emergency crews out there. you can see how the side of the airplane there is actually charred. they had some issues there. we'll keep an eye on this as we continue on through the rest of the afternoon here. it is 4:01 right nouxt and two weeks ago a teenager was shot and killed at a cleveland heights mr. hero. >> romona: today the man behind that was sentenced to life without parole. sony patel was just 15 years old. today he learned his fate in shanelle's death. shanice. >> reporter: ramona, this case moved really quickly. patel pled guilty to 15 counts, including killing sonny. 15 members of the patel family in court, including his aunt, son any's aunt and upg ncle who were there the night of the

south taylor. in court the assistant prosecutor showed perry running out of the restaurant and dropping money. they say after that, he went on a crime spree. went onto rob a subway and then tried to rob a dollar general in cleveland heights but police arrested him. today sonny's cousin had a chance. >> i hate you for being the last person that sonny last moments being filled with fear. i hate you for holding my aunt and uncle hostage at gunpoint after you murdered my cousin in cold blood. all because you wanted a few quick and easy bucks. >> even though his life was short, he made a positive influence on the world. he made it a better place for you, me and everyone he met. you two would have benefitted from knowing him if you would have given him the chance.

it's a beautiful night here at wrigley field. it's everything you would expect this to be in their first world series in 71 years. it feels like the entire city is outside this ballpark partying right now. and inside the energy, you can feel it. even four hours away from game time. by the way, the tribe has made the move. terry francona putting carlos santana in left field and he will lead off. he's going for it. it could turn off if that bat comes alive. you look at pitching. kyle hendricks goes for the cubs. season. he's been great. especially in the playoffs. we got josh tomlin on the hill. i'm going to give you a stat here because he is well rested and ready to go. when josh tomlin pitches this year on six days rest or more, he is 5-0 with a .225 era. he comes into tonight on 12 days rest. they love his control. he won't walk guys. if the cubs are going to beat him, they have to earn it. >> i think adrenaline takes over and it's just another game. after this series, this is it.

of the story it was. if you watched game two, you had to listen to it all day. people all evening started coming out with memes like this. i don't know. that's probably not very nice. you get a little titanic scene. joe buck and kyle schwarber. so they took this to the next level. not just memes. there's now a joe buck and kyle schwarber wedding gift registry saying the relationship has advanced that much. what concerns me, this is the one that's pretty bed, bath and beyond. somebody has already purchased the sugar bowl for $9.99. i don't know where you send it to. but then there is this. there's a whole other gift registry. i like this one. a very nice picture. very thoughtful. joe and kyle. what i like about this one is you see it's baseballs, markers, pencils, notebooks and stuff. whoever started this one, if you buy anything off of this gift registry, it's going to the cleveland indians charities. so the kids charities.

and republicans are going to bludgeon her with this over the next 11 days. >> reporter: donald trump has made the outcome of the fbi's probe a focus of his campaign against clinton. >> they are reopening the case into her criminal and illegal conduct. >> it's uncommon for a wealthy candidate to face pressure from their donors, even when they haven't made such a big deal out of self funding as donald trump did. >> reporter: early voting is already under way in florida and 35 other states where 16 million people have voted so far. craig boswell, cbs news, the white house. >> laura: clinton's campaign team announced that the vice president joe biden is at the top of her list to become secretary of state. she was a popular west bartender murdered earlier this week. there's still not any arrests in the case. today catherine bosley is getting answers about who melissa brinker was. >> reporter: this is one of those crimes that leave you shaking your head and leaves somebody that knew melissa brinker nothing but wonderful things to say about her. this happened monday night at this little neighborhood bar. police are told four men walked in, ordered drinks and moments later two of them pulled out

floor. that's when 44-year-old missy brinker took a big chance. the bartender locked herself in a little back room to call police for help but only seconds later they broke down the door and shot her. many of her friends are regulars there that say they already miss her so much. >> she was happy all of the time. she loved everybody. she was smiling, singing, dancing behind the bar. >> i've known her about a year and, you know, the first time you seen her, you know automatically liked her. she's just so friendly and every time we come in she knew our names and right away -- just -- just everyone -- everyone loved her. >> reporter: she made people feel special. before she made a break for the back room, she even gave the robbers all of the money from the bar. she's from ashland. she leaves behind a boyfriend and brothers and sisters. she's very close to.

children look forward to but nearly two kids in every classroom have food allergies leaving millions of children unable to eat the candy they pick up on halloween. but as kenneth craig explains, a growing campaign is trying to change that and raise awareness. >> reporter: lucas is a happy, healthy 6-year-old who loves sweets. >> mom, i love those. >> reporter: and snacking. so naturally, trick-or-treating would seem like a perfect fit. but until severe allergy to peanuts and tree nuts turned halloween into a drag. >> because your friends can have all of these great treats and you have a nut allergy so you can't eat all of that stuff. but this year lucas couldn't wait to put on his costume and show us this teal pumpkin on his front step. >> stickers, budding. for tricker treaters with food allergies, it's a signal that a home is handing out non-food treats.

welcome back. our top stories right now at 4:00, the fbi is looking into newly discovered e-mails from the clinton's private e-mail server. while she was secretary of state. back in july, the fbi decided not to prosecute clinton who insists she did nothing illegal. and sentencing today for 20-year-old daveon perry who pleaded gilluilty to shooting a 15-year-old two weeks ago. surveillance video helped police catch perry last week. he was sentenced to life in

and the windians are hoping to live up to their name. folks flocking to wrigley field since it's the first time a world series game has been there for 70 years. the disappearance of a woman is starting to look suspicious. >> romona: she's been missing for nearly two weeks. and now chris tanaka reveals her ex-husband is on the radar of police. >> chris: that's right. she was last seen edgewater drive apartment on october 16th around 6:45 p.m. she's the mother of a 3-year-old son and had a protection order against her ex-husband. lakewood police told cleveland 19 they have arrested fahad syed for violating the protection order. they believe he had contact with her and her son around the time she vanished. syed has not been charged in connection with her disappearance.

she has black hair with a tattoo on her left wrist area. anybody with information on her whereabouts is asked to call lakewood police. you see the number 216-521-6773. getting answers, chris tanaka, cleveland 19. a 49-year-old willoughby police supervisor decided to retire before he was fired after allegations that he had sex with several women on multiple occasions. >> mark: all of it while on duty and in charge of his shift. well, paul orlousky reviewed the file of former lieutenant richard ashton and is getting answers tonight into what he found. >> reporter: this is former willoughby lieutenant richard ashton, and this is the investigative file which examined his behavior while on duty. the admissions of one woman regarding on duty trysts triggered the probe, which uncovered on duty room ps with three other women.

ranks of the department from patrolman to sergeant to lieutenant. >> in any workplace obviously you're going to have a certain percentage of problem employees. >> reporter: ashton's problems began in january while on duty and in charge of the over night shift, he stopped at the willoughby brewing company. he began talking to a 21-year-old woman. she was drunk and by the description of another officer working off duty security at the bar, she was coming on to ashton. they talked for about 45 minutes and ashton left. when the bar closed, duty officer saw the woman getting into her car. he called ashton to tell her she was too drunk to drive. he went looking for her and tailed her for miles into the lake metro park, down the hill and finally here to isolated gully brook park where she pulled over to sober up. he got into her vehicle with her. she vomited two or three times and after about 15 or 20 minutes, they had sex. ashton left the woman alone and partially naked here in the park. she passed out. he returned a couple of hours

her. she was still partially naked. he came back then later around 6:00 in the morning. that time he was able to wake her up. she got dressed and drove home. the investigation was triggered when the woman told another officer what had happened. to the department's credit, the investigation was thorough and through it detectives found three other instances of on duty romps by ashton, as well as romps while he was working side jobs. one night while married, he was supposed to be working security but he was off havin woman called sandy. a crime occurred. it was broadcast on the police radio and involved a chase. the woman heard the call. ashton never left to assist fellow officers. ashton met a married woman at the oktoberfest. mondays later he contacted her and a two year sexual relationship began. she told investigators he never stripped everything off, he always kept everything on. that included his uniform and

buildings, as well as side job locations. >> help the community out. used bad judgment. that's about it. >> reporter: the investigative file included that ashton should be terminated but before that happened, he retired. and, yes, he is getting his full pension. the chief says the department at that point moved no further towards termination. >> at that point the officer has a chance to file a grievance. and then the grievance procedure begins way up to arbitration hearings which could take months. >> reporter: bottom line, it would have cost a lot of money to officially fire him with no change in the pension payout. >> someone is vested in the pension. they can pull their retirement any time they please and without any notice. so basically we could serve the termination and before we ever went to hearing, he could go ahead and retire. he is entitled to his pension either way, so nothing would really change.

ashton admitted the incidence and what he had done saying only he put himself in a bad position. no acknowledgment of what he has done to the department's reputation and the perception that while what he did was perfectly legal, he somehow contributed to a leaf tha-- bel that he got over in the system and he never admitted the dangers he left the woman in in the park until now. >> dowry gret the danger y might have left her in? >> yes. >> what would you say to her right now? >> just trying to do a favor and i used poor judgment. if i had to do it all over again, i wouldn't. >> reporter: getting answers, paul orlousky, cleveland 19. >> romona: the retirement did exclude ashton from participating in what is called the drop program. now, over the years, that will cost him tens of thousands of dollars. there are no limits on his

[ laughing ] >> romona: well, as you know, it's game three of the world sow rees tonight and it's in chicago. so you know that's where sports director tony zarrella is. he joins me now live. tony, tomlin has been sensational in his last two starts. so why are people nervous about him >> reporter: i don't know why. i mean, this is a guy who has master control on the mound. and if you really wanted to decide -- you want to go with bauer in game two in front of a home crowd and then when you get to this place it will be rocking tonight, as you know, you put a guy like tomlin in who is not emotional. he'll just go out there and do what he does. after his slump in august, he was pretty bad in august, he turned it on. he has been good. ro, very quickly, i want to show you the scene here. i was really hoping for an exclusive but i don't think that's going to happen.
