she spoke with students who are shocked by the video. she joins us now with more in tonight's big story. kattey: thanks to some quick thinking middle schoolers... this bus driver ... 61 year old robert scarbough of west des moines was handcuffed in the middle of the bus route. the students were able to flag down a deputy at the next stop... and showed him on their phones what they had just witnessed. (nats) students begging a bus driver to leave a 15 year old special needs student alone in this disturbing cell phone video. "why! why would they do that!" johnston middle schoolers were on the bus ride home thursday afternoon ... when police say 61 year old robert scarbrough got upset the victim wouldn't sit in his assigned seat. when the student responds with some strong words .... "the driver ends up striking the student in the face and pushing him in the floor on the bus." a group of kids reported the incident they caught on camera

to a deputy who happened to be at the next bus stop. the student was treated and released at the scene ... but investigators took scarbrough away in handcuffs. "it's disgusting" students at johnston middle school were quick to support the victim ... who they say may not have understood what was happening. "he's mentally challenged, he's always been really nice, and i don't think he knew what he was saying, i think he was just taught to say stuff like that." "he's very cheerful. he's amazing." officials with johnston community school district say scarbrough passed all background checks when he started working for the district at the beginning of this school year. they say he knew the student was special needs. "our drivers undergo regular behavioral training as part of our positive behavior intervention and support system, and this person made a poor choice on how to handle a behavioral issue." kattey: tonight scarbrough is in the polk county

jail charged with child endangerment and assault causing injury. extra counseling will be available to students ... and the district says there'll be extra training for all bus drivers from now on. in the studio kattey ortiz local five news we are iowa. stephanie/ramvo: halloween is all about the scare, but the des moines fire department says it's not worth your safety. despite city ordinances that regulate who can open up a haunted house - des moines fire is worried that "quick hit" pop up houses are getting by the inspections meant to keep you safe. local 5's nikki davidson is on your side tonight stephanie: as she shares ways to keep you scary safe this halloween. the fun of a haunted house... is the thrill of the unexpected... (fade to video) back in 1984 eight teens entered a six flags haunted castle attraction and never came out after a fire trapped them inside the structure... there were no smoke alarms or sprinklers inside. 4:14:13 the disorientating nature, people are not familiar with the layout of a building, it's important to have safety measures in place. des moines fire marshal jonathan lund says thirty years later... haunted houses have a whole new set of rules for how they get their frights. smoke alarms, sprinklers, lighted exits, and a "kill switch" --- one that turns on the lights and allows customers to easily get out are required... and flamable material like black plastic

coverings and dead end mazes have been banned. 4:55:08 it was hard! an investment -- costing thousands for haunts like linns 5:09:03 i had to double my sprinkler systems, go above and below, you don't normally need to do that but i did. in order to legally operate a haunted house in des moines , it has to be inspected by the fire department... 5:08:38 they check it out really check it out. a process that means now... linns is the only legal haunted attraction in des moines city limits. 4:18:03 applications have been denied because systems aren't in place. 5:09:19 you can't do it unless you own the building. it's tough. but for fire departments like des moines... the real scare isn't these guys... (nat) its attractions that slip through the cracks... and break the law by opening up without an inspection or permit. 4:18:30 it's difficult to keep up with them, some of them are gone by the time we're notified we're there. fire officials say it does happen nearly every year... and its hard to keep them

closed. 4:19:18 location changes or short duration events, it might be next monday we find out, and it's packed up and gone, it's a big challenge for us. and there's another loophole... many smaller communities never created a haunted house safety ordinance ... which means the houses can move shop over there... and legally open. (nats pop here) that was the case in pleasant hill, up until last year... when the city council changed code to enforce safety measures. two out of three long open haunts that had been open for years failed inspection... but that didn't stop one from trying to open up anyway in 2014. the pleasant hill fire department was tipped off that white water university opened its their doors despite failing the inspection. des moines quickly interupped... and shut it down while customers were still attempting to pay to enter. it's owner craig smith

tried to stay open with a permit because he didn't feel his attraction was dangerous. make sure the date is on the video and super (it wasn't last year, or the last 30 years. it's all in the eyes of the beholder... what the city wants done. but the pleasant hill fire department found in their inspection that it filled with (graphics) combustable materials, lacked fire extinguishers and had no sprinkler system. its a risk safety experts say should be enough to send your family -- screaming... and leaving behind. 4:15:25 it's just a hazardous reccomends before you head out to a haunted house... you call your local fire department and check to make sure the business is operating with a permit. if you know a place operating without a permit... they want you to give them a call. jack/ots: even city property isn't safe in polk city. two ford f-35o trucks and the tools inside were taken from inside the public works building. the burglars broke into a

point between employee shifts at 5 p-m wednesday and 6 o'clock this morning. the trucks have giant polk city logos on the side, and would be easy to spot. but that's one reason why police say the thieves may already been stripping the trucks down to sell off the parts. "roger sanders, polk city interim police chief: "nobody's done anything wrong, nobody's done anything negligent. everybody's done exactly what they're supposed to do. the only people who've done anything wrong here are the thieves who've broken into our facility and stolen our equipment." " jack: so far, there are no suspects. stephanie: a major break in a decades old child abduction case out of minnesota. stephanie: 11-year-old jacob wetterling was kidnapped in 1989 when he was riding bikes with his brother and a friend. tonight, investigators have arrested a man they say is a person of interest in the case. police say back in july, they searched 52- year-old daniel heinrich's home and found a bunch of child pornography. right now heinrich is only a person of interest in the wetterling case... but this case sparks memories of these two young men missing from the metro around the same time, johnny gosch and eugene

iowa's mosmeteorologist brad edwards and local 5 sports with sports director jon schaeffer. this is local 5 news at 10. we are iowa." stephanie: governor branstad has a plan for out-of- state companies to take over iowa's medicaid program, but it's not going smoothly. the latest hiccup is this hearing. a former iowa lawmaker on trial, renee schulte, accused of using inside, confidenditial information to

those out-of- state companies selected to take over iowa's medicaid. the iowa hospital association has been opposed to the governor's plan from the start and says this trial is only one of many concerns. there's a lot of process that's been tha thave been pursued, and ultimately whether it's in the bst interest of iowans across the state. " stephanie: governor branstad said he wouldn't talk about the trial that's underway, but says he's going to take the necessary steps to moderniz and improve medicaid in iowa--while eliminating duplicate services. jack: children living in deplorable conditions as we take a look around iowa now. the parents charged with endangerment. jack: police went to anthony arbuckle's house in perry to serve an arrest warrant for him failing to pay child support. when officers went inside, they found the house was in complete disarray. there say there are piles of trash, rotten food, and cockroaches throughout the house. four children and their mother were living there, too. arbuckle and the mother of

the children were each charged with four counts of child endangerment. jack: charges are now filed in a school bus crash in eastern iowa earlier this month. 32 students were taken to the hospital after an suv crashed into the bus in manchester. all the kids were released the day of the crash. tonight, the driver of the suv, monte klink, faces several charges serious injury by motor vehicle, operating while intoxicated, and failure to yield. klink bonded out of jail today, but is set to appear in court november 4th. jack: imagine answering your door to find two men holding guns. police say that's exactly what happened in a fort dodge burglary early this morning on first avenue north. the people there say the two armed men stole things from the home. tonight there are no arrests or suspects. stephanie: jon joins us now-- regional volleyball ... getting closer to the state tournament. jon: yeah stephanie it's win or go home coming up on local 5 sports we'll take a look

(alex giaimo) all season long the hawkeye mentality has been stepping up to to fill in when somebody else goes down. on saturday sophomore running back akrum wadley will get his first chance at starting this season with jordan canzeri sidelined with an ankle injury. (akrum wadley) i've been waiting for this moment and it's come now i just got to step up the plate and deliver. (giaimo) in the first game this season wadley was tested but he couldn't hold on to the football much to the chagrin of his head coach.
