twice, landing on a man. if it plodded into a tree and hit a bus stop before killing the 15-year-old unidentified man. happened along flatbush avenue, two this had minor injuries including a 3-year-old in the car. police are still investigating the cause of the crash. demanded a 12 pedestrian killed by car in the five burroughs since oct. 31st. ben: three men charged in the attempted robbery of a group of plainclothes nypd detective, officers investing a robbery in brooklyn when the three suspect approached them. atwater was shot after police say he pulled a bb gun on them. looks like a real gun. he is hospitalized in stable condition. the other two suspects are 15, and 16 years old. all week are held on separate charges including robbery. heather: the police commissioner offering a contentious solution to the homeless crisis. at a press conference yesterday

a brooklyn mom, the city has a new regulation. kids in preschool have to get flu shots by december 31st. that is the rule. a group of moms of kids in the public pregame program are suing the city. juliet: they're fighting the mandate of public students under 5 have to get this vaccine, linda schmidt has more on the case. >> the flu representing huge threat to children under 5 years of age. >> reporter: pediatrician says the flu can be deadly for preschoolers. >> highest death rate of any age group is in the pediatric population under 5 years of age. >> reporter: he is a former supporter of flu vaccine between the ages of 6 months and 5 years, michael bloomberg, the city health department has a rule mandating flu vaccines if preschoolers attend school programs. five mothers are fighting that rule and don't want their

children to receive a flu vaccine, they are suing the city claiming their rule is illegal because the city health department passed it, not state lawmakers in albany. >> it is a personal choice. every parent has their own reason they don't want a flu shot and until an elected representative tells the mother was a should be able to make that personal choice. >> reporter: the parents' support all of the other required vaccinations except the flu vaccine. in part because the mandate does not apply to everyone. >> there are 11,000 licensed -- the only price for 2,000 of them. their are also 20,000 legally exempt day care providers in new york city. this flu dictate doesn't apply to them. >> reporter: the city released this statement, quote, we are confident that the board of health has the authority to require flu vaccinations which protect children and the broader public from serious illness.
