let's get into the top five this morning.... elias: the trial of pete polson resumes this morning, as the jury continues to deliberate his fate... polson, who faces charges following a shooting spree in pleasant hill last november, was the last of 40 people to take the stand before closing arguments. local five will be there as the verdict comes down. elias: in the number two spot this morning... elias: authorities in florida continue the search for a person who opened fire at a crowd saturday. the shooting spree left five injured and one person dead. police had to completely evacuate downtown fort myers....where more than 20 thousand adults and children were roaming the streets as part of zombi- con. elias: the third thing you need to know before you walk out the door... elias: a homeless community hopes to stave off eviction from the city of des moines, and a local ministry is working to meet

their everyday needs. the thankful leper has set up a program to help give the homeless people what they need to survive day to day life. homelessness continues to be a problem for hundreds of people in des moines. elias: number four... elias: talks of a merger between two fire departments in the metro who are facing staff shortages. the clive fire chief says they're looking to join forces with nearby windsor heights. there will be a public meeting tonight to get the opinions of those that live in both communities. elias: and finally in the top five... elias: 75-hundred athletes from around the world laced up their shoes and filled the streets sunday for the i-m-t des moines marathon. the winner this year was returning champ philip lagat of kenya with two hours, 21 minutes and two seconds. this is the 13th year for the event. local 5 is a proud sponsor of the marathon.

elias: this morning, des moines police continue the investigation of a sunday drive by shooting. elias: police received a call about gunfire on east 12th street around eight last night. the caller heard two gunshots, went outside, and saw a hispanic man walking down the street. that man told the caller he was shot. police say the caller told them they saw a larger car take off south bound . it is unknown of the victim was injured but police did find shell casings at the scene. elias: for much of the nation this morning....a crisp warning that cold temperatures have arrived and the snow is sticking. over the weekend .....snow fell near the great lakes...and widespread flurries across the northeast. abc's stephanie ramos has the details. over the weekend, a military family got quite the surprise while tailgating at the cyclones game. "it is such pleasure of mine to present to your family a check which is reflective of free groceries for a year" elias: master sergeant clayton jensen served in the u.s. army for 15

years and received two purple heart awards. he and his wife were invited to the game at jack tryce stadium and were free groceries for a year. the jensen family was also recognized during a special presentation before the start of the game. elias: it's a race for time by retailers as more people shop online....and with the winter holidays shopping season approaching , amazon, wal- mart, and other retailers are working behind the scenes to make sure they can deliver online orders to shoppers faster. retailers are building bigger warehouses - some the size of 20 football fields - to handle shipments. they're also sending orders to shoppers directly from their stores and using sophisticated software that tells them the quickest, cheapest way to get orders shipped. u.s. online sales are expected to increase by 12 percent this year. elias: speaking of amazon, the online retailer is now going after people who reportedly sell fake reviews for products on its website. the company says more than a- thousand people sold 5-star reviews through "fiverr-dot-com". that's a website where odd-jobs can be picked up for as little as 5-dollars. amazon's policy bans fake product

and now, the city is threatening several groups that have set up camp around town with eviction notices. one group, called the thankful leper has set up a program to help give the homeless people what they need to survive day to day life. that includes things like toiletries, clothing and food. there's no limit on what the homeless are allowed to take, and organizers of the event say it's especially important to help them get back on their feet.

candidate larry lessig has called on 35 n-b-c affiliates to provide equal time for their candidate....at issue, a recent appearance by democratic frontrunner hillary clinton on saturday night live. clinton made a guest appearance on the show on october 10th...which lasted three minutes and 12 seconds. lessig's campaign requested the same amount of time to address voters. nbc sent a memo to its affiliates, the day after clinton's s-n-l cameo, reminding them they might receive equal time requests. this also brings up an interesting situation next month....when republican frontrunner donald trump is set to host the late night comedy show. this raises the prospect of his gop rivals asking for equivalent opportunities to reach nbc viewers. but those candidates won't be able to submit their requests until after the trump broadcast. november 7, elias: at ((time check)) we'll take a short break but

streets of des moines sunday... the winner of this year's des moines marathon was returning champ philip lagat of kenya with two hours, 21 minutes and two seconds. as for the women-- brook (da-gef-a) degefa from ethiopia took the prize with a time of two hours and 33 minutes. "nats ready go we get a lot of intresting stories every runner has a story these two guys are unique i've never seen anything quite like what they're doing i"m from team 99 counties we're running across every county in iowa to benefit the american heart association and to raise awarness for physical fitness their stipulation is in every county it has to be a marathon distance and if you look at a map of iowa there are some counties that aren't quite 26 miles if thats the case they do a loop nats cowbell it started at a christmas party in 2009 we decided we were tired of running the same routes so we started talking of running to one town to another it was like a train wreck of circumstances it was one good idea lead to a bad idea and here we are today we thought it'd be fun to run from one place to another then we ran across one county without thinking of the logistics of driving all across iowa to run across all of iowas 99 counties nats good job gatorade you can do this i don't think we ever run out of things to talk about its constant banter while we're running theres always something to talk about its been fun we stick together and it kind of awlays works where if one of us is down the other one is up you kind of pull each other along everythings a
