in a stand off and minutes ago we learned a little more about what is happening. >> ryan: listening to the live press conference and started at the coral garden can doughs after 11:00 -- condos, 11:00 p.m. and live to jackie orozco now, there asking questions, and, one thing that stood out, they know who the man is and swat has been involved but they are having a hard time getting him out of the apartment building? >> reporter: that's right. ryan. officers are telling me that it could end whenever the suspect wants it to end. and, of course, officers want it to end peacefully. as of now, luckily no one has been hurt and though we heard a lot of gun exchange. let's look at videos, you can see a lot of officers here. now, melbourne police told us everything happened around 11:14 last night. from a domestic violence call. now, they couldn't go into detail exactly what was going on, but, the man barricaded himself and officers will not release his name, just yet and

said that he is the one who shot first, perhaps a few shots inside of the apartment and a few shots in the parking lot. then it was around 6 o'clock this morning, and there was a lot of gunfire exchanged between the suspect and police officers. and, of course, earlier this morning we were told and saw a lot of refts sidents, 30 of them evacuate because they didn't want anyone hurt and the red cross is trying to keep everyone comfortable now because they are not allowed to go back inside. no officers were hurt and we asked if the suspect was hit at any point and right now, officers say they do not know his condition. we also heard explosions. now, whether it was gas explosions, trying to get the s.w.a.t. team to get him out and they said it was part of their swat techniques and they couldn't go into detail about that. but let's hear more from the melbourne police. >> as far as the tactics of our s.w.a.t. team, i cannot say for

doing. but, again, our ultimate goal is to make sure that no one gets injured and really that is in the hands of this individual, right now. >> reporter: yeah. and some neighbors we talked to were scared, thinking they were getting hurt or were going to get hurt and they were evacuated and a lot are not allowed to come back. it is still an active scene and everything happened since 11:00 p.m. and, of course we'll stay on top of the developing story. now reporting live in brevard county, jackie orozco, fox 35 news. >> thanks for the update and also developing, volusia county, the man accused of stabbing a young couple inside of their ormond beach home is set to appear before a judge for the first time this afternoon. >> amy: police released the sketch after they interviewed the victim following the attack on december 27th. philips' own father saw the sketch and identified his son.

details. and, not a lot has happened. waiting for the man inside? >> reporter: yes, but, s.w.a.t. team is here and the negotiation team is here as well and are trying to get him out peacefully. a lot of officers, an active scene and you can't see the apartment. it happened far back and we have heard dozens of gun shots go off all morning long and let's hear the gunfire. the stand-off started 11:00 p.m. last night as a domestic violence call and police say when they arrived at the coral garden apartments, the armed man was the only one inside and refused to come out. residents were forced to evacuate and 1:00 a.m. the first shots were fired, inside of the apartment and police say that that man started shooting at them. and this is what melbourne police told us. >> the subject began shooting out the window, towards the

-- in southeast orange county yesterday. screws crews secured the gas line and took him to the hospital, where he has serious burns. >> amy: a mom accused of killing her daughter rejected a plea deal. yesterday she had the option to plead guilty and spend 30 years in prison and she says she wants to go to prison for the rest of her life and investigators say she said she killed her daughter inside their home in 2014 and waited several hours to make sure her daughter was dead before she tried to kill herself and the judge ordered another mental evaluation and the plea deal is off the table now. >> ryan: the state improved the scoring system for the fsa, the board of education adopting scores presented by commissioner, pam stewart. a passing score being a 3 and critics claim it will make it harder to pass the fsa and the board approved a formula for grading schools to make it

grades on a through f scales and "star wars" and chick-fil-a are taking over the business headlines. >> amy: for more to lu in the studio. >> luanne: chipotle has been under a lot of scrutiny since the e. coli outbreak and now federal authorities are launching their own investigation into the company. hundreds of customers and employees have come forward claiming that food made them sick. the fda and the justice department are only investigating one specific incident that happened at a california store back in august. but, the criminal investigation is just the beginning for that company. chipotle's stock plummeted 42% over the last three months. after outbreaks of the norovirus, e. coli, and salmonella across nearly a dozen different states. well, this probably won't surprise anyone. but, "star wars," the force awakens, has reached yet another milestone. the film is now the highest
