meet the death penalty standard. >> smith was portrayed by the defense as a man who only deserves life in prison for the murder of melissa huggins jones. >> what happened to melissa huggins jones was horrible, tragic, and heartbreaking. and it was completely senseless. and travion will be punished for the rest of his life because of what happened. but his history before what happened does not show that he's incapable of redemption. >> but the prosecution says there's no redemption for smith, only the ultimate punishment. >> how much hatred does it take to get there. not one blow. but 18 blows. at close range. they were on top of her. they didn't shoot her.

her, in her own bed. and stabbed her in her face. and tore her nose off. how does that not call for it? how does that not call for the death penalty? >> but the jury did not agree. after the verdict was rendered, the parents of melissa were able to address travion smith directly in court through victim impact statements. very compelling stuff. >> absolutely. we did hear from several family members before the sentencing recommendation, including melissa's mother, don wallace, she actually spoke directly to her daughter's killer at one point during her statement. >> all lives matter to someone. including yours travion. your life matters to your family and friends.

the other two have been released. wncn's david hurst spoke with one of the riders. >> four people on bikes just got hit by a car. >> it's a route joel lawrence and his friends travel all the time. >> we were going up the hill and in an instant, everything happened. >> he spoke to us on skype from his home while he's nursing injuries after a car plowed into the back of him and three of his friends. two of his friends are in icu in critical condition. all four were wearing safety vests and they're experienced riders traveling a bike- friendly route. >> all the roads are quiet, hardly any traffic. it's hard to believe this happened. >> the driver's daughter told wncn her mom was coming up over the hill and didn't see the cyclist. she claims a car was passing in the other direction and she

people. charlotte city council will take a vote on controversial changes to a nondiscrimination ordinance the proposed changes would allow someone to choose whether or not they want to use a men's or womens restroom based on gender identity. it protects the lgbt community. and governor pat mccrory is vowing legislative action if the ordinance passes citing public safety concerns. raleigh police are looking for a man in connection to break-ins in a north raleigh neighborhood. they happened back on february 13th in the 400 block. police say multiple cars were broken into and several items were stolen. at one point, this man was captured on surveillance video breaking into a car inside a garage. if you recognize this man and have any information, call crime stoppers. a fayetteville doctor is accused tonight of inappropriately touching a patient. 74-year-old paul carter faces sexual battery charges. the incident happened last

the victim was receiving a consultation for weight loss surgery and carter violated her. the uber driver charged with killing six people in a shooting rampage made his first court appearance today. michigan prosecutors say they think they know what happened but they're trying to figure out why. jason dalton faces six counts of murder. the married father of two went on a shooting spree while continuing to pick up passengers. >> this was not just a momentary lapse. there was nothing that provoked this. there is videotapes of these instances. he walked up on these people and shot them. in all, eight people were shot in three separate locations. tonight two remain in the hospital. dalton had no prior criminal record. and passed uber's background check process. a big political fight brewing now in north carolina. next we break down the latest developments in the redistricting battle. find out why some voters say

on air, online, wherever you are, this is wncn news at 7:00. it's a political fight that has some voters saying enough is enough. >> it comes after state lawmakers create new boundaries for congressional districts. but tonight critics say the new map isn't good enough. michael highland is live in raleigh to break down the latest developments. >> certainly no agreement between democratics and republicans about whether this map is the right way to go. but a couple words you do hear on both sides of the aisle about this process, chaos and confusion. voters are saying something has to change. is it voters picking their politicians ? or politicians picking their voters ? >> this apartheid redistricting. >> the north carolina naacp is frustrated with the new maps. state republicans redrew the boundaries after a federal court found two districts were gerrymandered along racial

>> an unconstitutional way of stacking and packing black voters and then you undermine the power of the black vote. >> now they want the judges to throw out the new map and for the judges to create one themselves. republicans say race played no part in drawing the map. >> it's clear the ncaacp wants to reenter correct into the maps for the purpose of electing democratics and no other purpose. >> i think it should be totally independent. >> a new pole found a majority of people regardless of party want a nonpartisan process for redistricting. but lawmakers who agreed tried and failed to make that happen. >> people don't want to give up the power over redistricting and the unfair advantage that comes from it. >> redistricting has always had politics in it.

scenarios it will have politics involved. but we have followed the law. the state has all ready decided to hold two primaries this year. one next month for everything except the congressional races. that will be held in june. a lawyer says he's asking the court considering this case to issue an expedited ruling to get clarity about this map as quickly as possible so voters will know who they're picking to represent them in washington. michael highland, wncn news now. in regards to next months election, north carolina senator tom tillis is throwing support behind senator marco rubio. senator tillis says rubio has the unique capability of drawing people into the party which is important in a swing state like north carolina. other north carolina politicians who endorsed rubio include skip and representative john bell. rubio is battling it out with ted cruz. >> donald trump is a clear

hampshire and south carolina. the realestate mogul has a good chance to make it three in a caucuses. the fight between rubio and cruz getting more personal by the day. >> everyday something comes out of the cruz campaign that's deceptive and untrue. >> even in florida, his home state, he's poling in third place. >> the big test will come march 1st when 14 states hold their primaries. poles show trump leading in ten of those states. and the north carolina primary takes place march 15th. and a new pole shows promising results for the gop front runner, donald trump has 28% support. compared to ted cruz at 19%. and marco rubio with 16%. on the democratic side, hillary clinton leads bernie sanders by 10 points. when you put the front runners head-to-head, clinton beats trump, 27 to 41%.

>> i have percentages. they're higher and involving rain and not politics. it's been a soggy day. showers not severe. but light to moderate. causing some problems on area roads getting home tonight. these showers will stick around over night through tuesday and wednesday. although we don't expect severe storms to pop up until about wednesday. now after 60s and 70s this weekend. today 40s and 50s and temperatures all over the place. it's 48 in raleigh. a little warmer in fayetteville, 53. warmer north in roanoke rapids. warmer in asheville where it's 52. they're warmer than we are. they have low 50s along the coast as well. the deal tonight is temperatures won't really move that much as we go hour by hour, you can see we'll be stuck about 47 at 8:00, 46 at 10:00, we'll hold for a few hours dropping to 44 tomorrow morning. but from now through tomorrow morning, on and off scattered

and as i said earlier, everything in the next couple days is rain and not the other stuff that we've all ready had this month. so cold front moved through. that's why our temperatures have dropped. now it's going to kind of hang out next to us for the next few days. and that will keep our atmosphere unstable. there's also going to be one or two areas of low pressure that ride along this cold front. and that's what keeps rain in the forecast through wednesday. let's talk about the storms. here's what the map will look like tonight at midnight. we might get a break for a couple hours, more wet weather tonight, more wet weather tomorrow morning but some of us will have dry time. the showers will be on and off throughout the day tomorrow. you can see rain about lunch time passing through. then the afternoon we'll get dry time. the clouds staying with us and staying thick. then tomorrow night, another batch of showers moves through. a lot more of it back to the west. then wednesday morning we'll again have a wet start. but it's later in the day

approaches. shortly after lunch time that we will see the stronger storms. so that batch coming through just after lunch time lasting through the afternoon. could be a second line as the actual front comes through closer to 7:00 p.m. then by late wednesday night, the rain moves out. and the cold front's through. and we dry out thursday into friday. but wednesday, something that hasn't happened in a while here, a slight risk of severe storms. and that could include damaging wind and even an isolated tornado. not too often do we go up to that second level. we're watching a lot closer as we head into wednesday's weather. tomorrow, still cloudy, still wet, not rain all day but on and throughout the entire day. 50 in raleigh. 49 in durham. 54 in fayetteville. from the high of 50 tomorrow, it's warming up and getting more unstable wednesday. we have a threat of severe weather. then the front comes through. we cool back down to 54.

and when the changes take tonight in sports, unc and nc state will meet for the second time this season when the tar heels travel to raleigh on wednesday. unc won the first contest. 67 to 55. the tar heels will be looking to keep a hold on first place. for the wolf pack, a win over the tar heels would brighten up a disappointing season. >> i think our guys have great confidence in themselves. our team has played really well most of the time. we don't have a lot of wins to show for it. we've done a good job at times. these guys got to get over the hump with some big games. >> state seems to play well at home with the tar heels. will we see a rushing of the court? tip off is set for 8:00. >> governor pat mccrory wore a
