i'm ryan elijah. i'm gina benitez thanks for waking up with us! here are the stories we are working on this morning. first-- winter garden police looking for the driver... who ran over a three-year- old boy with his car... and just drove off. we have the latest details on the investigation. plus-- brooks! and today--florida lawmakers will head back into session. coming up... we'll have a breakdown of the bills that will be discussed.

morning-- police in orange county now on the hunt for the driver in a hit and run crash. officers say the suspect hit a 3- year-old boy... and then just drove off. this happened on east cypress street winter garden--and the car was abandoned a few blocks away. fox 35's keith landry has the latest. president obama

state of the union address tonight. the president is expected to paint an optimistic view for 20-16. this is based in part on 2015- which saw u-s auto sales hit an all-time record of 17-point-4 million. last year saw the creation of 2-point-7 million new jobs, second best for job creation since 1999. also on the president's check list include renewed relations with cuba... ....an iran nuclear deal, and initiatives on climate change and trade. the state of the union starts at 9 pm, time. that is followed by fox 35 news at 10-- once the address is over. and we will have analysis-- of the big speech-- during the newscast. the new florida legislative session begins this morning in tallahassee. governor rick scott will open the session with his annual "state of the state" speech. meanwhile-- lawmakers are talking everything from the budget.. to refugees. lawmakers start with a surplus this year-- as they prepare to negotiate a budget

first. governor scott has proposed a 79-point- three billion dollar spending plan. among his proposals-- per- student funding in public schools.. boost economic- development incentives and tax cuts. lawmakers may also work on making changes to florida's testing system. some lawmakers want schools to use tests other than that florida standards assessments. another program up for discussion-- is if lawmakers will continue giving teachers bonuses.. baswed on their a- c-t or s-a-t college-admission test scores. and a bill filed block any state and letting refugees are considered "restricted persons". people as any refugee or immigrant who quote, "originates from.. or is close to.. any location where invaders are known to originate or train for violent acts of war." there are several other bills under consideration this session. coming up in the next hour-- developing in jacksonville-- new charges are being considered after authorities

toddler lonzie barton. the 21-month-old vanished last summer. lonzie's mother, lonna barton and her boyfriend ruben ebron have already been charged with neglect. deputies say ebron actually led investigators to the remains. the remains were found in a wooded area off of u-s 1... but authorities aren't saying the condition of the body or how barton may have died. the discovery comes on the same day that ebron's trial was set to start... but he waived the speedy trial. officials have not confirmed or denied if a plea deal is in the works. in marion county-- deputies need your help finding a missing

the sheriff's office says -- around 9-30 yesterday morning -- one of their deputies spotted 17-year-old margaret lehman walking away from belleview high school. the deputy picked her up and took her back to school, but she never returned home later that day. she was last seen wearing a purple and blue jacket--- blue jeans and a panda knit hat. if you spot her call the marion county sheriff's office. orange county deputies say they've arrested a person... accused of kidnaing a woman before a trial. q%5 says she was ambushed by two suspects before she was set to testify. fox 35's valerie boey has more. developing at this hour-- authorities are investigating if the florida native killed in italy on saturday... hour-- authorities are

florida native killed in italy on saturday... had a stalker. ashley olsen was found inside her florence apartment... with bruises and scratches on her neck. the 35-year-old originally from "summer haven" posted two pictures taken of her on instagram before she died... with captions that read "stalker alert". right now it's unclear who took those photos. we're getting an up-close look at the shootout that led to el chapo's arrest last friday. this video follows the 17 mexican marines who captured the drug lord at his safe- house... as the team closes-in while grenades and guns go off all around them. five of el chapo's men were killed in this raid... another six were arrested. the armed militia that's taken over a federal facility in oregon... now claims to have discovered documents proving the government discriminated against ranchers in the area.

you decide 2016-- the line-up has been announced for the republican presidential debate this thursday on tusiness network". and a candidate who's participated in every prime-time debate so far... won't even attend... after learning he didn't qualify this time around. kentucky senator rand paul issued a statement shortly after the line-up was announced saying he will quote: "not let the media decide the tiers of this race and will instead take his message directly to the voters of newiowa." with paul gone... the prime-time debate will now only feature seven candidates... including donald trump... ted cruz... marco rubio... and jeb bush. the debate begins at

indialantic police are searching for a burglary suspect...after police say a homeowner shot at him. that story kicks off our morning rush. police are releasing his picture of the suspect and a car they believe is the getaway vehicle. they say the homeowner heard a noise in his garage... and found a man stealing something from his garbage. the homeowner fired one round at the suspect and he took off. it is unknown if the suspect was hit by the bullet. anyone with information is askedto call crimeline at 800-423- tips. a judge is expected to decide whether a teen accused of running down an orlando police officer should be

officer william anderson and his wife were in court yesterday asking the judge to keep edward kelty behind bars. kelty is accused of running over anderson after the officer stopped the car kelty was in. kelty's attorney argued that his client did not try to run over officer anderson, instead... he was actually steering away when anderson fell. a convicted sex offender charged with kidnapping and assaulting three women -- killing one of them... learns his fate in court. a judge sentenced john lytus to 45 years in prison. lytus pleaded guilty to second degree murder, aggravated assault and kidnapping. police say lytus picked up three prostitutes in daytona beach on separate occasions in september of last year. one of the women was found dead in deland three days after she vanished. developing now-- peta is speaking out out the "ringling brother's barnum and bailey"circus retiring their elephants early. they don't believe the conservation center in polk city is the best place for the animals.

killed outside of his business in sanford. the family of joshua hur is holding the vigil at 7 o'clock at kim's food store. hur was shot and killed outside of the store back on december 23rd. police have yet to identify a suspect in the case. turning now to sports-- college football crowned its champion just after mid-night... after the crimson tide outlasted clemson. alabama got off to a slow start... the tide only managed to score a touchdown in each quarter until the fourth... when they piled up 24-points. and the turnaround all started with a major gamble by alabama head coach nick saban... who called for an on-side kick with about 10- minutes left in the game. the tide recovered... alabama scored again... and they never looked back as the team won coach saban his fifth national title.

time to take a look at the stories making headlines around florida. a blind man and his service dog are now recovering... after they were attacked by 2 other dogs. richard draper says he and his service dog "andie" were out taking their daily walk in their sarasota neighborhood last week. all of a sudden... he says two pit bulls came out of nowhere and started attacking them. one of the dogs grabbed andie's neck-- the other latched on to draper's leg. a bystander was able to pull the dogs off the pair. both are expected to recover... the owner of the pit bulls was issued a citation. a st. pete man man faces child neglect charges-- after police say a 3-year- old girl in his care ate synthetic marijuana. pinellas county deputies arrested 45-year-old christopher lee clark on sunday. investigators say clark had the drug in his pocket-- and at some point, the girl took it out and ate it. deputies say child had to be treated in the hospital-- she's expected to be okay. clark remains in jail on 20-thousand dollars bond. a woman accused of
