where we're not starting off nearly as nice as we were this weekend. the clouds have moved in and some of you are waking up to an isolated shower. a little bit of fog as you wake up this morning. so plan accordingly your morning commute could take a bit longer. 52 in raleigh i was almost going to say durham but that temperature up-2008ing to 53. 52 in goldsboro and clayton, good morning you're at 50. let's get straight to your fast forecast this morning. areas of fog for the morning drive, 53, 54 at lunchtime today we'll stay at 54 through about 3:00 ask then start to cool off. best chance for rain is going to be for the evening drive home. let's go ahead and switch gears we'll check be in with traffic. i-40 and page road if you're heading in this direction it's a clear stretch just a few cars

along at a pretty good speed now, just in we now have arch accident on u.s. 64 between i-540 and smithfield road. we'll continue to get some details on that including on what direction on highway 64 this is but right now again an accident highway 64. today the man that durham police say shot a toddler in a in court. >> officer say a 26-year old fired shots into an at home day care last week a bullet hit a little boy right in the leg. >> emma wright joins live interest the courthouse with an update on this story. >> police say the shooting wasn't random but say the little boy wasn't the intended target. neighbors say they're upset someone knowingly shot up a

>> police say 26-year old laney fired off several rounds into an at home day care. >> it was like they just shot in broad daylight and didn't even care. >> listen say one of the bullets a friend of the owner says she tried to protect the kids. >> she thought it was fire crackers but when she saw the bullets and debris she grabbed the kids and hit the floor with the babies. >> police say the toddler has recovered and is out of the hospital of the owner didn't want to talk on camera but says she shut her business down indefinitely. durham pd says laney a convicted felon is facing a slew of charges including assault with a deadly weapon. neighbors say it makes them mad someone was to reckless >> i couldn't tell who it was but you could tell that it was a young -- it was a young youth and for them not to have any type of common courtesy or respect for human life, that's just tragedy. you know, you

and open fire and just pull off like it's nothing. >> miss say laney is in the durham county jail on $1.5 million bond and is expected in court later today. today a michigan man accused of killing 6 people is expected in court. investigators say this man dalton choose victims at random saturday night while he was working as an uber driver. he shot people outside of an apartment complex, a car dealership and a restaurant during the course of 7 hours. six people were killed and two others including a 14-year old girl seriously injured. he is set to be arraigned on murder charges today. the 45-year old uber driver who is married with two children has no criminal record. investigators have no motive. the fate of a man convicted of killing a woman in raleigh rests in the jury's hands now. testimony resumes this honoring

smith after being convicted of killing huggins-jones in 2013 in her north hills apartment. smith's defense is now trying to save him from the death penalty. the jury has heard from his half sister who cried while recounting how his father beat and abused him. >> in any way possible, physically, leaping on him, punching him, hitting him with things, throwing him. >> the prosecution brought in smith's former parole officer and two jail officers who say smith had multiple run ins with them while he was incarcerated. some tense moments after police evacuated a neighborhood. we were sent this video and a stand off began when an officer reported hearing a gunshot from a home. the incident lasted three hours. no one was injured and police do not expect to charge any -- file any charges in this case. a 39-year old man is dead after troopers say he crashed

i-40. it mapped around 3 a.m. yesterday morning in wake county. troopers say that he was driving backwards for some reason in and collide western district a silver chevy. he died and two people in the chevy suffered minor injuries. investigators believe alcohol was a factor in this crash. last check two bicyclists it happened saturday after troopers say a car hit four of the cyclists, charges pending against the driver. the state nccap. republican lawmakers redrew the districts recently to comply with the federal court ruling it comes after a three judge panel threw out the original map saying race played a factor in the drawings. now, voters will go to the polls months. the march 15th primary still set for all elections except for congress. that primary will happen on june 7th.

hear cases for the first time since the death of associate justice scalia. the court right now has 8 members, president obama plans to nominate a replacement despite objections from republicans. they say that job should fall to his successor. today a panel at duke university will look at the impact of justice scalia's death on law and politics. the event is free, open to the public. it runs from 4:00 today until 5 on duke's campus. governor pat mccrory will be back in north carolina today after spending the weekend in washington. he was there for the national governor's association meeting. last night president obama hosted his final dinner for the group and as always he got a few laughs during his speech. >> so this is my final governor's dinner, at least my final one as president. i'm just kidding. that was a joke, people.

he killed huggins-jones in a raleigh apartment in 2013. his defense is now trying to save him from the death penalty. today bill cosby's wife is said to give her deposition in a defamation lawsuit against the comedian. a group of women claimed cosby sexually assaulted them. the attorneys requested a delay in the deposition but late last night a judge denied the move. they have been married for more than 50 years. she worked for her husband as a business manager for years. private conversations between a married couple protected by law but business conversations not. the search is on for answers after investigators found this man shot to death. johnson was just released from prison. he died at the hospital. the shooting happened around 12:30 yesterday morning in the area near charmain street. if you have any information on what happened please call

today a wake forest woman is expected in court after authorities say she assaulted a police officer and a k-9. she's charged with assault with deadly weapon with intent to kill. officers responded to a domestic dispute yesterday morning. police say she then assaulted one of the officers when put in the patrol car. police say she then banged on a kennel and screamed at the dog. tomorrow raleigh's police union will discuss whether or not to boycott appear an upcoming beyonce concert in raleigh. this comes after the singer's controversial super bowl performance where she alluded to the black panther unit. many officers believe that was disrespectful to the police profession. several departments urging the police officers not to volunteer at her shows. we spoke to some locals and here's what they had to say. >> surprised by it. i think it's not going to hurt her in any bit it's probably going to

it's now the strongest storm on record: devastation there. back here at home now this weekend we had a pretty nice weather i'd say. >> yeah, we sure did. the cloudy skies have moved in and now we're tracking the chance for rain. 52 degrees right now not raining at the airport but some of you have seen some rain either yesterday evening or throughout the overnight hours so conditions a bit damp for you. here's our satellite radar composite the big picture not showing a lot of rain right now but i want to bring you into a closer look at home. we've seen a shower move through mainly through our northern counties. a few showers out towards goldsboro this morning but for the most part we're going to stay dry over the coming hours. the visibility is going to play a big factor in your morning commute. we're looking at visibility at a mile and a half

a mile in sanford, less than a mile in dunn through portions of johnston county and then look at portions of wayne county visibility in goldsboro at a so take your time if you encounter some of the foggy conditions make sure you're slowing down. now, as far as the temperatures concerned we're at 52 in raleigh through durham and henderson, 51 right now in south hill and roxboro. sanford you're in the upper 40s but around the sand hills we're looking at temperatures in the mid-50s this morning. now, temperatures going to actually just fluctuate a few degrees throughout the day. so you're thought going to see a significant warm up, you're not going to see a significant cool down. 53 at 8 a.m. through 10 a.m. noon through 2:00 be we should be close to 54 degrees then those temperatures will start to drop. 53 at 4:00, 50 by the evening drive home at 6. so you'll notice the best chance for rain will actually develop after about 2:00 this afternoon. so umbrellas necessary for the

cloudy skies this morning through lunchtime and then the showers start to develop down around the sand hills first. overall the best rain chances actually going to develop overnight tonight which for the most part is good news, however, some of this rain still holding on for your tuesday morning commute and at that point in time we could be talking about water ponding on the roadways. as we head towards tomorrow at lunchtime most of the rain tapering off. so for today 54 in raleigh, 53 in durham, 57 in fayetteville, fast forward to tonight rain likely overnight low right around 42 degrees. and here's a look at the coming days 50 tomorrow again the best chance of rain in the morning as we head towards wednesday, more rain maybe even a few isolated storms winds going to pick up wednesday into thursday, but look at that thursday and friday the sun is back in our forecast and right now i'm expecting the

a family of refugees who fled from isis in iraq have been reunited with their cat. a a woman and her five kids walked for three days carrying their cat with them. the cat survived even in a rubber boat but ran away somewhere along the journey. three months later people found the cat and started a social media campaign to get the cat back with its family and they have been reunited. amc theaters face a class action lawsuit. the lawsuit was filed in san francisco and claims that amc does not provide appropriate is and functioning devices it advertises to have available to blind customers. the devices often have the low battery and play the wrong audio descriptions even the equipment offered is for deaf customers. netflix knows they only have
