there are 18 sororities at the university. they had just completed their spring rush. in the wake of the incident, the university says it is suspending all sorority related activities until further notice. students say they're disappointed but not really surprised that this would happen. >> it's really scary. i mean, i don't know as a sorority member myself, i get nervous for the new members or nervous for anyone that's ever in those positions. >> it's sad because you know, people come on to campus and then they think that the best way to make friends is to go there's this societal constraints on how like you're not cool if you don't drink. >> reporter: now in a statement, the university wrote in part "the student affairs

chapter presidents and the pan helen nick executive board. each chapter will be asked to review its activities on alcohol use." that meeting was scheduled for 5:00 it was closed to the media. the university i want to mention too is not identifying the student involved in this or the sorority. we're going to have more on what students have to say about all this coming up at 7:00. live at duke, i'm amy cutler, nbc charlotte. also breaking news in garner a pedestrian killed on the ramp from 40 eastbound to u.s. 70. this is a live look from the scene right now. police tell us this area could be backed up for a while. again, we know one person a pedestrian is dead after an accident there. garner police are on scene and it happened just before 5:00. we'll have more you tapes as they come in. the aspcs is calling it one of the biggest rescue operations in its history. nearly 600 animals, cats, dogs,

rescued from a so-called safe shelter in hope county. our nate rogers has been on the scene all day and -- scene all day and joins us with more. nate? >> reporter: well, authorities began investigating the haven after numerous complaints of sick animals being adopted from the shelter here. now once authorities got on the scene around 7:30 this morning, they say they found many animals living in deplorable conditions. >> people tried to tell the state many, many times. >> reporter: but today, there's action. more than 600 animals found in need of medical careful some with open wounds and others with severe respiratory disease. >> some of that is living environments. some of the -- some of the buildings here are just really insufficient, very unsanitary environments for the animals. >> reporter: property owners steven and linda spear now face multiple counts of animal cruelty and take a look another the pictures taken today by the

you can see the dogs and cats housed in filthy kennels and cages and also in this video the group shows what they say is a dog with a broken leg which this malnourished horse. it's been in operation for the last 20 years. now officials tell us over the last ten years, the property owners have operated without a license. the animal shelter was also deemed inadequate by the department of agriculture during past inspections and received several complaints throughout the years. what took authorities so long to intervene? >> well, what they would do is these complaints would of course go through the state. the state would then do their investigation. when it came to the animal cruelty, or neglect, that's whenever we drafted a search warrant and went out to the property. >> reporter: nearly 140 responders will assess the 120- acre property over the next two to throe days. tomorrow they'll begin removing all of the animals. you're glad the panels are finally getting some -- animals are finally getting some care. >> i'm glad i don't have to

toying that asr -- saying they are committed so seeing this project through and of course folks around here are really concerned about why they weren't approached sooner about the project. >> i don't care if it's a railroad hub or a subdivision or a six flags over selma. i mean we're not interested in selling the land. >> reporter: trent has been heading the fight against the csx transportation hub project. not all together, just in its current prosized site on his hasn't. >> my dad grew up here, he farmed this land. my grandma grew up here and he farmed this land and i mean you know it meant so much to have this business. >> reporter: according to the north carolina department of transportation, the state has been in talks with csx about a hub in the eastern region since march of 2014. yet lasseter says committee 4 other -- he and 34 other property owners didn't find out until about four weeks ago.

and sad down and said look here's the map of if project. this is kind of a big project. your land is = for this. we would have told them a long ago it wasn't for sale. >> reporter: if economic developer chris johnson says that's not the way businesses usually is done. but that's the way csx went about it. >> they were wanting to wait until after the project was announced so they could be up front and honest with the property owners and say look, there's a project looking at the area we'd like to discuss this with you. as far as the possibility of purchasing your land. >> reporter: the late land talks caused commissioners and even the governor to rethink the project. which still could move forward somewhere in the region. >> it is a great project for not only johnston county but eastern north carolina but only with willing landowners that can work with the csd and the tate to find a suitable location for the project. >> reporter: now both johnson and lasseter tell me there are some property owners willing to work with csx and johnson is

along the csx rail line who are willing to sell to contact his office because they are still trying to find a viable site for this project to breathe some life into this area. live in johnston county, carly griffith, wn cn news now. to help with low performing schools? >> as our political reporter bow minnick reports -- beau minnick reports, there's some opposition. >> we're try to do our own system, our own district, where we have an ability to make it fit for north carolina. >> the question these lawmakers are asking is does it fit in north carolina? a plan that would take five of the state's lowest performing elementary schools and group them into one district what's called an achievement district. the state would select a charter school operator to come in and try to turn the school around. >> we talk about low performance schools and we talk about where we want to go in education, we have to think about what we can do right now.

>> reporter: if approved the plan would be a pilot program in north carolina starting in the 2017 and 2018 school year. a school selected would have to be in the lowest 5% of all schools. the school would also have to be not meeting or exceeding recent growth expectations. if approved, it would enter into a five year contract with the achievement school district. >> and we're talking about just five schools to start. and we're -- we're trying to make sure our selection process for those schools is one that will work. >> reporter: some lawmakers question whether the state should focus on efforts already understood way. >> we've got to step it up. that's why i sat in here, perhaps the right answer is let's do more of what we're already doing so we get more kids more quickly. >> reporter: we also asked the parents their take. >> i would prefer that they just work on improving the scores of all the schools as they are. >> reporter: lawmakers are planning to hold two more meetings on this topic. one in february and one in march. they're looking to hear from the public and also from states

killer might target them next. mclean was 22 when he was shot to death last march near this intersection. while he was driving down holloway street. his two passengers were also shot but survived. >> we won't dissolve all of the homicides. >> reporter: i wanted to speak with their interim chief about killers roaming our streets. >> all of our homicide cases until they're solve. they -- solved. they remain active. >> reporter: sheldon per tins talked instead and hysteresessed there are many reasons why -- he stressed there are many reasons why some cases go unsolved. lack of witness cooperation and lack of physical evidence. but that doesn't mean they quit digging. >> we never have a homicide case that goes inactive. >> reporter: but i pressed dpd about whether eight homicide investigators is enough. >> we are like everybody else. we can always use more resources. >> reporter: mclean's family told me they just want closure to a promising life cut short. >> he crossed my mind every day. >> and that was mario boone reporting.

-- yesterday. right? today we barely made it into the 50s and most of us sit in the 40s right now. and if you think it's cooler you're right. it's 16 degrees cooler right now in rocky mount. compared to 24 hours ago. ten degrees cooler in roxboro and ten in sanford and ten degrees cooler in harnett county than where we were last night at 6:00. so as you can imagine it's also going to be colder overnight and for tomorrow morning. so as we go hour by hour not going to do anything about the clouds, they're sticking around and really just small chances i mean maybe a sprinkle or two on your windshield in a few areas. but then as we get toward the early morning hours in the morning commute, we're going to up that chance just bit. but -- a bit. but most of the rain comes tomorrow late morning and afternoon. and as far as our temperatures will continue to fall through the 40s tonight. and you're out the door tomorrow morning not with 40s like we had this morning but we've got mid 30s. there's the area of low pressure. there's our cold front. now stationary. so this area of low pressure is

right along the front almost like a train on train tracks. don't worry though, this area of high pressure will be here starting friday and give us a great weekend. not going to call tomorrow great though. let's start it off at 6:00 a.m. so it's already thursday. so we're almost through the workweek. by 9:00 a.m. we're going to start to see some showers move in from the southwest and this is a rain only event. no concerns about anything else. as we get toward lunchtime you can see a lot more of us getting some rain and the better weather with this -- wetter weather with this system is going to be further south like wise drier farther west and north you go. here we are mid-afternoon and could have a few scattered school. and for a few of us mainly i-95 corridor and sandhills a few commute. by late thursday night most of the rain the starting to pull out of here. we've got clear skies as we head to work and school friday morning. and we've got lots of sunshine this weekend. we don't have lots of sunshine scattered showers, remember those rain chances that used to be small 24, 48 hours ago have gone up.
